This very good, short article shows the way that the RIAA cooks its books to create losses due to file-sharing when there's no indication that file-sharing is costing them money. Peter sez, "I'm an economist researching the issue too, and I've found the figures frankly unbelievable for a long while. Now I know why."
There is only one logical integration of all these statistics with the recent Soundscan data: even though actual point-of-purchase sales are up by about 9% in the US - and the industry sold over 13,000,000 more units in 2004 (1st quarter) than in 2003 (1st quarter) - the Industry is still claiming a loss of 7% because RIAA members shipped 7% fewer records than in 2003.

Forget the confusing percentages, here's an oversimplified example: I shipped 1000 units last year and sold 700 of them. This year I sold 770 units but shipped only 930 units. I shipped 10% less units this year. And this is what the RIAA wants the public to accept as "a loss."

I'll go a step further. This fact, that Sherman seems to confirm, should logically mean a smaller percentage of returns. But, shouldn't fewer returns mean higher profit margins and faster turnaround; and shouldn't that be good for both the retail and wholesale side of the industry? "Sure," admits Sherman today, "but I have no idea what US shipments looked like in the first quarter." Then how can he claim world-wide "losses" in his March speech to Financial Times New Media?

Online music provider eMusic announced on Tuesday a relaunch of its Web site that features new editorial content and search tools. The service launched in 1998 and currently sells over 1,000,000 MP3 downloads per month, with more than 500,000 songs available in a wide variety of genres. Its new roster of editors and writers, who help guide users toward the type of music they like, was culled from well-known newspapers and magazines while such added features as "Tell a Friend" and "Neighbors" expand the site's browsing options with the ability to e-mail information about tracks to friends and the chance to create a profile and connect with others who share similar interests.

When eMusic was sold and ditch ed their unlimited download plan, we were afraid they'd also end up ditching MP3s and start offering some kind of copy-protected/crippled music. It looks like they still realize that would be a bad plan. The new owners are getting ready to relaunch the service, still offering MP3s. The focus is still mostly on independent bands, but they're also adding more reviews and written content to help "guide" users through the independent music world. While it's an interesting idea, one of the joys most people have in working through the world of independent music is discovering stuff on their own, or with the help of friends, rather than professional music reviewers. Instead of going with professionally written reviews, why not open it up and make it more participatory? Of course, with their plans that still limit the number of downloads you can make a month, it limits a subscriber's ability to sample new music anyway. So, while it's better than plenty of other offerings, it still seems to be a bit too limiting. The one good thing they've done, however, is to partner with a company that records live shows to put those up for download as well -- recognizing that people use file sharing apps not just for the studio versions of recordings, but also for live and bootleg recordings.

David Pescovitz: Following up on my earlier post today about JewelEye, Shannon Larratt of the excellent Body Modification Ezine points to his wife Rachel's personal account of Cosmetic Extraocular Implantation. Shannon says Rachel was the first American to have the procedure done. And I was very wrong in my original post: self-installation is clearly not an option. Rachel writes:
"The procedure itself involved injecting a liquid to elevate and separate the layers of the eyeball, which helps the surgeon with the placement of the implant under the conjunctiva (in old age, many people build up calcium deposits in this area, so our eye is actually designed to handle material stuck there). A small flap is cut, and the implant is inserted. After it was in place, they began suctioning out the liquid that was used to elevate the layers. After a few weeks, the liquid will dissipate and the implant will become even more visible."

I wanted to share with WWdN readers this amazing thing I discovered via boingboing recently: Comfort Stand Records.

I'm listening to Swingin' Singles while I do this work . . . and I absolutely must share this record with you WWdN readers. It rules. Stand out artists include Mat h and Physics Club, Forty-One , Messer Chups (particularly Orgia of dead 2), and Kim & Buran — and that's just the first side of the collection. I haven't even gotten to side b yet.

But here's the greatest thing in the world about these artists and this label: every track and album is released under a Creative Commons license, so you can download, burn, and share the music with anyone you want legally. Comfort Stand sez: "Comfort Stand Recordings is a community-driven label where all releases are free with artwork and liner notes. We strive to bring you recordings that we find interesting, compelling and downright enjoyable. We are not genre-specific and feature a wide range of material, from well-known performers to those loud unknown kids down your block.

We are not a business. We're not out to make a profit. There are no banners, popups, or spam at Comfort Stand. You don't have to register yourself to download the music you like. We operate under the ideology that money need not come between artists and audience."

There's a lot of lousy free music on the internets. It's nice to listen to some really good free music for a change.
