The American Ninth Circuit court has been
listening to arguments about copyright infrigement and
liability for filesharing applications, notably Grokster and Morpheus . A decision
could shape the legal status of
peer-to-peer tools for the near future.
The
discussion has largely been framed in
terms of the landmark 1984
Sony v Betamax case . This is an appeal for an earlier
decision, where Grokster was found not liable for users' infrigements. Counsel for copyright
holders argued that Betamax could be read to allow blame to be
assigned to devices, and ended up
considering Xerox liable for bad copying. Their opponents argued for
substantial noninfringing usage, as per the Betamax decision.

01/23/2004 02:23 PMIn a move that seems likely to backfire on them partly out of the
audacity of the move, Sharman Networks, the company behind Kazaa, can
now
sue record labels and
Hollywood studios for copyright infringement. We had briefly
mentioned this case
back in
September, but now it's been given permission to move forward.
Sharman claims that the entertainment companies violated copyright law
by using Kazaa Lite (which is not actually associated with Kazaa) to
get on the network and monitor the file trading that was occurring.
At the same time, they claim that those same companies broke the terms
of service of Kazaa by sending threatening instant messages to file
traders, warning them that they were distributing unauthorized music
files. Sharman clearly has a stronger copyright case against the
industry than the industry does against them (in that they're actually
accusing the companies of copyright violation, rather than just
"facilitating" copyright violations) - but, it still seems like a long
shot that could reflect badly on them in their other efforts.

the importance of intellectual property, it hasn't been on the radar
screen of the Bush/Cheney administration... or has it? NBC got angry
that the campaign released an online commercial for the President
using
footage from an interview done on NBC. The campaign insists
they've done nothing wrong. Does that mean they're supporters of
"fair use"? Chances are they've never actually thought about the
issue, and this is yet another case of politicians who would push for
more stringent intellectual property laws, while making sure to ignore
them themselves when convenient.

victims of copyright infringement -- Hollywood studios and the music
companies -- are obviously so strapped financially, Congress may soon
order the Justice Department to use resources tracking file sharers
and filing lawsuits against them. (Yes, I'm being sarcastic.)
As Declan McCullagh reports,
legislation known as the "Pirate
Act" is moving with light speed through Washington -- getting not
even a hearing in committee before being sent to the full Senate.
Sadly, Vermont Sen. Patrick Leahy, who should know better, is part of
this travesty; but he's running for reelection in a state where he
couldn't lose if he tried, and apparently needs more money from Hollywood.
Oh, and once the government files suit -- with huge penalties -- the
copyright cartel companies will still be able to file their own suits.
Nothing like piling on.
I'm not endorsing rampant infringement for profit, the kind of
activity that truly fits the term "piracy," such as the stamping out
thousands of CDs or DVDs in Malaysian and Chinese factories that
deserves to be stamped out, harshly. I'm not endorsing petty
infringement, either, such as downloading songs you would otherwise
have bought in a store. But this kind of legislation, turning the full
force of the government against penny ante infringers, is far over the
top. In times like these, when there are real criminals out there,
it's insane.

report on filesharing and copyright infringement on college campuses. The group found
that awareness of copyright problems had grown, and many solutions
mounted.

After some weeks of advance notice ,
the film industry's lobbying group has launched lawsuits
against hundred of alleged copyright infringers.
One lawsuit, obtained by The Associated Press, targets 18 individuals
and was filed in the U.S. District Court for the Eastern District of
Missouri in St. Louis.
Other lawsuits are believed to have been filed in
New York, Philadelphia and other areas with large concentrations of
high-speed Internet customers. Such connections are required to
download the massive movie files.

demanding I stop sharing 'copyrighted' material, even though it's made
very clear on my site that the files I host on my Blog Torrent install

with it). The file in question is a short documentary about Booth
Babes my wife and I made and posted on our site back in 2001, and the
file that tipped them off was generated by my test install of
Broadcast Machine (which has been mysteriously not working on my
server)."
I don't want them to turn off my websites. And this is not any kind of
civil disobedience, which would involve breaking a law. I'm just
uploading my files to the Internet and trying out some technologies to
facilitate this with the lowest demand on my webserver. If hosting
companies apply some kind of blanket filter against .torrent files,
that will seriously limit our ability to share media and content. It
is completely unacceptable for web servers to do this kind of
unmonitored regulation and threatening. What if I had been on
vacation, couldn't respond, and they shut down my site in a week?

Indian man named "Andre" who seemed to grasp the silliness of the
situation. He escalated the issue to his manager, and said I should
hear back within 24 hours. So I've been waiting. No reply to my email
either so far.

Copyright Board of Canada
issued a ruling on
" private
copying ", largely via peer-to-peer computing, with several
components. First, downloading is acceptable, but uploading is not
(presumably to target hyperpirates). Second, new mechanisms for
levies were described, freezing current ones, allowing new
charges.
the Copyright Board said uploading or distributing
copyrighted works online appeared to be prohibited under current
Canadian law.
However, the country's copyright law does allow making a copy for
personal use and does not address the source of that copy or whether
the original has to be an authorized or noninfringing version, the
board said.

head of WIPO's comparison of copyright infringement to terrorism. God,
how I hate the comparison of all things to terrorism, it's such shoddy
rhetoric. Really: if copyright infringement is like terrorism, does
that mean that our first line of defense against illicit music
downloading shoud be the systematic confiscation of nailfiles and
scissors from business travellers?

counterfeit baby shampoo and warned of the potentially disastrous
consequences of relying on machines that had been made using an
illicitly duplicated model.
Excuse me, but those aren't intellectual property/piracy problems.
False advertising is a consumer protection issue and a problem that
everyone supports eradicating...
However, there have been several documented instances where WIPO's own
high protectionist patent and data registration policies are actively
hurting patient access to AIDS-related drugs and other essential

in Alternet about Mash-ups, going over the copyright laws involved
and how the laws are viewed in the mash-up scene. It's an interested
clash, where restrictive laws loom over digital musicians armed with
low-cost computers and software that makes mixing easy. In this realm,
Newitz sees mash-ups as a form of protest, where DJs knowingly violate
laws in order to spread their art in the world.
As a masher on [Get Your Bootleg On] recently posted, "Everything is
illegal." Under an I.P. regime where artists feel like nothing goes,
it seems that everything could. The infringement generation aims to
mash up copyright law in pursuit of better music. But it also has a
chance to challenge social divisions more profound than the

parody and someone was pulling a sick joke. But unfortunately a
clueless legislators who has gotten some serious campain donations from the sponsors.
I get tired of having to get up on my soap box but I must and will
until this madness is brought to a halt. Dan Gillmor sums it up
perfectly:
"This bill, the stated purpose of which is to criminalize
actions that might "induce" copyright infringement, doesn't just
overrule the Sony Betamax case, which gave us the right to tape TV
shows to watch later. It would turn people offering totally legitimate
technology into criminals, if what they offered could also be used for
infringing purposes."
The EFF has written up an example complaint that is on Gillmor's
site that could be submitted if this legislation makes it to the floor
of congress. I encourage your to read Dan Gillmor's article he has
links to the Elected Officials we need to write to this time.
Folks won't be long before we will have to swipe our debit cards
thru our multi-media devices to listen to music we have paid for or to
watch TV thru the set we purchased along with the monster cable bill
we have to pay every month. Think I'm joking don't you know their are
