software lock on new phones that use the GSM system. The lock prevents
customers from using the phone with another carrier's service.
This mostly affects people who want to use their phones in other
countries, or who want to put a stored-value SIM card into their
current phone for specific uses, during the initial contract period.
It also affects those who want to switch carriers after they've paid
for their year of service (or have paid the extra fee for leaving
early).
A consumer group has file
d suit to force the carriers to stop this practice, which is
flagrantly anti-consumer. Good luck on this one.
The companies will tell you that they lock the phone so you'll pay for
the subsidies they give you when you sign up for their service. This
is a total red herring -- a blatant deception -- by the industry.
You sign up for a year's service (sometimes more) when you get a
subsidized phone. As noted, if you quit early you have to pay an extra
charge. Either way, you've covered the subsidy.
I have a T-Mobile phone, and T-Mobile is one of the carriers being
sued. When I bought it I was told I could get the unlock code three
months after starting my service. That's coming up soon, and I intend
to avail myself of this feature. AT&T, the carrier I left, told me
it might never give me an unlock code.
Three months is still unreasonable. I hope the suit succeeds, but what
we really need is legislation prohibiting this conduct from the
industry.

companies for
infringement
infringement for their information-gathering application. The
claim is that the named firms, such as Big Champagne , used Altnet's
software and concepts for obtaining information about user
activities within peer-to-peer (p2p) networks:
"Our intent has always been to commercialize peer to peer, and if
anyone is misusing our patent for any reason, I have to protect that
intellectual property," [Altnet Executive Vice President] Broes said.
"If they're building business on the backs of the patent I worked hard
to acquire, then they should talk to us."
Given the large audiences using p2p applications for (among other
things) file-sharing, many intellectual property owners have used or considered using
them to learn more about market behavior and preferences.

bizarre interpretations of intellectual property to their advantage
suddenly getting hit with intellectual property lawsuits. First, we
had the
RIAA
get sued for patent infringement and now
MLB Online is
getting sued for patent infringement over some patents concerning
the real-time display of game information online. Not surprisingly,
it's a small patent hoarding company rather than a company that is
actually doing any innovating. Of course, MLB.com doesn't exactly
have a sparkling record when it comes to intellectual property
freedom. You may recall that they wanted to stop all other sites from
reporting in-game data (facts) because they seemed to believe
they
owned all the rights to in-game data. Of course, you can't
copyright facts. Once again, though, this lawsuit is unlikely to make
MLB.com realize some of the problems with the way intellectual
property is dealt with these days.

Good news for TiVo today as they won a patent suit
against Pause Technology. Pause Technology has a patent on the
functionality of pausing TV, buffering live TV, and catching up to
live by fast-forwarding. It sounds pretty close to what TiVo does, but
