Following Blockbuster's plan to drop late fees in favor of a longer grace period and then a large lump charge for "buying the movie" if you waited too long to return the film, New Jersey came along and sued Blockbuster for being misleading about its "no late fees" marketing slogan. Apparently, 46 other states jumped on the bandwagon and sued as well. Sensing trouble, it appears that Blockbuster has given in and will pay up a fine, refund fees paid and change their marketing program away from the "no late fees" claim. It still seems like Blockbuster had a valid claim here. A late fee is a "punishment" fee for returning a product late. Blockbuster wasn't punishing customers, but simply assuming that they were buying the video in question. In other words, people were getting something in return for those fees -- not just randomly charged.

Last year we wrote about the increasing practice of stealth inflation on telecom bills, where the telecom company would hide rate increases by adding official looking fees such as the "federal recovery fee" that look as though they're required by the government, when the truth is anything but that. Now, found over at Broadband Reports, comes the news that a consumer advocacy group is asking the FCC to take a more active role in regulating those fees. For example, they point out that nearly a billion dollars has been collected in fees related to number portability, but there's no data on what that's being used for, or even how many people have benefited from number portability. The group isn't objecting to the fees completely, but believes that the wireless carriers should be more open about what they're collecting these fees for, and how the money is actually being put to use.

SCO Group recently announced that it will no longer seek legal action against companies running Linux. In lieu of this announcement, companies' interest in protecting themselves from SCO's lawyers has waned.

In a move to counter such complacency, SCO is currently "evaluating" raising it's licensing fee. Blake Stowell, SCO's Public Relations Director, claims that "companies that license now may be able to do so cheaper than if they do so later", alluding that lawsuits could potentially happen again in the future.

Interest in SCO's SCOscource license program has been steadily tailing off which could suggest that many companies believe SCO will lose it's various court battles. If this happens, SCO's claim that Linux contains it's intellectual property would dissolve and the need for licensing would be no more.

We've had plenty of stories about phone companies and all of the additional fees they add to your bill, but the Miami Herald has a few examples where the situation clearly goes beyond any reasonable level. Take, for example, a simple plan from BellSouth, advertised at $11.04/month. What they leave is out the extra $16 in fees and taxes (BugMeNot required) that turn the $11 plan into a $27 one. Then, there are companies like Primus which is adding a $15 "low usage" fee for anyone who doesn't make $25 worth of long distance calls per month. The telcos come back with their usual refrain that they somehow "need" to collect this fee "to recoup normal business expenses." That, of course, is a ridiculous statement. Any normal business prices their "normal business expenses" into their advertised prices. This is simply a way for the telcos to advertise lower prices than they're really charging. Perhaps other companies should get into this game as well. Want a pizza pie? It's just $3, but there's a $3.50 "crust fee," a $9.38 "oven fee," a $4.50 "service fee," and a $2.18 "cleanup fee." Plus tax.
