Declan McCullough is looking at one of the anti-spyware bills that's rocketing its way through Congress so that politicians can tell their constituents that they "banned spyware" in time for the November elections. Unfortunately, like with the CAN SPAM Act, the bill they're pushing could possibly make the problem worse, not better. Even more annoying is that it sounds as though a much better anti-spyware bill has been introduced by others -- but politicians have no time to actually look at which one is better, since they need to rush this bill through before they all run home to campaign for the election. Politics at work.

The Protecting Intellectual Rights Against Theft and Expropriation ( PIRATE ) Act would expand the Justice Department 's power to pursue copyright infringers. In a related vein is the proposed Piracy Deterrence and Education Act , which would establish punishments for and further government abilities to pursue traders dealing in unusually high amounts of content.

Aren't unintended consequences wonderful? Now that anti-spam legislation is becoming popular, one result is that spammers aren't wasting time with just spamming mortgage offers and ways to buy Viagra. Instead, now that they realize they're definitely on illegal ground, they're moving more towards malicious attack spam, including phishing attacks and trojan horse attacks. In other words, if they're going to break the law with spam, they figure they might as well go all out.

With the rise of ringtones, it seems that some have really taken the idea and tried to run with it. So far, certainly, ringtones have done well for some companies, but it's still not clear if it's a sustainable market, or a faddish one. There's also the fact that the industry continues to deny that file sharing of ringtones could ever be a risk -- which suggests they're only asking for serious trouble down the road. Still, the latest move is that one company has set up a record label just for ringtones. Because, already, musicians have separate labels for CDs and videos and digital downloads and... wait a second... no they don't. Most musicians basically sign deals with a single recording label to handle all of their musical endeavors, so it seems sort of strange to have an entirely separate label for ringtones only. For recording labels that don't already include this in their standard contracts, they will soon -- and then this new "label" will be out of luck. Of course, the reality is that it's just a way for this company to get a little extra publicity for these "unique" ringtones. Considering that part of the reason ringtones are so popular, though, is that people recognize the songs they represent, it makes you wonder if people really are that interested in songs that are designed just to be ringtones. Seems sort of like a niche market within a niche market.

I've written before about the wireless carriers' current obsession with ringtones. It appears to be a booming business, to the point that others are muscling in on the carrier's turf by offering "non-authorized" ringtones or even the ability to make your own ringtones (for a fee, of course). While it may be good money in the short run, I still don't see how it's sustainable. As mobile phone platforms are increasingly open and standardized, ringtones will go through the same Napsterization process, where many will be available for free. Meanwhile, I still don't understand what's wrong with the good, old-fashioned vibrate mode that doesn't bother anyone around you. However, the article does mention the growing popularity of the silent ringtone that we wrote about last week. Apparently, it costs $2. Incredible. We've reached the point where people are willing to pay to have their mobile phone not ring. Maybe the next step is letting people pay to have someone else's mobile phone not ring. "My goodness is your ringtone annoying. Here's $2. Go buy yourself a silent ringtone."

It's like watching a bad movie over and over again, each time a somewhat promising market starts to open up for the recording industry, they all do their best to kill it. Earlier today we saw how they're looking to kill the promising market for immed iate live recordings of concerts, but now it looks like they may be killing off ringtones. For the last year or so, ringtones have been the surprising revenue generator for both mobile phone carriers and the recording industry, and despite plenty of warning and predictions that this market couldn't last, the recording industry isn't known for their ability to understand how technology changes will impact their business over time. Already we've seen applications like Xingtone take the industry by surprise by daring to let users make ringtones out of music they've legally purchased - and it won't be long until ringtones are easily downloadable directly to mobile phones via a Napster-like application (if it doesn't exist already). Still, the music industry sees money, and are increasing the royalty rates they charge for ringtones, making them more expensive. In fact, ringtones that are mere snippets of songs cost much more than actually downloading the full song from any of the various download music stores out there. Of course, all this will really do is drive more people to investigate alternatives like Xingtone, and make the "market" for selling ringtones disappear quite quickly. This was going to happen eventually no matter what, so maybe, by raising prices, the industry is just speeding up the process.

I missed this until I came across it a Susan Crawford's site, but apparently Google is starting up an Internet phone service. The TimesOnline article bases this on an employment ad looking for a “strategic negotiator” to help the company to provide a “global backbone network.” So, if Microsoft is trying to expand by getting Windows into our living rooms, perhaps Google is trying to get itself inserted wherever there's a telephone...including wifi phones, if bastards like Verizon let up their headlock on state legislatures.
