01/07/2004 06:36 PMWe all know now that the CAN SPAM law is a disaster and is unlikely to
do anything useful in the battle against spam. It's also becoming
clear that the entire point of the bill was never to stop spam, but to
make a few folks in Congress look good (which seems to be the entire
point of most politics these days). First, Business Week spends some
time
comparing the mostly effective federal "Do Not Call"
list with CAN SPAM. The DNC list was planned out carefully by the
FTC and the FCC, and, while it upset many telemarketers, it was
designed in a way to be effective. There was also enough time, and
enough publicity given to the list that people knew about it and had
the opportunity to sign up for it - while marketers had the ability to
prepare on their end as well. With CAN SPAM, however, it was rushed
through Congress with little thought towards whether or not it would
actually do anything
and without any money to actually deal
with any of these cases. Meanwhile, the NY Times reports that the
sponsors of the bill
asked the FTC to
sue a spammer the very first week the bill was in effect in order
to make a big "splash" so they could pat themselves on the back - even
as the spam levels continued to increase. FTC Chair Timothy Muris
(who has spoken out
against
this spam law) apparently laughed them off and pointed out it was
impossible to do such a thing. First of all, in order to violate the
law, the spammers have to ignore an opt-out request. Then, the FTC
would have to track down who the actual spammer was - with no
additional funds, because the law didn't provide for them.

exploding costs of health
care as they are due to the company's

Keith, I'm not sick of standards themselves; I've been using them for
over two years now and couldn't conceive of developing without them.
Unlike Keith, I'm not tired of advocating them - but I thoroughly
believe that it's time to extend the discussion.
As web developers and designers, we face an abundance of
challenges. Sites must be fast, accessible, usable, well designed, findable and search engine friendly, with
smart URLs, well managed communities and maybe even a sense
of humour. Most of us find ourselves taking on the role of copy editors, programmers, designers, information
architects, and much, much more. In addition, we frequently run in
to problems that have no correct answer (font sizing is a classic
example). Trade-offs have become a way of life.
It's time to extend the discussion. Web standards are a
small but vital part of a larger solution, something I like to think
of as web development best practice. Let's face it:
web standards are boring! Focusing discussions on them is like taking
cooking lessons from a chef who only ever talks about food safety;
sure they're important, but there's so much more involved in creating
a decent meal.
There are plenty of benefits of re-framing web standards
in the larger context of best practice. Firstly, discussions get a lot
more interesting - as I've just demonstrated, there are enough facets
to creating effective sites to keep us talking for years to come.
Secondly, wrapping web standards in the larger context of industry
best practices makes them a much easier pill to swallow. "Our site
doesn't validate" is a turn-off. "Let's follow industry best practice"
is far more appealing.
As a community, we need to work together to discover the
best ways of doing things. We've discovered web standards: let's move
forward to the other pieces of the puzzle.

01/28/2004 02:33 PMThis post about web standards struck a chord wih
me. Because I promote
TopStyle as a tool for building standards-compliant sites, I
frequently get email reporting that my own site doesn't validate.
However, the reason it doesn't validate is quite simple. My site
uses Atomz search, and Atomz offers
proprietary elements which control how a site is indexed. For
example, Atomz won't index anything wrapped in
<noindex>..</noindex>. I use
noindex elements on every page to skip indexing the
navigation links, which causes the W3C's validator to complain that my
site isn't valid XHTML. This inevitably leads to email from people
calling me a hypocrite.
Now, I'm all for web standards. I've been creating sites since
1995, and I've learned the hard way how writing browser-specific code
leads to problems down the road. However, I consider
standards-compliance a goal, not a requirement.
Limiting the usefulness of my site's search feature just to make it
100% valid XHTML seems way over the top.
Standards-compliance isn't an uncomprising religion, but rather a
practical business decision that must be weighed alongside the other
goals of your site.
