Apple on Tuesday opened for business its iTunes Music Store to customers in the UK, France and Germany. Apple said that a European Union version of the store is coming this October. Music is priced at €0.99 or £0.79 per track. The iTunes Music Store launches in the UK, France and Germany with more than 700,000 songs in its catalog, with songs from popular commercial artists represented by the five major music companies as well as dozens of independent record labels.

While the courts in the US still seem to be a bit confused over the purpose of trademarks in lawsu its against Google concerning advertising based on trademarked keywords, it looks like the German courts may have a clearer picture. A similar lawsuit brought against Google in Germany has been dismissed, though details are not given. Again, the purpose of a trademark is to avoid confusion for the customer. That is, it's designed to protect another company from misleading someone into believing they're a different (usually more popular) company. However, advertising somewhere where people are looking for a particular brand is simply good marketing, not trademark infringement. Just go into your local supermarket, and look at all the similar products stacked near each other, the aisle coupons for other products, and the receipt coupons advertising competing products after you pay. There's no confusion over brands -- it's just advertising.

Xten has announced its newest Session Initiation Protocol (SIP) SoftPhone, eyebeam, which, like other SoftPhone software previously released by the company, will turn your Mac into a phone that can place and receive calls via Voice-Over IP (VoIP), a protocol that carries voice data over the Internet. An OEM version of the company's X-PRO SIP SoftPhone was just made available to Vonage subscribers who use Mac OS X, as reported by MacCentral on Thursday. eyeBeam SoftPhone will offer H.263 and H.264 IP video conferencing, CDMA cellular network support and such telephony features as instant messaging and encryption. Xten is currently demonstrating the new product at Supercomm 2004 and will soon make a Beta release available to select partners, with the commercial roll-out slated for October. eyeBeam will be Mac OS X compatible, but the company hasn't released system requirements and pricing yet, nor had it placed a product page on its Web site as MacCentral posted this article.

An update to the earlier story we had on a schoo ls being raided by the FBI for sharing music files, here's the news on a larger FBI operation to shut down a larger software, music and movies warez group. This makes more sense than just going after file sharing, but it still makes you wonder. There is this huge terrorist threat thing going on right now, and you would think that it might make more sense for the FBI to protect us from being blown up than to worry about people sharing music files that they can probably get on file sharing networks anyway.

So yeah, that sucks, but you shouldn't be downloading phone warez, either.

Fortunately, if you're one of the unlucky ones who has been stung by the malware, removing it appears to be as simple as deleting the offending file. And while this is notable, and a little bit scary, maybe it should be a sign to mobile OS developers to start locking down the dialing functions of their phones a little more securely?

Covert DoJ investigations into online swapping of copyrighted materials have identified over 100 people in the USA and other countries involved in the distribution of music, movies, and software valued at over $50 million. The initiative is called Operation Fastlink, and targeted warez groups like Fairlight, Kalisto, Echelon, Class and Project X. Excerpt from DoJ press release:
Attorney General John Ashcroft announced today the most far-reaching and aggressive enforcement action ever undertaken against organizations involved in illegal intellectual property piracy over the Internet. Beginning yesterday morning, law enforcement from 10 countries and the United States conducted over 120 searches worldwide to dismantle some of the most well-known and prolific online piracy organizations.

"Intellectual property theft is a global problem that hurts economies around the world. To be effective, we must respond globally," Attorney General Ashcroft said. "In the past 24 hours, working closely with our foreign law enforcement counterparts, we have moved aggressively to strike at the very core of the international online piracy world."

When I.R.C. started in the 1980's, it was best known as a way for serious computer professionals worldwide to communicate in real time. There are also respectable I.R.C. systems and channels - some operated by universities or Internet service providers - for gamers seeking opponents or those who want to talk about sports or hobbies.

Still, I.R.C. perhaps most closely resembles the cantina scene in "Star Wars'': a louche hangout of digital smugglers, pirates, curiosity seekers and the people who love them (or hunt them).
