up at the Digital Copyright Canada Wiki:
We, the undersigned residents of Canada draw attention of the House to
the following:
THAT the Copyright Act is properly recognised as being a careful
balance between the rights of creators and the rights of the public
(including viewers, readers and listeners);
THAT the Supreme Court of Canada unanimously affirmed this view in CCH
Canadian Ltd v Law Society of Upper Canada;
THAT digital technologies have recently given copyright holders the
ability to upset the balance in the Copyright Act by preventing
Canadians from accessing works for purposes that have been legally
granted to them;
THAT the creation of original works is nourished by wide accessibility
of earlier works, including a vibrant public domain;
THAT dissemination of cultural ideas requires that they be preserved
in a form that is accessible to future generations; and
THAT historically, consultations regarding changes to the Copyright
Act have mostly taken place with creators, intermediaries and only
some special users (such as educators and librarians)
THEREFORE, your petitioners call upon Parliament to ensure generally
that users are recognised as interested parties and are meaningfully
consulted about proposed changes to the Copyright Act and to ensure in
particular that any changes at least preserve all existing users'
rights, including the right to use copyrighted materials under Fair
Dealing and the right to make private copies of audio recordings. We
further call upon Parliament not to extend the term of copyright; and
to recognise the right of citizens to personally control their own
communication devices.

The
Copyright Board of Canada
issued a ruling on
" private
copying ", largely via peer-to-peer computing, with several
components. First, downloading is acceptable, but uploading is not
(presumably to target hyperpirates). Second, new mechanisms for
levies were described, freezing current ones, allowing new
charges.
the Copyright Board said uploading or distributing
copyrighted works online appeared to be prohibited under current
Canadian law.
However, the country's copyright law does allow making a copy for
personal use and does not address the source of that copy or whether
the original has to be an authorized or noninfringing version, the
board said.

Parliament vowing to "fix" this, it's time to take action. If you're a
Canadian resident, there's a petition to Parliament you can sign to
encourage lawmakers to do the right thing.

06/14/2004 09:01 PMCopyright has become an election issue in Canada, and with the federal
election looming on the 28th (I've cast my absentee ballot, for Olivia
Chow, and have my fingers crossed for a nation run as well as Toronto
was under Jack Layton) the copyfight is heating up back in my
homeland. Most recently, a Liberal MP from my old riding of Parkdale
introduced a poorly thought-out bill that would have been bad news for
the Internet. Michael Geist wrote an editorial about this in the
Toronto Star, and the fallout has been intense, with letters going
back and forth in the paper. Michael's written a followup editorial
that the Star just ran.
Further, copyright reform proceedings must also be perceived to be
balanced. According to Elections Canada, Bulte and her riding
association have accepted thousands of dollars in campaign
contributions from rights holder groups and broadcasters.
Parliamentarians involved in the copyright reform process should
refuse all such contributions to ensure that the perception of
absolute impartiality is preserved.

The Canadian Recording Industry Association's call for what is
effectively a notice and termination approach to removing allegedly
copyright infringing material. CRIA's counsel told a Parliamentary
committee
that once an ISP receives notification that a subscriber is offering
copyrighted works for download, the ISP "ought to kick that
subscriber off the system." The approach would be the most radical
worldwide as the proposed removal would presumably come without a
court hearing or other due process. Given that CRIA lost its file
sharing suit in Canada earlier this year, this would appear to be an
end-around the court system by attempting to force ISPs to terminate
subscriber service based on a mere allegation of activity that may or
may not constitute copyright infringement.

07/22/2004 01:22 PMWith the recent release of the
4G iPods, Apple released an iPod firmware update
adding new features/functionality to the iPod. Unfortunately, the new
features are only available to 4G ("click wheel") iPods?leaving the
not-so-old 3G iPods in the dust.
When I first heard about this, my first response was, "Why can?t they
just release the same firmware upgrade for both the 3G and 4G models?"
I don?t know about models older than 3G, but as far as I know, the new
model is exactly the same as the 3G. The firmware could easily work
for both. This seems to be a marketing ploy on Apple?s part. Get the
people who want these simple new features to buy a whole new iPod.
Well, people aren?t buying it.

03/22/2005 03:49 PMLevel 3 Communications on Monday withdrew a petition before the U.S.
Federal Communications Commission (FCC) that sought to reduce access
charges paid to telecommunications carriers when calls originated over
VOIP (voice over Internet Protocol) end on the traditional telephone
network. Level 3 said in a statement it had withdrawn its request
because of a leadership change at the FCC. On March 16, U.S. President
George Bush named Commissioner Kevin Martin as FCC chairman, replacing
Michael Powell, who left the FCC this month.
The FCC was required to rule on the Level 3 petition by Tuesday if
commissioners wanted to deny it. If the FCC failed to act, the Level 3
petition would have been automatically granted. "Given the
appointment of new leadership only three business days before the
statutory deadline for ruling on the petition, we determined it was
inappropriate to ask the agency to resolve this important issue in the
timeframe required by law," James Crowe, Level 3's chief
executive officer, said in a statement.

charging corporate policy as complaints to customer service agents or
extremely huffy forum posts, Levi Wallach is doing what he can to
encourage T-Mobile to support synching on the Danger Sidekick --
something promised by the company for years and which is currently
being supported by non-U.S. cellular vendor Cable & Wireless.
Since all the data that goes to and from the Sidekicks has to go
through T-Mobiles servers (instead of just their network), I would
guess they would have to upgrade all their internal hardware to
support something like this, something perennial tightasses like
T-Mobile are loathe to do. But hey, sign Levi's petition and see what
they say, if anything.

09/24/2004 04:17 PMEuropean plane maker, Airbus, has withdrawn its petition in the on
going European Union investigation into Microsoft's activities. The
withdrawal has been viewed with some suspicion by Microsoft and
analysts, as it comes very close to the companies appeal hearing.
Last week, it was made public that Airbus had made a petition to the
EU regarding certain points in the ruling that it was concerned about.
It expressed concerns that the judgement could restrict its ability to
pick suppliers, and might hamper its business. The intervention by the
company was seen as a boost to the case for Microsoft, showing the
wider implications of a ruling against Microsoft.
Microsoft's chief legal representative in Europe, Horacio Gutierrez,
described Airbus' action as ‘unusual’, and strange so close to the
companies appeal hearing next week. Trying to put a positive face on
the action, he remarked that "these actions may illustrate why
other industry leaders have been sympathetic to the merits of our case
but reluctant to come forward and explain the negative consequences of
the commission's decision".
The case continues; Microsoft's EU appeal begins in a few weeks.
