Surprise, surprise, some people are finding out the hard way that when you switch carriers, you can take your number with you now, but usually not your phone. Besides the incompatibilites in networks (Verizon and Sprint use CDMA, Nextel, T-Mobile, AT&T Wireless, and Cingular use GSM) most carriers lock their phones so that they can't be used with anyone else. It is possible to unlock most phones so they can be used on another carrier, thought it's not always easy, so if being able to take your phone with you is important, you probably should just suck it up and pay extra for a phone that comes unlocked in the first place. Now that nearly two months has passed since wireless local number portability went into effect in the US, it turns out that carri ers are still having problems porting numbers in a timely fashion. There are eve a few cases where people who signed up back in November still don't have their numbers ported. The problems are being worked out, though, and are much less likely to occur these days. However, it is still taking a few days to port the number in most cases - which is way more than the 2.5 hours the FCC had told carriers it should take. For the time being, it looks like the FCC isn't taking the carriers to task for missing that mark. It's also interesting to note that all of the carriers report that portability has not been nearly as big an issue as they expected, with many fewer subscribers moving than were predicted. Of course, some might point out that the carriers who had the most to lose from number portability had every incentive in the world not to make the process very smooth - and to make sure everyone knew that it wasn't going to be smooth.

Oh man, we really don't want people to think we're fixated on the whole cellphone number portability thing (though it is nice to be pre-occupied with something besides the dismal failure of the N-Gage), but there's a new report out from Mobile Competency about how the cellphone companies still aren't ready for November 24th, the first day the new rules go into effect (even though they're had no problem charging their subscribers for it for months). By this point, it's pretty well known that wireless number portability didn't go so smoothly over the past couple of months. However, now the FCC has admitted the extent of the problems, saying that they've recei ved 4,750 complaints concerning number portability. Considering the total number of switchers, that's really not a huge percentage - but it still doesn't speak well to the efforts the wireless carriers put into the process. The FCC is now looking to see if any regulations were broken. Considering that many carriers were clearly dragging their feet on getting ready for this (partly as a ploy to ask for more delays), it seems likely that the FCC will fine a few carriers for screwing around when they should have been preparing (as we expected back in May). It still seems like a strategically backwards move not to have embraced something that customers clearly wanted - and which was clearly going to come sooner or later.

Well, it only took half a year, but the FCC is now reporting that wireless number portability appears to be moving along smoothly. Of course, all hell might break loose again when the rest of the country (that is, anywhere that is not one of the top 100 metropolitan regions) starts offering number portability next month - but hopefully the carriers have learned their lesson. There are still some problems with portability, so don't be completely surprised it things don't work the way they're supposed to. However, if you really want to switch, there's not much reason to wait any more.

Despite having fought tooth and nail to prevent the imposition of number portability, that hasn't prevented the cellphone carriers from exploiting the FCC's new rules by using them as an excuse to rip off customers with all sorts of fees and charges. I just noticed noticed the charges on my cellphone bill the other day, and when I called up customer service to ask what they were for, the rep actually had the gall to say that the fees had been "mandated" by the FCC, which is patently untrue. These aren't taxes and they're not fees that subscribers agreed to when they signed up for service, and it's unfair to charge extra for the "privilege" being able to take your number with you should you ever decide to switch carriers. Not everyone's doing it, but Om Malik has noticed that the carriers who are collecting these surcharges have been raking...

It seems like November 24th, 2003 is increasingly taking on a Y2K feel, as story after story after story is talking about how much of a mess it's going to be when people first try to switch their mobile phone numbers. It's tough to tell how much of these stories are carrier propaganda, from those who are trying to scare people away from switching, and how much is legitimate. Even if the fear is legitimate, it's still possible that many of the problems aren't necessary, but are caused by certain carriers who are purposely making the process annoying, in order to scare away people from switching. No matter what, everyone's gearing up for November 24th. Large call centers are being trained to deal with number portability issues, and basically no one has any idea (a) how many people are actually going to switch on that first day or (b) how well the process will work? At least no one is heading off for reinforced bunkers in the mountains.

This just never ends... While most of the major wireless carriers have given up trying to stop wireless local number portability (and in the case of Verizon Wireless, publicly embraced number portability), it appears that some of the smaller carriers are now making their last minute desperation play to stop it. A group representing smaller rural carriers has given the FCC an ultimatum, saying that if they don't stop number portability by tomorrow, they'll go to court to get portability delayed. They claim that number portability leads to an unfair competitive situation where the bigger carriers can stomp on the smaller ones. The FCC's response? Nope. Number portability is going into effect Monday no matter how much carriers of all sizes complain about it.

We'd thought that the cellphone companies had stopped trying to weasel out implementing number portability after a Federal appeals court threw out their lawsuit against the FCC back in June, but apparently they hadn't quite given up yet. AT&T Wireless and Cingular just tried again in court to stall the new rules by arguing that the FCC hadn't been clear enough about how number portability applies to landlines as well. On Wednesday this second lawsuit was also thrown out, though now it looks like AT&T Wireless and Cingular might be trying get Congress to intervene and obtain a delay. Read [Via MobileTracker]...

I spent about 6 hours today going thru the various tutorials on how to use the Mac to create a Podcast. The initial setup was easy although I could not figure out why the Mac would not record iTunes or my Skype calls with what comes standard in windows. Instead I had to go download this flower power application. :) On a Windows machine it is as simple as clicking a check mark box in the built in Audio settings.

When I did get it working I had this annoying delay on the audio, a good 2-3 seconds. I will honestly say I really worked at it to see how easy or difficult it was on a Mac. Audio Hijack Pro seemed to work ok but Garageband sucked.

I'll be honest I prefer Adobe Audition for windows for Podcasting.

Ok now I realize I am doing these test with a Mac Mini with a gig of Ram on board and a iMic. I also realize a lot of people are doing podcast on Mac's but for the time being I will stick to my windows machine.

After having the mini a couple of weeks I am yet to discover what makes a Mac so much different. What I would like to do is speak to a Mac Guru that is creating a podcast with a Mac and let's check some of my settings and see if I am missing anything. "The new iTunes has stricter DRM than the last version, limiting the number of times you can burn your playlists to seven (it used to be ten), and detecting and blocking similar playlists. Jason Schultz has some good ranty analysis about what this means:

So after one year and 70 million songs, $0.99 now buys you less rather than more -- seven hard burns instead of ten soft ones. What will Apple 'allow' us to do with the music we 'buy' next year? three burns? one? zero?

And what about the songs you've already bought? Don't we get to keep the rights we had before the change?

I can't find it right now, but I saw a post somewhere noting that you could actually keep the songs you've already paid for at the old licensing by not upgrading to the new version of iTunes. The problem with this, of course, is that you can't buy any new ones. Right.

When DRM Goes Wrong or Why I'm Not Using Microsoft Reader Any More

"I was going to do some reading this evening on my computer. I had a copy of the Devil's Banker in Microsoft Reader format. When I tried to open it though, i got a message that informed me that that the security software had been updated and that I needed to update. No problem, I go to the update page but it tells me, I'm updated and activated just fine. Except, I'm not. The e-book won't open. I try to activate the reader again and the fun gets more interesting. I get a note saying that my acc't only has six activations and all of them are used. Let's see, by my count, I have two laptops and one PocketPC active. That would mean three activations left (and of course, the COMPUTER IS ALREADY ACTIVATED)... Yikes. Pulling up my PocketPC, I get the same infuriating message but it does activate again and the book opens there (but still not on my computer).

Bottom line. MS Reader is DRM at its worst. Unlike competitive solutions, like iTunes, Reader won't let me authorize AND de-authorize a computer. Yes, you can request more authorizations from MSFT, but that's sort of useless when you're trying to read a book. I'm staying away from Reader at this point and going to use Palm Digital Media that has a far friendlier DRM that's never locked me out of my content yet. Like most users, I have no objection to DRM, it's necessary to prevent abuses but should never, ever be something a legitimate user should bump into, like i kept bumping into tonight...." Except that, I bought a book from Palm once. Once. They tied my credit card number to the title, and three years later, I have no idea what that credit card number was, so I can't access the book anymore.

So in summary, iTunes, MS Reader, and Palm Digital Media DRM: bad.

This is what really scares me about libraries getting into the digital files business, even outside of all the issues surrounded subscription-based access versus ownership. When terms change on a whim, upgrades take away existing rights, and files become locked and inaccessible, how is this going to affect how we circulate titles to our patrons? It's not like libraries have any leverage in this situation since publishers and Congress are doing their best to eradicate fair use rights, including the right of first sale.

vwsi730.jpgUh oh. I didn't know this was possible: Verizon has released a phone I want. The Samsung SCH-i730 is a WIndows Mobile device that has not only an EV-DO radio (I love me some EV-DO) but also Wi-Fi, which many thought Verizon would remove for fear they might not squeeze every last testicle dollar from their subscribers. It's $600 and only available to business customers at the moment, but it's lovely.

I've already got Verizon for EV-DO service with the PCMCIA card. I wonder if they'd let me add the phone service on, too? I might just have to see.

Over at MSNBC.com, Gary Krakow compares three new phones that have just hit stores: Motorola's new MPx200 (pictured at right) and GPS-enabled i730 cellphones, and Siemens' stylish SL56 handset. Krakow gives high marks to the MPx200, which runs Microsoft's new Smartphone operating system, calling it "one slick device" and noting that it's a marked improvement over Orange's SPV Smartphone which came out last year.
