Continental Congress. Richards speculates he was the first to do so,
and should thus be a model for Creative Commons.
So at first I thought that was right (the model part; I don't know
enough about the history part). But here's why I don't think so now:
We should distinguish in this debate between altruistic copyright
policy, and reasonable copyright policy. I'm all for altruism, and we
certainly don't have enough out there. But
Creative Commons is not about
altruism; it is about reasonableness. CC says balance, not self-less.
It is trying to find a way to restate what balance there should be "in
the digital world" (how I hate that phrase). Voluntarily, no doubt,
but not self-lessly. Self-lessness, and sainthood, like free and open
source software, have enough models out there. CC is not yet another.

unproven
gang activity, Interlake High School has banned baseball caps, and the
wearing of hoods, stemming from alleged gang involvement on the part
of a few students. The faculty "believes" there to
be gang actvity, and we all know that gangs require hooded-sweatshirt
/ ballcap uniforms, or you're out... Gang members can usually be
singled out due to their poor fashion taste, but it has nothing to do
with how they joined. This must be more of that freedom we North
Americans seems to endorse so much...

chairman of the Federal Communications Commission, talked a great game
last night at the

ways On conference at Stanford. He spoke out for an open
architecture on the Net; indicated that the broadcast "indecency"
rules are at best questionable from a Constitutional and logical
framework, and generally impressed a crowd of technologists and tech
constituents.
I'll be happier when his views translate more firmly into FCC
policies, and when Congress discovers that the distinction between
media are growing far too hazy for the old rules. But this is genuine
progress.
There's lots of blogging going on here. My older, wiser brother
Steve is part of the ZDNet team that's posting here.
Oh, here's Powell's al
leged blog, which has been drawing attention. I say "alleged"
because while I think it's great that he's posting and listening --
two of the major components of blogging -- this neither looks nor

the Island ECN after closing at $14.76 on Friday following news that
the company agreed to a multi-year strategic alliance with Microsoft

Wired is running an interview with Pamela Jones, who has been doing an
amazing job analyzing every SCO misstep over at GrokLaw. If you follow the case at
all, you're likely to be familiar with the site. The interview,
though, focuses on what she's
going to do with the site once the SCO mess goes away. It's clear
that she's not going to stop, but is gearing up to take on other
intellectual property messes (which will continue to come, fast and
furious). The reason I'm posting this, though, is a great quote from
her concerning the problem of patenting software: "With time I expect
that as tech savvy-ness increases in the judiciary, and it will,
someone will notice that software is just math, creativity and math,
and patenting 1 + 1 = 2 will eventually set us up to where only the
owners of that and similar patents can write software. Meanwhile the
rest of the world will move ahead in development, while the United
States is stuck in the mud because no one can write 1 + 1 = 2 without
crossing somebody's palm with silver."

Phishing has never been that much of an issue for me, because most of
the phishing emails I've received have been for big name banks, where
I don't have an account. The bank I do use is pretty small, which I
figured made it highly unlikely to be a threat from phishers. Perhaps
that assumption was wrong. Phishers have apparently tapped out the
big name banks and are increasingly targeting lesser
known banks and credit unions as they try to scoop up additional
victims -- especially from banks and credit unions (and their
customers) who figured they were pretty much immune to the problem.
We should have known better... It's really a "security by obscurity"
technique, like people who choose a less popular computing platform
solely on the basis of "security," when that security may only be
because it's less attractive to hackers. Of course, my second
strategy in avoiding the problem probably has been working: I pretty
much ignore all of the emails from my bank as they tend to just be
"spam" marketing anyway.

Recording industry drops amnesty program for
file-sharers: The RIAA has ended their amnesty program that let
you off the hook for copyright violations if you turned yourself
in.
...the trade group explained that it no longer deems the program
useful because it considers the public educated or aware enough now to
know that they could be sued for file-sharing.
The RIAA added that the number of people stepping forward to
participate in the program has slowed "to a trickle."
In all, 1,108 people signed up for the program, the RIAA said.
They announced this change in papers filed to dismiss that one guy's lawsuit over the program.
