Microsoft Throwing Its Weight Around

Microsoft Throwing Its Weight Around 12/19/2004 02:57 PM

Yeah, I know. What's new about that?

MS lawyers jumped all over the administrators of digital.forest demanding that they immediately shut down the MacSlash site because someone posted what appeared to be a valid Longhorn serial number in a comment to a post there. (Story here.) From the logs, the MacSlash guys figured that that comment was accessed exactly once in the eight months it was there. By MSN's own search bot.

Chuck Goolsbee, head geek at digital.forest, responded to the hounds:

A short lesson in human nature... Try asking nicely. I realize that owners of intellectual property feel the need to enter into discussions with lawyers blazing, but I know from long experience that attack begets defence, whereas courtesy begets respect. If you look at this situation objectively, I'm sure you will realize that the site owners have not acted in any malicious way. The content in question was posted to the bulletin board by some anonymous user. So, rather than using terms like "Demand for Immediate Take-Down" why don't you try something like "Please remove copyright infringing content".

You will likely be amazed at how much better it works.

(I've always liked that Chuck!)

Of course, Ben from MacSlash edited the serial number out of the comment as soon as he realized it was there. The funny thing is that now that it's gone from MacSlash, it can still be seen in Google's cach e of the page. I wonder how many people have seen it now.

The difference between throwing a bullet

The difference between throwing a bullet
and shooting it out of a gun
05/18/2004 01:24 AM

I've started trying to exercise more regularly for the past couple weeks, going for a 12 mile, hilly bike ride 3 times a week. Today I did my ride with a decent average speed and finished it in the shortest time yet. The loop I ride has a couple 10% grades in it and I do about 250ft of climbing through it. I was walking around the house today feeling pretty cocky about my progress when I sat down to watch one of my current favorite shows, The Lance Chronicles.

On tonight's episode they followed Lance Armstrong through his european training. One of his regular rides was a 4 1/2 hour, 30 mile climb from the flats high into the mountains, going straight up. It turns out he climbs over 13,000ft in that single ride. When I was in marathon shape, I did a few hikes where I would gain about 6,000ft in a single day from basecamp to summit, and Lance is doing more than twice that. As a training ride.

I'm thinking he's a shoe-in for this year's Tour.

Man Angry At Mobile Phone Service,
Starts Throwing Phones
05/14/2004 03:14 PM
These days, with things like number portability around, if you don't really like your mobile phone provider, you can simply change providers. Apparently, that wasn't what a man in North Dakota wanted, though. He went to the local Verizon Wireless store, pissed off about something, and when yelling at employees (his original intention) didn't satisfy him, he started to fling mobile phones around the store causing $2,000 worth of damages and injuring (not badly) an employee. Of course, you have to wonder about his claim that he only intended to yell at employees. Before he started his fling fest he apparently took off his shirt (?!?) and put on safety goggles. Amusingly, this was done at a Verizon Wireless store - and Verizon Wireless tends to get some of the best marks for customer service.

VC Tries To Defend Claria... Sort Of

VC Tries To Defend Claria... Sort Of 08/13/2004 02:43 PM
Back in April, we noted that a clueless VC had dumped $40 million into a company that was widely hated for their spyware. Now, in an article that certainly doesn't do any favors for anyone's impressions of the VC industry, a venture capitalist tries to divide the spyware/adware/malware offerings into the "nine levels of hell" and admits that anything above level 3 may be okay for VCs. It's obviously slightly tongue-in-cheek, but the point remains that certain VCs (including the writer of the article) think that even if the way you make money is by tricking users, it's ok. A smart VC with a long-term view would realize that tricking users is never a long-term strategy that will succeed. The point she is really trying to make -- which she unfortunately buries all the way at the end -- is that if users want adware, they should be able to install it themselves. This is the positi on we've taken here as well. We agree that many of the anti-spyware laws go way too far, in that they confuse two issues: (1) is the spyware being disclosed to the user and (2) should it be able to put ads next to competitor web sites. The real problem with spyware is that first issue. However, for the few people who actually do want to install these programs, they should be free to. Unfortunately, the sneaky tactics most of these programs use, shows just how much real demand they have. It's too bad that this article mostly brushes over how sneaky most spyware programs are in how they are installed, and focuses more on the competitive ad products. In the end, it makes her look like she's defending Claria, when her final hedging shows she would never invest in the company anyway (since Gator is often installed without the user knowing it, and uses popups -- both of which she deems below the levels of hell where she'd invest).
