December filed an appeal Tuesday arguing that the ruling violated the
First Amendment and that Apple should first subpoena its employees or
use computer forensics to determine the sources of the leak.
Apple filed a civil complaint against unnamed individuals who
allegedly stole trade secrets and posted detailed information about an
unannounced Apple product last December, and on March 11, a California
judge ruled that Apple has the right to subpoena the records of the
three Macintosh sites that published details on an unreleased Apple
product.
"The California courts have a long history of supporting and
protecting the freedom of the press," attorney Kurt Opsahl said
representing the journalists. "The Court of Appeal will now get the
opportunity to correct a ruling that endangers all journalists."

01/05/2005 04:10 PMApple has filed a third lawsuit in less than a month, this time
against the publisher of the Think Secret website and other unnamed
individuals, alleging that recent postings on the site contain Apple
trade secrets, according to court documents seen by CNET News.com.
"Apple has filed a civil complaint against the owner of
ThinkSecret.com and unnamed individuals who we believe stole Apple's
trade secrets," Apple said in its statement to CNET. "We believe that
Think Secret solicited information about unreleased Apple products
from these individuals, who violated their confidentiality agreements
with Apple by providing details that were later posted on the
Internet."
In its suit, Apple specifically lists certain articles that contain
confidential information, though it does not confirm which of the
article's details are true. For example, when mentioning the report
that Apple plans a "G4-based iMac without display," Apple says the
article "disclosed numerous confidential details regarding the
technical capabilities of Apple's unreleased computer product as well
as Apple's confidential marketing plans."
The CNET report says similar confirmation is offered regarding iWork,
which Think Secret said on Dec. 31 would be a suite of office software
combining the company's Keynote presentation program with a new
document creation application called Pages. "The postings on Think
Secret included detailed technical specifications and product code
names," the lawsuit maintains. "Apple had maintained and protected
this Future Product Information as trade secrets."
Apple also mentions articles that discussed updates to the company's
iLife suite as having "disclosed various technical specifications
regarding Apple's unreleased 'iLife '05' software product."
This latest lawsuit is the company's third intellectual property suit
in recent weeks. In other court cases, Apple is suing two developers
who it says distributed prerelease versions of Tiger.
In a separate action, it is suing unnamed individuals who leaked
details about a forthcoming music device code-named Asteroid. Apple
won court permission to issue subpoenas to Think Secret and two other
Mac enthusiast sites in an effort to ferret out who leaked the
information.

Volokh, Feedster, Gawker Media, Joi Ito, Gothamist, Rebecca MacKinnon,
Groklaw, Jay Rosen, Groklaw, Glenn Reynolds (a.k.a. "Instapundit,"),
Markos Moulitsas (a.k.a. "Kos") and many, many more filed a joint
"friend-of-the-court" brief (PDF) today supporting the journalists in
Apple v. Does -- the case in which Apple Computer is seeking to unmask
online journalists' confidential sources for articles about

attempting to prevent one of its ex-employees from joining Western
Digital, a competitor.Pete Goglia recently left Seagate Technology LLC
to join Western Digital Corp., where he will lead that company's
read/write head development after serving at Seagate for 16 years.
Seagate is attempting to block the hire, claiming that Goglia will not
be able to avoid disclosing Seagate confidential information and trade
secrets in the course of his new job.
"This is a situation in which one of our competitors has recently
acquired the read/write head assets from a bankrupt supplier, and has
stated their need to strengthen their capabilities in that
technology," Dave Wickersham, Seagate's chief operating officer,
said in a statement released late Friday. "We do not wish to
impugn Mr. Goglia, but only to ensure that Western Digital does not
build its new recording head capabilities with Seagate trade
secrets."

04/14/2005 04:59 PMWith all the talk recently about "citizen journalism" and getting
everyone to report on news events as they occur, many in the
traditional media are dismissing these citizen journalism efforts as
being "not journalism" or just plain "bad." Generally, though, those
who are responding this way are probably doing so because they
actually feel threatened by these efforts. A smarter move might be to
embrace the efforts, and while recognizing that many of the citizen
journalist reports will have problems, look for ways to help improve
them. The folks at E-Media Tidbits are suggesting that traditional
news organizations
actively look
into training so-called citizen journalists. They can
complain all they want about the quality, but this is an opportunity
to actually help improve that quality. The idea is that a "trained"
citizen journalist gets some sort of status that makes it easier for
their material to rise to the top. While it's not clear if this
particular suggestion really does make sense (or if it's just a way of
trying to add another layer of "certification" to the process), it's
still good to see some at least thinking about ways in which
traditional news organizations can work
with these new efforts
-- rather than simply scoffing at them and pretending they don't
exist.

question of whether or not bloggers deserve the same protections as
journalists (which many have extended to mean "are bloggers
journalists?" -- which is a silly question, when you think about it).
However, in the decision concerning subpoenas, the judge
clear
ly avoided the issue for a good reason. It really had little to
do with the case at hand. Instead, the question is
what's the
definition of a trade secret? The judge made it clear that if
this was a trade secret violation, then any journalist would be just
as guilty -- since this isn't so much about "whistle-blowing" as it is
about revealing product data before it was to officially be released.
Of course, that complicates matters. What if the process of whistle
blowing also involves revealing trade secrets? In most cases, it
does. It seems like, for now, the test being used is whether or not
it's a public safety or health issue, in which case it becomes
protected whistle-blowing. If it's just product data, then it might
not be protected.
