A security company discovered some vulnerabilities in some Sybase code a couple weeks ago and handed them over to the company -- who did a good job of patching the problem relatively quickly. Then, things started to get messy, as the security company got ready to explain what the vulnerabilities were, leading Sybase to threaten to sue them. That's some thank you for finding the security hole. After a public backlash, Sybase has called off its legal dogs and issued an odd announcement "thanking" the company they were thinking about suing just a day before. It's amazing that this sort of thing keeps coming up. While this case had a bit of a twist, in that the bug was already patched, it's still all about a company trying to hide where its vulnerabilities are, rather than owning up to them. Security holes happen. Everyone knows that. The real question is how a company deals with them -- and that goes beyond just how quickly they patch the holes, but how they treat those who are helping them fix their software by finding the holes in the first place.

Cory Doctorow: I have the coolest job: my employer, EFF, is now officially doing development on Tor, an anonymizing network tool that lets people use the Internet without being snooped upon:
Your traffic is safer when you use Tor, because communications are bounced around a distributed network of servers, called onion routers. Instead of taking a direct route from source to destination, data packets on the Tor network take a random pathway through several servers that cover your tracks so no observer at any single point can tell where the data came from or where it's going. This makes it hard for recipients, observers, and even the onion routers themselves to figure out who and where you are. Tor's technology aims to provide Internet users with protection against "traffic analysis," a form of network surveillance that threatens personal anonymity and privacy, confidential business activities and relationships, and state security.

Traffic analysis is used every day by companies, governments, and individuals that want to keep track of where people and organizations go and what they do on the Internet. Instead of looking at the content of your communications, traffic analysis tracks where your data goes and when, as well as how big it is. For example, online advertising company Doubleclick uses traffic analysis to record what web pages you've visited, and can build a profile of your interests from that. A pharmaceutical company could use traffic analysis to monitor when the research wing of a competitor visits its website, and track what pages or products that interest the competitor. IBM hosts a searchable patent index, and it could keep a list of every query your company makes. A stalker could use traffic analysis to learn whether you're in a certain Internet cafe.

On today's New York Times op-ed page, Nicholas Carr of "Does IT Matter?" puts the FBI software meltdown in the context of other recent enterprise-scale software train wrecks like McDon ald's Innovate and Ford's Everest (he could have dragged in the IRS, too). As everyone does who addresses this topic, he references the Standish Group "Chaos" report from 1994, with its dire statistics about software failure.

As with his previous arguments on the topic, Carr gets things just about half right: Of course the record of large-scale software projects, particularly those meant to replace existing systems that are functional but graying, has been awful, and the complexity of these systems remains daunting. Carr concludes that the complexity is so overwhelming we should give up on innovating in software and just concentrate on doing the same things we currently do more efficiently: "When it comes to developing software today, innovation should be a last resort, not a first instinct."

He's forgetting that, in the world of software, innovation is the primary way to add value. We move existing "off-line" systems and processes into software not only to make them more efficient, but to give them capabilities the physical world can't provide. Thus online publishing isn't just about delivering text and images more cheaply; it's about connecting publisher and information consumer in new ways that change the whole relationship. Manufacturers implement inventory control systems not just to save money but to transform their businesses so they can build products when customers ask for them, rather than trying to guess what the market needs. If software isn't providing new capabilities, why bother? It seems obvious that we're a long way away from exhausting the possible new wrinkles software can offer business, government and society.

Carr is right that large institutions get into trouble when they try to replace big old systems and introduce complex new features at the same time. But his advice -- give up on those new features, be happy with what you've got -- is needlessly ostrich-like. The answer is not to abandon change but to structure change so that it's not a big bang but an evolutionary process. The failures in so many of these software disasters don't stem from ambition but from impatience and bad planning.

After an 18-week trial, a criminal court in Stuttgart, Germany, sentenced the convicted software pirate to three years in prison without parole for copyright infringement and selling counterfeit Microsoft Corp. software. The court also convicted the defendant's father for his participation in the counterfeiting scheme, issuing him a 16-month jail term and 100 hours of community service.
