Jonathan Band, a copyfightin' lawyer from Morrison & Foerster, has
created a great roundup of the amicus briefs in Grokster, the Supreme
Court case where EFF will argue the right of P2P developers to make
tools without having to anticipate and prevent copyright infringement
in their designs. The highlight of this is a chart in which the
various positions of each of the amici is summed up on a grid. You

WIPO Development Agenda proposal
scorecard: USA, Mexico, UK all blow it
04/09/2005 12:28 PMCory Doctorow:
Next week, non-governmental organizations, rightsholder reps, and
national delegates from all over the world will converge on Geneva to
meet at the World Intellectual Property Organization, for a landmark
meeting on promoting development through copyright, trademark and
patents.
This comes out of last fall's "Development Agenda," where India,
Brazil, Argentina and other developing countries held WIPO's feet to
the fire and demanded that it adopt a formal policy to act like any
other UN agency: that is, to promote humanitarian goals, not higher
levels of copyright restrictions.
In the interim, it's been clear that WIPO and the rich countries it
has traditionally served aren't exactly thrilled about this -- for one
thing, they
stabbed the public interest groups in the back and arranged to
lock nearly all of them out of the room.
With the meeting about to start, the national delegations have started
to produce documents describing their proposals. Mexico -- captive
state that it is -- has produced an embarrassment of a document
calling for more copyright to save development. The US has produced an
even dumber document saying that the solution to development is to
assign developing nations "buddies" from the developed world to show
them the ropes. The UK's document says that they think this stuff is
important but aren't willing to do anything about it.
Shining out like a single rose on top of a mountain of crap is a
12,000-word detailed analysis by fourteen nations ("the friends of
development"), explain exactly what they mean when they talk
about facilitating development.
Jamie Love's done a great analysis of the proposals, with a scorecard
on which buzzwords the different papers use, and how often they use
them:

their own greenhouse gas emmissions. Their
Tree
Totaller (Australian-based, but I'm sure conversions are
easy) works out how many trees you need to offset your annual
emmissions, based on private car, home energy use and flights. It's a
very neat little flash-app, and at the end it lets you chose to
"subscribe" to Greenfleet so they'll plant the necessary
number of trees for you. I owe 44 trees, for only AU$103 a year.

A new study (in a biggish PDF) from
PRI states that most
environmental indicators in the United States have improved
dramatically since the 1970's regardless of the political party that
controls the White House. Notably: "CO (Carbon monoxide)
levels were the lowest recorded during the past 20 years"
(EPA, 2002, pg 48), ambient lead levels have fallen 98% between 1976
and 2002 (pg 46), and sulfur dioxide has fallen 70% since 1976 (pg
44). (Mostly) Happy Earth Week, right?

OCLC Environmental Scan Now Available
01/09/2004 10:11 PMThe 2003 OCLC Environmental Scan:
Pattern Recognition
"From the document, 'The 2003 OCLC Environmental Scan: Pattern
Recognition report was produced for OCLCs worldwide membership
to examine the significant issues and trends impacting OCLC,
libraries, museums, archives and other allied organizations, both now
and in the future. The scan provides a high-level view of the
information landscape, intended both to inform and stimulate
discussion about future strategic directions.'
Intro
and Flash Graphic of Several Stats Contained in the Report ||| D
irect to Full Text" [Resourceshelf]
I saw a piece of this report last month and even had the chance to
provide some feedback and comments that made it into the final
version. I have not yet had time to read the whole thing, but what I
did see was pretty solid and does provide a good overview of current
and future issues for libraries. Naturally, I agree with a lot of
what's in the report, although I did have an interesting dialogue with
the author, which is where some of my quotes come from (mostly in the
Future Fr
amework section).
Some of the quotes that are not from me but could be because of
their "shifted-ness" include:
- "Wi-Fi, short for wireless fidelity, is a
technology that has captured the heart of the information consumer and
is filling tables at coffee shops across the world.... Jupiter
Research reports that 6 percent of U.S. consumers have used Wi-Fi
services in a public place. Why not make the library the first public
place for the next 50 percent?
- The high school students interviewed for the scan told us that the
technology tool they wanted most was a PDA device that 'contained all
the information they needed to do their work.' Vendors are
responding. Several vendors now offer PDAs under $100, making it
possible for the information consumer to get a PDA for about the price
of two video games. Personalization, alert technology
and other PDA-friendly information services have brought a world of
convenience to the business user. The information consumer is ready
for libraries to bring 'all the information they need to do their
work' to their PDAs." [Security, authentication, and Digital Rights
Management (DRM), p.
5]
- "What if libraries and OCLC and all the other players in the world
of structured access to information erased the organizational charts,
the artificial separations of content, the visible taxonomies, and the
other edifices real or otherwise built to bring order and rationality
to what we perceive as a chaotic universe? What if we built an
infosphere rich in content and context that was easy to use,
ubiquitous and integrated, designed to become woven into the fabric of
peoples lives; people looking for answers, meaning and
authoritative, trustable results? How do we take information,
information sources and our expertise to the user, rather than making
the user come to our spheres?" [Future Frameworks, p.
5]
It will be interesting to gauge the reaction to this document
and to see if OCLC
can successfully use it as a springboard to implementing the
frameworks discussed (or helping their members to implement those
frameworks). I hope they do a follow-up in a year to evaluate its
impact on the organization and/or libraries. Personally, an API into
WorldCat that could be used
as an
ISBN lookup service would be pretty high on my list in terms of
integration into the web in the user's infosphere (hint, hint).
OCLC is soliciting feedback about the report, so feel free to contribute your thoughts to
them.

"Bring

(PDF)." An independent survey just released by the UK global
health charity Medact, finds
that "the war on Iraq and its aftermath exacted a heavy toll on
combatants and civilians, who paid and continue to pay the price in
death, injury and mental and physical ill health. Between 21,700 and
55,000 people died between March 20 and October 20, 2003." Accord
ing to the BBC, the report says that the "conflict and its
aftermath have put the most vulnerable in society - women, children
and the elderly - at risk", and "there has been a reported
increase in maternal mortality rates, acute malnutrition has almost
doubled from 4% to 8% in the last year and there is an increase in
water-borne diseases and vaccine-preventable diseases."

Bill Gates recently got together with Steve Mills from IBM and
demonstrated some web services interoperability between our two
companies' products. It has taken awhile to get to this point,
from the initial hype to the point where some of these key scenarios
work without smoke and mirrors; so it is nice to see a "status report"
like this.
The first response I saw came in the form of this shrill attack
piece run on CNET. The author seems stuck in the last
century, when people still bought the big lie about "write once run
anywhere". He fails to explain how "runs only on Java" is
significantly different from "runs only on Windows", and completely
misses the point that most enterprises have to support both
types of systems (and many more) and therefore place a high priority
on interop.
The attack piece brought back fond memories of the days when Bob
Metcalfe and Jai Singh (now managing editor at CNET) were together at
the helm of Infoworld. Then I saw another analysis in
CNET, covering the same interop event, but surprisingly balanced,
at least in comparison to the first piece. Finally, I found yet another
analysis on CNET, again covering the same event; and this one is
positively glowingly accurate!
What to make of it? A single presentation by Bill Gates
inspires three different pieces in CNET which cover the whole spectrum
of opinion. Can't complain about that.

Tragically, politics shuts down
