09/09/2004 03:51 AMWhile some may consider it poetic justice to hear that
the RIAA has been sued
by a P2P company for patent infringement, the news really isn't
that great. It's really not particularly unexpected either. Altnet
made it clear last year that
they
would use their patent for identifying files via a hash to sue the
music industry for spying on file sharers. Altnet is barely a typical
file sharing company either. While it does seem to have a convoluted
relationship with Kazaa, it's really a system for interjecting copy
protected files into Kazaa's system. The patent, like so many these
days, seems quite questionable (and fairly obvious). The RIAA, of
course, will fail to see the irony of being hit up with an
intellectual property charge, and it will do nothing to change their
behavior. All we really end up with is yet another bad patent lawsuit
that will do little to move the industry forward.

new national "do not call" list, that's not actually the case. It is,
however, the first major attempt by a federal agency to fine a company
for violating do not call rules. In this case, the FCC is about to
fine AT&T $780,000 for 78 phone
calls to 29 people. The violation isn't of the national "do not
call" list, but of the internal AT&T "do not call" list that they're
required to keep if anyone requests that AT&T not call them. Still,
it clearly shows that the FCC is pretty serious about cracking down on
bad telemarketers.

provisions in license agreements between Microsoft Corp. and Japanese
PC vendors violate Japan's antimonopoly code. Should licensees believe
Microsoft is infringing on their patents, Microsoft's current
provisions restrict possible legal action, according to a statement
issued by the JFTC. The JFTC decided such a provision unjustly
restricts the business activities of the licensees and thus violates
section 19 of the Antimonopoly Act, it said.

second anyone called someone else a "Nazi" (see
Godwin
's Law). These days, perhaps it should be amended to include
anyone calling someone else a "terrorist." Remember a few months back
when the World Intellectual Property Organization

ed a meeting about open source along with a quote that open source
was "contrary to the goals of WIPO." Apparently that wasn't a one-off
statement. Instead of exploring issues related to intellectual
property, WIPO seems to now firmly believe that there is one and only
one way to use intellectual property: and that's to lock it up.
WIPO's director, Kamil Idris, was quoted today saying that
"Pira
cy is like terrorism today." This leaves little (if any) room for
an open debate on how there are ways to support intellectual property
without having to lock it all up. While the quote is talking about
counterfeit products that aren't up to the safety levels of original
products, it's way too broad a statement. Certainly, these
counterfeit products are dangerous and something should be done about
them. However, simply equating all intellectual property violations
with "terrorism" goes too far. In the same talk Idris claims that
stronger enforcement of intellectual property rights could help
developing nations improve their economies. This, of course, is
exactly the opposite of what a few studies have found, saying that
developing nations would be
much
stronger without such draconian intellectual property laws. But
why should Idris rely on studies when he's in charge of WIPO and his
opinion must be right on all things related to intellectual property?

Well-known environmentalist Willie Fontenot was giving some college
students a tour of an oil refinery recently. They were standing on a
public sidewalk, taking photographs of the refinery, when sheriff's
deputies and refinery security guards came over and asked Fontenot to
confiscate the students' drivers licenses and hand them over. Fontenot
refused, and as a result, he lost his job as community liasion officer
for the Louisiana Attorney General's office.
Antioch New England Graduate School, whose students were
photographing the refinery, has announced that it "is working with
Marylee Orr, Executive Director of the Louisiana Environmental Action
Network (LEAN), to create a fund to help Mr. Fontenot make up his lost
salary and continue to work for environmental justice in Louisiana
through a nonprofit organization of his choice." The Louisiana
environmental community is also looking into what else it can to
defend the right to stand on a sidewalk and talk to students. How
sad.
