04/15/2004 11:36 AMThis story on Sami Omar al-Hussayen is worth the pain of (free)
registration at WashingtonPost.com. Here are a couple of
excerpts:
Defense attorney David Nevin portrayed his client as a well-liked
leader of the university's Muslim Student Association who had been
quick to publicly condemn the Sept. 11, 2001, attacks. Hussayen, the
father of three young boys, is not an angry Muslim who hates the West,
he said. On the contrary, Nevin added, he comes from a well-to-do
family that has traveled the world. "He doesn't hate the United
States. He doesn't hate Western values. That's not who he is," Nevin
said.
Hussayen, 34, a doctoral candidate in a computer science program
sponsored by the National Security Agency, is accused of creating more
than a dozen jihadist Web sites and of moderating a global e-mail
group that in February 2003 posted an "urgent appeal" for Muslims in
the U.S. military to supply information about American forces and
facilities in the Middle East that could be selected as targets for
acts of terrorism.
Displaying a chart that showed the links among more than a dozen
Web sites, [federal prosecutor] Lindquist told the jury that Hussayen
managed "an Internet network -- a platform," and that "the content of
this platform was extreme jihad -- terrorism."
...
The Saudi Embassy has pressed for Hussayen's release and is paying
for his top-flight legal defense team, which includes Joshua Dratel,
who represented Wadih Hage, a former aide to Osama bin Laden.
The case is interesting because Mr. Hussayen's main defense is
based on the First Amendment though he is not a U.S. citizen. If
the U.S. government doesn't like someone residing in a foreign country
it is free to shoot a missile at the guy's car and summarily kill
him. If, on the other hand, an enemy manages to score himself a
student or tourist visa and arrives on our shores we can't touch
him because he is now entitled to a variety of protections under the
Constitution that were designed for (presumably loyal) citizens.
Sami Al-Arian, the computer engineering professor from University of
South Florida,
attempted a First Amendment defense as well [Mr. Al-Arian, a
Kuwaiti national whose application for U.S. citizenship was turned
down based on his fraudulent registration to vote in the early
1990s, is a great example of the American Dream because the
taxpayers of Florida are still paying his salary while he sits in
federal prison awaiting his trail in January.]
The Ancient Greeks took the rules of hospitality, xenia,
very seriously. Certainly running off with your host's wife was
out of the question and thus the abduction of Helen was a sufficiently
serious breach to warrant the Trojan War. Most of our recent
troubles with terrorism stem from Arab guests in or immigrants to the
United States. So far the government's response seems to be an
attempt to reduce the number of guests and/or screen them more
thoroughly for existing connections to terrorist organizations.
In the long run, however, this seems doomed to fail. You can't
expect someone to abandon his beliefs simply because he is visiting
the United States or has immigrated here, even if one of those beliefs
is hatred of American society. My prediction: within the
next five years there will be calls to restrict constitutional rights
to citizens. It will be noted that in 1787 everyone in the U.S.
was either a citizen, the property of a citizen (slaves), or
expected to become a citizen. It will be argued that times have
changed. Thanks to commercial airlines millions of people land
on our soil every year with no intention of joining the society.
Thus a distinction should be made between U.S. citizens and
guests. The counterargument will be that the rights of the
Constitution are universal and should not only be extended to guests
on our shores but also to human beings anywhere on the planet.
We shouldn't be supporting dictators in poor countries if they won't
guarantee U.S.-style rights to all of their citizens and certainly we
should not be engaging in extrajudicial assassination of our
enemies.

"Michael
Lohman is sick" read the email to students in MAT 308: Theory of
Games, explaining why the Princeton mathematics graduate student had
not yet graded their homework. Not sick as in "flu"-sick,
but sick as in "squirting his bodily fluids into unsuspecting
women's drinks and cutting off locks of their hair for unspeakable
acts involving mittens"-sick. And not just any women, but
exclusively Asian women. An extreme case, to be sure, but the
Western
"ota
ku" lusting
after (and often having
much
success with)
Asian women is a quite familiar
and often disturbing<
/a> trope for those of us who have spent much time among the
disaffected English majors, anime
fans, martial artists,
dirty old
men, and various other Asiaphiles. Yet decidedly
non-nerdy folks have expressed a definite preference for
Asian
women as well.
Where does
this preference (which certainly
goes both
ways) come from? As such
interracial couplings increase,
should we even try to distinguish relationships based on
"Suzie Wong"
stereotypes or even outright
economic exploitation,
and relationships that are somehow more "acceptable?" Or
will non-Asian guys with Asian girls constantly be forced to prove
it's not just a case of
"Yellow Fever?" Favorite Mac-Oriented IRC?

of the applications that I'm running on my Mac. I realize I do this to
people too. I've seen people make lists of their favorite applications
on their blogs, but I realized that it might be better to do on a
wiki. I've made a list of my favorite applications. Feel free to click
on any of the application links and comment on the page for the
application. Also, feel free to make a similar page for yourself and
list YOUR favorite applications. If we can get a bunch of people on
the wiki with their lists, it might end up being an interesting
resource.
Is there something like this elsewhere already?

08/01/2004 01:32 PMHere's Dan's comments after the launch party of his new book "We, the Media".
NOTE: I got to bring my twins Aron and Jacob to the party. That
was fun showing them off.
Here's Dan's post....
J.D. Lasica and Brian Dear
were among the folks who came to last night's gathering celebrating
the book launch and the relocation of Creative Commons to its new
offices in San Francisco. I was honored by the presence of so many
fine folks.
The book was published under a Creative Commons license, permitting
non-commercial use of the material as long as people give it proper
attribution and add their "remixes" back into the world under a
similar license. (The book will be online in full very soon on the
publisher's official
site.)
In my brief remarks to the folks who'd gathered last evening, I
talked about the great value Creative Commons is giving to all of us,
by doing its part to restore a tiny bit of balance in the copyright
regime. I doubt many publishers would have allowed me to live up to
what I've been saying on copyright these past few years, and I'm
grateful that I have a publisher who totally gets it.
(Cross-posted to We the Media.)
[Dan Gillmor]
Brian Dear
and JD Lasica also had their own posts on the party. Here's some of
Brian's shots.....

12/26/2004 07:03 PMI love lists, especially those end of the year ones. Following Rex's
lead, here are some of my favorite weblogs from 2004. (Note: This
list is not objective. I'm not surveying the entire landscape of
weblogs and picking the best ones, just choosing my favorites from
among those I follow on a somewhat regular basis.)
12. Mr Sun! - The funniest celestial
object in the blogoverse.
11. Collision
Detection - Clive's got some writing chops -- he's a professional
journalist -- but his enthusiasm for the subject matter is what I look
forward to when clicking through his site.
10. Gothamist - As Jen's
posting frequency has decreased (that she kept that pace for so long
is amazing), the site has become a little aimless, but it's still
worth a few daily visits.
9. Dooce - Heather can (and
does) talk about anything and make it funny. Despite several
challenging episodes in her life over the past couple of years, Dooce
is still going strong and from what I can tell, keeps getting better.
One small request though: TONE DOWN THE ALL CAPS SHOUTING. Please?
8. Slower - Except for the
celebrity photos, which he posts specifically to irritate me, Eliot's
work somehow gets better with each visit. Well, I don't much like all
the people photos he's been posting recently. On second thought, maybe
I should reconsider...
7. Anil Dash - His professional duties for Six
Apart has resulted in a substantial decrease in volume on his site,
but Anil was a must-visit for me in the first half of the year.
6. My del.icio.us
inbox - Josh, I know you're hurting, but hook me up...I need my
del.icio.us inbox back!
5. Gulfstream - The best
weblog that you don't read. Michael updates somewhat irregularly, but
every single link he posts is gold.
4. Boing Boing - Cory's the
engine that makes BB run...when he's posting regularly, the site
shines.
3. Waxy.org - One of the best
edited sites on the web. Andy highlights so much interesting
stuff.
2. The Morning News -
Apologies to Rosecrans and Andrew for including TMN in this list of
weblogs, but the site's too good not to mention because of
semantics.
1. Photos from
my Flickr friends - Flickr is the most fun on the web right now.
Period. It's the closest thing I've experienced online to hanging out
with your friends at the coffeeshop. (Note: your Flickr friends page
looks different when you're logged in and is a lot more useful.)
And a special mention...
0. Kottke.org - Oh man, am I
gonna get mail about this one...the nerve! But I really enjoyed doing
my site this year and I've already told you this isn't really a "best
of" list. Earlier in the year, I was thinking about quitting entirely
and the site's been a little, uh, crappy the last couple of months (if
you haven't noticed, you're not paying enough attention...wake up out
there!), but other than that, the site's been really good to me.
Thanks for reading, your emails, your comments, and for indulging me.
Expect good things next year.
