the press first, and later in the actual court room. While,
historically, the press has had free reign, the latest trend is for
people involved in high-profile trials to
take their case
directly to the public via a website. While they sound pretty
carefully crafted, it does give people (often famous ones like Martha
Stewart) the chance to respond to what people have been saying and
give their side. Of course, this contrasts with the theory that
defendants should stay as quiet as possible outside of court - and
could open them up to more difficulties later on. However, it seems
that many celebrities are realizing that the view in the court of
public opinion may be more important in some cases than the actual
results in the court of law.

major film studios and the recording industry who are seeking to shut
down peer-to-peer services they say are costing them billions of
dollars. One of the questions the court kept coming back to was this:
What's more important — preventing potential copyright violations or
allowing the market to come up with innovative new products?
The case began when MGM and several record labels filed suit against
StreamCast Networks and file-sharing network Grokster, arguing that
they were intentionally created to allow people to illegally trade
copyrighted material. That case was thrown out by a circuit court in
August, paving the way for it to be argued in front of the Supreme
Court. "The scale of the whole thing is mind-boggling,"
argued recording industry lawyer Donald Verrilli. "They
intentionally built a network of infringing users."

14% of American
internet users claim they've stopped downloading music, but that
the number of people downloading has been steadily growing again over
the last few months. The study has a few problems, however. First,
it's all based on asking people about their activities, and
considering the publicity campaign, it's easy to imagine a heavy file
sharer saying they don't download any music because they don't want to
risk opening themselves up to a lawsuit. Furthermore, the study does
not appear to distinguish between what kind of music is being
"downloaded." They seem to lump together downloading unauthorized
files, using paid download stores like iTunes, or even legitimate
downloads directly from a musician's own website.

Online file swapping endures: What, exactly, is eDonkey?
Despite entertainment industry attempts to curb online song and
movie swapping with lawsuits and education campaigns, more people than
ever are using peer-to-peer services.
BigChampagne, which tracks Internet file sharing, says 8.3 million
people were online at any one time in June using unauthorized services
like Kazaa and eDonkey — up 19% from 6.8 million in June
2003.
The majority of files being traded were music, BigChampagne says.
Porn videos and images were the second-biggest category.

over?:
If one is willing to believe the happy talk
from music business executives, the tide has finally turned against
file sharing, thanks to the get-tough tactics employed by the
Recording Industry Association of America.
Last fall, the RIAA began filing lawsuits against individual users
of peer-to-peer trading sites, and the strategy, the RIAA says now,
has paid off. The group is careful not to declare a final victory over
file trading, but things are finally beginning to look up for a
business long in decline, say industry representatives. After years of
scoffing at copyright laws, Americans are finally beginning to
understand the gravity of file trading's offense against copyright.
The article is interesting. But what I find most
interesting is this automatic alignment that is made in the media
discourse between file sharing and piracy. There are many, many uses
other than those the RIAA defines as illegitimate for file sharing
(note, I am not saying
anonymous file sharing, although there
worthy uses for that too). Sure, the media loves a good fight and
that's why the focus on this comparison. But the uses of sharing
should, can, and
will move beyond those in dispute. And not
just for files, either.
Why am I saying this? Well, can't you guess?

it was only a matter of time before everything started to go mobile.
I recently wrote up an article at TheFeature about
all the
various music download offerings for mobile phones, but it looks
like some are already going beyond that to offer some form of "file
sharing" as well. EMI has
talked about
mobile file sharing in the past, but it seemed pretty watered
down. Recently, Wippit, makers of an increasingly popular DRM
technology that encourages limited file sharing announced plans to
offer
mobile file sharing by letting users get around many wireless
carriers by sending the file in response to an SMS message. The
latest, though, is that SK Telecom is showing off a
mobile file sharing system in Korea that will
let users swap music files, ringtones, videos and more via their 3G
network. They admit that it has no copy protection at all, and even
say, "we're not thinking about that type of problem." It's not clear
if that's because they never plan to actually launch it, or they just
don't care. Given that the recording industry in Korea wanted to
sue wireless
carriers for offering MP3 playing phones (even after they agreed
to forcibly degrade the sound quality), you have to wonder how long
such an application would remain on the market. Still, it's been said
many times before: it's only a matter of time until a real
Napster-style file sharing app is written for mobile phones, whether
by the carriers themselves or (more likely) independently. And still,
everyone in the wireless and music industry seems to ignore this
potential problem and insist that overpriced ringtone revenue will be
around forever.

After months of hearings and
consideration , the United
States Ninth Circuit Court of Appeals ruled that
makers of peer-to-peer computer software (" P2P ") are
not liabile for damages concerning copyright infrigement.
The decision hewed to the 1984
Sony v. Betamax ruling , which exempted videocassette recorder
makers from copyright infringement, arguing that a tool isn't necessarily dangerous
if some of its uses are actionable. Instead the court recommended that intellectual
property owners pursue individual infringers. Additionally, defenders
of the p2p software argued that the decision
preserves privacy rights for users.

the side of research labs and academia, largely due to the popularity
of commercialized P2P file sharing applications such as Napster,
Morpheus and KaZaa. In the P2P model, peers exchange data and/or
services in completely decentralized distributed manner. Peers are
autonomous, and are free to choose what other peers to interact with,
and, in this point-to-point interaction, peers possess equal
functional capabilities.
On the other hand, Knowledge
Management (KM) is increasingly viewed as a core capacity in order to
compete in the modern social and economic environment. Researchers and
practitioners agree that those intellectual assets that are embedded
in working practices, social relationships, and technological
artefacts constitute the only source of value that can sustain long
term differentiation, quality of services, innovation, and
adaptability. Nonetheless, even due to a debatable success of current
KM implementations, still unclear is how such matter should be managed
in highly complex, distributed, and heterogeneous settings.
In the last couple of years, P2P and KM have followed different but
converging paths. In fact, P2P technologies have left their initial
“computational”, “anarchoyd”, and spontaneous fashion to
embrace more service level domains and business settings. On the other
hand, KM is questioning its centralized assumption based on the
implicit belief that knowledge is managed successfully when it can be
standardized and controlled. In this sense, it seems that while P2P is
looking for value added domains to better exploit its technological
potential, KM is looking for a technological paradigm more able to fit
an emerging distributed organization of knowledge.
The
convergence of P2P and KM creates new challenges for researchers to
address: new methodologies to model, design, and deploy distributed KM
solutions; theories and algorithms to represent the social and
semantic dimensions of a knowledge network; mechanisms to cope with
the dynamic autonomous nature of P2P and to provide means to support
emergent network self-organization.

a means to enhance the Web with machine processable content. However,
mostly the Semantic Web is aiming at techniques and technologies for
static information, in contrast to dynamic services or distributed
computing. Several interest groups and efforts are working on
infrastructure for enabling distributed computing. The organization of
these efforts are in part top down organized efforts, involving
multiple formal organizations and dedicated projects, and bottom-up
efforts, sometimes started by single organizations or individuals in a
grassroots effort.
The Grid is aiming at technologies which
allow the flexible, secure, coordinated resource sharing among dynamic
collections of individuals, institutions, and resources, enabling
virtual organizations. Problems encountered include authentication,
authorization, resource access, resource discovery, and interoperation
of active services. The same problems are eminent in the Peer-to-Peer
(P2P) area, where projects are typically organized in a bottom-up
fashion. Reusable infrastructures like SUN's JXTA are emerging,
attracting numerous applications. However, each application uses its
own data format, and it is hard to see how applications
interoperate.
A related area is Web Services: driven by
industry efforts numerous specifications are developed, which are of
interest for the Grid projects as well as for the Peer-to-Peer
efforts. Although there is an agreement that Web Services would
benefit from more semantics, little systematic research has been done
on the problem of how to combine the notions of Web Services with the
results of the Semantic Web, Peer-to-Peer and Grid computing.
The workshop will be organized in part around talks presenting
research results in the intersection of the Semantic Web, P2P and Grid
computing. Another important part of the workshop will be break-out
groups, focusing on the amalgamation of Semantic Web and distributed
computing. We hope the break-out groups will evolve into independent
working groups and generate follow-up activities, which contribute to
the technology areas. The proceedings will be published on the Web
and a workshop report will summarize the outcome of the break out
groups.

in record sales, and in some cases it may even be positive, says

he Guardian. Not completely unsurprisingly, the music industry is
now really pissed off at even the mere suggestion.
To me it makes sense: I have bought several CDs just simply because a
friend recommended something to me, and then sent me the MP3. Then I
just rip the CD to Ogg Vorbis and dump it in iTunes... I
actually never listen to the physical CD these days anymore; most of
the CDs are used just once to get the data onto a hard drive. But I
still keep the CDs as backups.
My digital music collection is my music collection. My CDs are my
backups. I don't even have to burn them.
(And BTW: My CD player refuses to play about 10% of all the CDs I've
tried on it lately. But my PC can rip 100% of them. So it's easier
for me to actually rip the music than it's to play them on my ancient
DVD player. So much for "copy" protection.)

States Threaten Peer-to-Peer Sites
08/06/2004 09:50 AMSeveral states are cracking down on peer-to-peer sites as hotbeds of
illegal file-trading. Attorneys general from 47 U.S. states and
territories have sent a letter out to P-to-P software vendors, saying
they must re-engineer their software to prevent illegal file-trading
do a better job of warning users of the dangers of trading illegal
files. This action follows on
news earlier this year that the states might get
involved in the P-to-P fight.
The letter, signed by the attorneys general of California, Texas,
Florida, and many others, calls for P-to-P vendors to also warn users
about the amount of pornography traded through P-to-P software,
including child pornography. "P2P users need to be made aware
that they are exposing themselves, and their children, to widespread
availability of pornographic material when they download and install
P2P file-sharing programs on their computers," the letter says.
