Xeni Jardin: A blogger who describes himself as an "extraordinary ordinary guy in Japan" says this on the 30th anniversary of Hello Kitty:
"Kitty's design was just a crib from ... Musti, created by the Belgian animator/director Ray Goossens (1924-1998) [Ed note: she's the center figure in the BoingBoing graphic at left]. Musti was started as an animation series on TV in 1968, and its picture books were also published. I read some of that books and loved it in my childhood. Although it is evident to everybody that Kitty was an imitation of Musti, Sanrio, the publisher of Hello Kitty have not touched on it. It is said that the total copyright fee for Hello Kitty reaches around 15 billion yen (13.7 million USD) per year, and Sanrio got 23.7 billion yen (21.6 million USD) gross sales in second quarter of 2004. I wonder why they don't feel shady about hiding the fact."

As someone who has never used Kazaa, I have no idea how its use has changed over time, but apparently, more and more users are bailing out. They're fed up with the adware, the lawsuits (which often target Kazaa users) and all the bogus files. Of course, while that might sound like wonderful news for the recording industry, it's actually much worse. Users aren't giving up on file sharing, they're just switching to other offerings that include more useful features and less annoying crap (gee, what a surprise). The article points out that the various lawsuits against Kazaa owner Sharman appear to be taking their toll as the product has been unable to keep up. However, this whole thing points to a much more important fact: users are going to keep migrating to better products that are further underground. Each time the recording industry thinks they're declaring victory, they're just making their own job harder -- and I don't just mean the job of tracking down and suing file sharing individuals. They're making it increasingly difficult to set up a system that actually embraces file sharing, while still giving them the ability to make money. They could still do it, but they've given no indication that they intend to go down that path. Instead, they seem to enjoy making things worse for themselves, because that lets them keep complaining.

While many have been following the story about the music police raiding Sharman/Kazaa's office, one competitor thinks it's a good thing. Streamline, the makers of the Morpheus file sharing application, has a long history with Kazaa - as they used to license the same technology until they were accused of not paying their bills and were shut off. So, clearly, they are a bit biased against Kazaa, but they're bringing up a very important point. The whole point of having a truly distributed file sharing network is that it can't be shut down, even if you shut down the folks who released the software. Yet, Morpheus was shut down two years ago which made many people questio n how this was possible. Over time, these questions have faded, but the folks behind Morpheus are raising the question again and saying that Ka zaa is really centralized - and have been hiding behind their odd corporate structure to hide this fact for the last couple years. That would be quite a revelation, and would seriously damage Kazaa's legal standing. Thus, the folks behind Morpheus are hoping that the questionable raid on Kazaa's offices will establish this for certain. It appears that, once again, there isn't much harmony in the file sharing world.

Apparently, catching copyright violators is becoming a profitable business in Korea.  So called Net-parazzis (Net + Paparazzi) are prowling the Net in Korea to catch unsuspecting copyright violators anyway they can in return for a cut of the financial settlement between the copyright violator and the copyright holder.

One Net-parazzi business found 18,000 violators in the past 8 months.  Settlement fees range $500~$1000 for adults, $300 for university sutdents, and $100 for minors.  With split of 40% for Net-parazzi, 40% for the lawyers, and $20% for copyright holders, Net-parazzis are making decent profits.  So far there are 10 such companies but the number is expected to grow rapidly because Korea is full of smart net-savvy yet jobless youngsters.

For all the complaints we have about bad laws in the US, at least (so far) we've been able to keep from declaring file sharing software (on its own) illegal. That's not the case in Japan, where the creator of a supposedly anonymous file sharing system ha s been arrested for "abetting the violation of the Copyright Law." Apparently, the fact that such software has plenty of legitimate uses as well doesn't matter. Shouldn't they also be arresting the creators of just about any other technology that can be used to break the law? In this case, they say it made sense because they have evidence that two people used his file sharing program to download illegal files. I think there's plenty of evidence that computers have been used in crimes. They should be arresting everyone who created computers. Plus the internet is full of criminals these days - so the folks who started the internet clearly to be thrown in jail. Just think how many crimes have been committed by people in cars! A pen can be used for both forgeries and to stab someone. Someone ought to be locked up for that. The list is endless. Clearly, no technology at all should be created and anyone who created any technology deserves to be in jail.

Digidesign on Monday announced that it will soon add Ableton Live Lite 4 Digidesign Edition to every Pro Tools TDM and LE music production environment. A free update from Live 2 Digidesign Edition is available for registered owners at the Ableton Web site. While Live Lite 4 is a feature-limited version of the full Live 4 music recording and mixing software, it adds functionality not present in the previous version of the Digidesign Edition, including better control of volume, pitch and timing, new audio and MIDI effects and more.

These guys are pretty upset. Symantec's new Internet Security suite combines a firewall, anti-virus utility, and content-filtering parental controls in one package. And guess what? When a user sets the filter to block "Weapons" sites, it blocks NRA pages!

Internet Security 2004 isn't really the issue, however. It's a (large) "community" once again overreacting, spreading FUD< /a> about rights being taken away, political brainwashing, and the world coming to an end.

Earlier this year, we noted that the Justice Department was telling websites they might be "aiding and abetting" illegal activity by running ads for online gambling operations, even if those operations were perfectly legal and run outside of the US. Now, the operator of a casino news website, Casino City, has filed a a lawsuit to have it declared that running such ads is protected free speech, and that the government can't tell them to stop. Of course, there are some precedents, such as bans on liquor and tobacco advertising, but it doesn't appear that any specific law has been put in place banning gambling ads. Still, all of this makes you wonder if the Department of Justice doesn't have slightly more important things to be worrying about than if a casino news site has ads from online casinos.

While the FCC has fined AT&T for violating it's own do not call list and California has gone after a telemarketer for violating the national do not call list, the FCC has finally made their first warning to a company for violating the national list. They've been told they face an $11,000 fine - per call - if they continue to violate the list. Here's where it gets a little strange. The company doesn't deny that they've been calling people on the list. I figure, if they admit that they've been willfully ignoring the list, why should they get a warning? Why not set the fine now?
