A year ago, the DNS for craphound.com disappeared. Which was weird, because I was paying for DNS with Dotster, my registrar.

I called them up and spoke to their tech support people. "Oh yeah," they said, "your paid service ended a month ago but our billing system was broken so we didn't send out a notice. So we terminated you for nonpayment. But dude, you're lucky! We gave you a free month's DNS!"

Lucky lucky me. I got a free month's DNS and to pay for it, I was bouncing mail all over the Internet and my Website wasn't resolving. Bastards. I bought two years' worth of DNS and vowed that when the domain came up for renewal, I'd switch away from Dotster. I sent them an email telling them as much and got an email back apologizing and saying that they would certainly never terminate my DNS wihtout notice again (you see where this is going, I trust)

Craphound.com is up for renewal at the end of August. Not wanting to leave things to the last minute, I changed over early this month, switching registrars to Domain Direct, who are now the registrar for all of my domains, and boingboing.net besides.

I didn't move over the DNS -- I figured I'd paid Dotster for another year's service, I might as well get it. Instead, I left myself a reminder in my iCal for next July to set up DNS at DomainDirect a month ahead of the service running out on Dotster.

This morning, Dotster terminated my DNS. Without warning. And when I called, they told me there was nothing they could do about it. Even though there's nothing in my DNS contract that says that DNS is provided to domains registered with Dotster and no others, that is, apparently, their policy. And they can't make exceptions. Not even for 48h while I effect a graceful change to DomainDirect (who have been fantastic throughout and now have 100 percent of my domain registration and DNS business).

Bastards.

Artist Philip Ross makes sculpture out of living oysters and mushrooms. A show of new work launches in Los Angeles this weekend.
Machine Project announces the opening of "Organized" by artist Phillip Ross, on Saturday April 10th from 5-8 pm. Mr Ross will give a talk on his work at the gallery the following Sunday, April 11th at 3pm. Artist, amateur bio-engineer and member of the San Francisco mycological society, Mr. Ross uses living organisms as the inspiration and means by which he makes his work. Through the design and creation of highly controlled environments, Mr. Ross manipulates, nurtures and transforms a variety of living species into sculpture.

Mr. Ross's work lies at the disparate intersection of homegrown technologies, folk art, materials science, and D.I.Y. cultivation techniques. The show includes a series of Reishi mushrooms grown into highly artificed forms, the aforementioned sculpture grown out of oysters, and a self-contained survival capsule for one living plant. A few weeks ago we wrote a post wondering if it's illegal to get hacked. Tower Records was fined for having their customer records hacked, with the rationale that they didn't do enough to protect them. While it makes sense to fine a company that has revealed customer records, this becomes a slippery slope. What if you put in place all sorts of protective measures, and hackers still get through? Or, take the argument in a different direction - what if you think it's fine to leave your system open? With that in mind, Mark Rasch takes a look to see whether or not using WiFi may constitute a felony. It seems like a fine line, but if someone felt it was necessary, you could get in an awful lot of legal trouble for using WiFi. On the end user side of things, connecting to an open WiFi access point may run afoul of laws that make it illegal to "knowingly access a computer used in interstate or foreign communication 'without authorization.'" If the response is that the system was open, and thus the authorization was implied, then does that apply to situations where a customer database is left open as well? What if the security is so flimsy as to basically be non-existent. Where's the line? On the other side of things, Rasch points out that just by setting up a WiFi network, you could be in trouble as well. Unless you carefully make sure that no one outside of your home can access the network, you may run into problems with many state laws that make it illegal to "share" an internet connection, the same way it's illegal to share a cable or satellite TV connection.

Keep in mind that I'm not a doctor of law (although I retain an honorary PhD in 'Home Cookin''), but something didn't seem right to me when I read Bob Kohn's analysis of Rip Digital's CD ripping service (prompted, as it happens, by our review). Kohn—who it must be noted, is no dime store music law pundit—posited the idea that Rip Digital's service might be illegal, on the grounds that hiring someone else to do your home taping equivalent might fall outside of the scope of the owner's right of reproduction. Here's my expert opinion: Hrmmm.

But I talked to Rip Digital's founder Dick Adams, who assured me that they "architected [their] service in compliance with US copyright law," and even contacted the music industry and made them aware of their plans before they started (not that that prevents a RIAA banhammer in the future, but still). And if you think about it, who could possibly be using Rip Digital to infringe copyright, when the service only rips commercially-pressed CDs you send them and they ear mark each MP3 they send back with a code that ties it to you? You'd have to be the most hardworking pirate in the world to get around their voluntary protections—and then why would you need their service?

WhenU, the Gator-wannabe company, has been happily winning lawsuits left and right, but it seems that people just won't stop suing, and now, yet another judge has found that WhenU's adware pop-ups are illegal. In this case, as much as I think companies like WhenU and Gator are being sneaky and misleading, I think the judge was wrong. There should be nothing illegal about having such an ad pop-up if the end-user knows they installed the software that will do that sort of thing. My problem with these companies is the fact that (at least with Gator), they are incredibly sneaky in getting the application onto your computer, such that many people don't realize they've installed it. However, if people do want to install such an application that pops up ads (why? I have no clue), they should certainly be allowed to do so - as long as it's clear that the pop up is coming from WhenU.

Tower Records and the FTC have apparently reached a settlement after the FTC accused them of allowing hackers to access customer records. This brings up a very interesting question that isn't often discussed. Since hack attacks to get at customer data happen all the time how does anyone determine whether or not the company itself is negligent in not protecting the data? At what point is it negligence rather than just being vulnerable? If the standard is set too low, then companies have less incentive to protect their data (though, pissed off customers may provide that incentive). However, blaming the victim for being hacked seems to present a lot of slippery slope style questions.

You see stories all the time from startup companies saying that they're in the process of raising money from investors. However, the folks at Silicon Beat have noticed that this practice may be illegal. There are plenty of regulations concerning raising funds, and soliciting them from the public without going through the whole SEC process is a no-no. Of course, the companies in question will obviously say that a statement to the press that they're raising money is quite different from soliciting funds -- but depending on how you read the regulations, this might not matter. If the funding source comes by way of this press statement, then it almost definitely does violate regulations. While the regulations are there for a good purpose -- to avoid tricking gullible investors, this does make you wonder if they go too far. Statements to the press shouldn't be considered solicitation of funds no matter what, and any investor at such an early stage is likely to go through a lot more due diligence (one hopes) than simply reading about a company in the news.
