In his keynote today at the Microsoft® Worldwide Partner Conference, Mike Nash, corporate vice president for Security Business and Technology Unit at Microsoft Corp., announced support from more than 25 industry partners for its Network Access Protection, an extensible standards-based technology that will enable users to more securely access their corporate network. In addition to enhancing the security for user access, the Network Access Protection technology will provide a more secure solution designed to reduce the complexity of network access for IT administrators. Available in an update release (code-named "R2") of Windows Server (TM) 2003, Network Access Protection technology will deliver a uniform method for detecting the "health state" of a client attempting to connect to a network, restricting the access until compliance to policy is validated and updating the client to current security policy levels.

Both companies have been named as defendants in a lawsuit recently filed in the Federal Court for the Northern District of California. The plaintiff in the case is Teleshuttle Technologies LLC. The suit alleges that Apple and Microsoft are infringing a patent that covers online software updates.

Last month, a company named BTG announced that they held the "worldwide licensing rights" for a patent on automatic updates over the internet -- and (of course) they expected everyone to pay up, including Microsoft. Well, it appears that the Microsoft lawyers laughed them out of the room, so now BTG has been forced to sue both Microsoft and Apple for violating patent 6,557,054 on "A method and system for distributing updates by presenting directory of software available for user installation that is not already installed on user station." And people still think our patent system works great? The patent was applied for in April of 2000. There must be a ridiculous amount of prior art of applications that updated themselves prior to that.
