A Line in the Sand: Here's a good, level-headed opinion on why the Movable Type 3.0 controversy shouldn't be one.

People feel like they have been betrayed… with all this talk of people jumping ship. Half of you would still fall into the free release category! Doesn’t anyone realize what MT will be turning into? If these people are making MT their livelihood, judging by their great track record, you can count on a quality product that will have a devoted team working to constantly make it better. [...]

Isn't there anything better to get all up in arms about? Too many of you are acting alarmed because you feel like you have to, this hive-mentality is ridiculous! If you have such a huge site, with so many authors, so many blogs and can't find the funds, then just simply don't upgrade right now.

Last Sunday's column, about the entertainment industry's latest effort to restrict our ability to make use of the copyrighted material we've purchased, took the technology industry to task for a belated response. Gary Shapiro, president and CEO of the Consumer Electronics Association, challenged me on that, saying the response was as quick and effective as he's seen from the industry to any challenge. Shapiro was, indeed, quick to jump into the fray, but the bulk of the tech industry didn't wake up nearly fast enough. Meanwhile, I'll take this opportunity to ask you again to contact your U.S. senators and express your strong opposition to the bill in question, S.2560. There's no time to waste. Om Malik is pretty hard on Real about their price reductions.

He sees it as a last ditch effort.

I see it as natural market pressures on Apple. Their model is wrong.

I actually like Napster's model the best. Real's Rhapsody doesn't work if you're off-line. And what's wrong with Roxio dumping their tools?

Maybe digital music downloading DOES have a future?

Anyway - here's Om's post....

Engadget points to a New York Times article about Real's half-off sale. Given that record executives would pimp their mama out for dollars, it is clear that Real is eating all the costs. Wonder what it will do to Real's bottomline next quarter. The 49 cent songs and $5 albums are ITunes compatible. Real has jumped onto the blogging bandwagon and launched Freedom To Choose blog. "We know that at 99 cents a download even Apple isn't making much profit, RealNetworksmust be losing more than just a pretty penny on each sale. Pai dContent estimates, "RealNetworks will be losing about 40 cents on every song it sells. The company plans to tell investors its music fire-sale could directly add about a penny a share in losses to its third quarter financial results, equivalent to about $1.8 million. (PaidContent has a dedicated page for Real.) "Apple fans, now's your chance to put them out business!" writes Engadget. Gizmodo says this "could be the start of the first legal music downloading price war. Apple probably won't flinch (yet), but hopefully this is a sign of lower prices all around in the near future." I think this is the last ditch gamble for Real. If this fails, well it needs to go figure out a new digital music strategy. Also expect this to soon enter the halls of corporate cock-ups, aka 101 Dumbest Moments in Business, Business 2.0's annual list, right next to the Roxio-turnin g-to-Napster disaster.

  • Tim Lambert: W hen Think Tanks Attack. Why are all these think tanks so down on Open Source? Well, the Small Business Survival Committee is concerned that using open source will expose small business to the risk of lawsuits. Citizens Against Government Waste is concerned that the Government might waste money on Open Source. Defenders of Property Rights is concerned that Open Source might be a threat to intellectual property rights. However, I was able to detect a common theme to all their criticism. They all seem to be funded by Microsoft.
  • This piece isn't absolute proof, but it's another layer of circumstantial evidence that Microsoft is continuing its campaign of what I've called "opinion laundering" to make a case against LInux and other free software. (See previous looks at this subject here, here and here, for example.) Microsoft is hardly alone in this activity, of course. Lambert's article looks into the tobacco archives and shows how major think tanks were paid by tobacco companies and took positions congruent with the tobacco interests' own views. The bigger problem is that we often don't know who is funding which think tank, and many won't tell us. Even the ones that do say they're getting some money from companies like Microsoft won't say how much. If the "contribution" is .001 percent of annual funding, that's trivial. If it's 50 percent, that's not trivial. But we are never told this relevant information. None of this is illegal, but it's definitely sleazy. We need laws, not that this Congress or administration will every touch the topic, to force think tanks to reveal the sources and amounts of their funding in amounts over, say, $500. That would let individuals continue to contribute in privacy, but would shine a needed light on the opinion laundering that is now so prevalent. In the meantime, when a think tank takes any position on just about anything, your first instinct should be to ask, "Did someone pay for that opinion?"
