Politicians never seem to tire of overr eaching into internet-related legislation. If anything, it seems to be picking up. Today's example involves lawmakers in Massachusetts who have taken up the cause of underage … word-of-mouth and viral marketing. Yes, that's right. A proposed bill in that state would prohibit kids under 16 from participating in "online buzz" marketing campaigns without parental consent. Finally, someone is taking on that great scourge, ad consumption by minors! Not to mention that it's so broadly written, you could arrest an entire middle school for text messaging each other about American Idol. With any luck, this meddling and unenforceable drivel will die before reaching a vote. Adding to the story's absurdity, leaders of the Word of Mouth Marketing Association (WOMMA) and Viral + Buzz Marketing Association (VBMA) are weighing in on the issue. It appears there are two organizations dedicated to such activity and looking after the interests of impressionable children. One of them has its own confe rence, but perhaps they didn't get the word out enough. Sadly, a misguided law such as this would only obscure a legitimate debate about the many more subtle ways companies are influencing children -- and the ways their parents are letting it happen -- through a host of media and otherwise.

Fafnir of Fafblog has written a good think-piece explaining the logical next step in the Bush administration's campaign to protect the rights of the unconceived: protecting the rights of the inanimate.
This is yknow a huge step backwards for women's health and for contraception and the prevention of abortions. But it is a huge step forward for what we at Fafblog like to call the "rights of the unconceived," which is just a few short steps from what we are really lookin forward to which is the rights of the inanimate.

I have personally spent hours an hours talkin to cans, waffle irons, boxes, printer cartridges and forks and they all dream of one thing: no longer bein treated as second-class citizens in the United States.

The common bit of wisdom is that MP3s are a young person's technology. It's the teens and the folks just coming out of college that are the MP3 generation, after all, so they'd be the most likely to own an MP3 player, right? Not at all, apparently. A new study says that 90% of MP3 player owners over 34 years old. While this may have something to do with the high price of many of the best MP3 players, the numbers still don't seem right. It would be interesting to see the methodology behind this study. That's not to say that those over 34 aren't likely to own an MP3 player, but it's hard to believe that 90% of MP3 players go to those 35 and older.

I rarely say "fuck" on my blog, but "Fuck you Japanese politicians!" (Lucky the FCC doesn't control my blog... yet.) I've paid about 1/2 of all of my life earnings in tax to the Japanese government and have paid my premiums to the national pension system even though studies that I worked on at the Association of Corporate Executives showed that I would most likely not benefit from these pensions. Now it turns out many Japanese politicians don't pay their national pension premiums. Actually, a third of the cabinet members haven't paid their pension premiums. The "Vice President" of Japan, Yasuo Fukuda just resigned for not paying his premiums. This is all amid a move by the government to increase premiums and lower pay-outs. The study we did showed that unless you were about retirement age today, would would most likely receive "0" from the pension system.

What's worse is that they use strong arm tactics like using the agricultural union (which hires retired bureaucrats and takes a commission) and other semi-public organizations to collect premiums from average citizens.

This is totally disgusting and I really wonder why I live and pay taxes in such a corrupt country.

Sorry I don't have links and references. This is a spur of the moment emotional post based on newspapers and radio that I skimmed today while I was trying to relax.

What is it with the difficulty politicians seem to have understanding what a P2P file sharing network is, and why none of the networks have control over the content being shared? The latest is that a group of 40 states have teamed up to write a threatening letter to file sharing companies accusing them of all sorts of bad things. In whose name are they doing this? Even though the courts have recognized file sharing networks for what they are, it appears that the state attorneys general seem to believe that they can ignore what the law says when the entertainment industry starts telling them how evil file sharing networks are. Update: Ernest Miller asks, "why shouldn't the state attorneys general condemn email and FTP as well? An awful lot of child porn is shared via email. Shouldn't email providers be doing more to stop it?"

For the past decade or so, there's been a growing interest in the concept of "word of mouth" or "viral" marketing -- where the idea is to get people to tell others about it. This has been helped along (greatly) by the rise of the internet. Since it's a communications platform more than a content platform, it makes it quite easy for people to tell others about something interesting or cool that they've seen, even if it is advertising. So, it was only a matter of time until some marketers set up a conference just for word of mouth marketing -- though, you have to wonder exactly how they got the... er... word out. It will be interesting to see how this technique evolves, because too many marketers still seem to think that marketing is about tricking users into viewing an ad or buying a product. The whole point of viral marketing isn't to trick people, but to make the advertising interesting and engaging so that people want to find out more about your product. That's a very different mindset, and it's not clear everyone has figured that out yet.
