Microsoft fired another shot in its defense of the patent infringement suit brought by Eolas Technologies, asking the U.S. District Court to overturn a Federal Court ruling. Microsoft has lost twice in the suit, once in a jury trial and once on appeal. Now, it's asked the U.S. District court to overturn the $521 million judgment and injunction against distribution of its Internet Explorer browser. Eolas, a spin-off from the University of California, sued Microsoft in February, 1999 for patent infringement related to the way the Internet Explorer browser handles media and plug-ins within Web pages.

Microsoft (Nasdaq: MSFT) will stop supporting Windows 98 on January 16th, although the software giant has said it may continue to release security patches for the older operating system if security problems warrant it. The company ceased its free Windows 98 support on July 1, 2003, and began charging callers US$35 per incident. After the January 16th cut-off date, users will need to consult the Microsoft Web site for help.

Sun emerges from the Microsoft settlement in good shape. The Sun-Microsoft alliance has been broadly perceived as an attack on Linux and the bailout of a weakened antagonist to preserve the illusion of competition. Certainly the deal is all about intellectual property, with licensing money flowing between Redmond and Menlo Park. The cash transfers recall the much lower number of dollars ($150 million) that accompanied the Apple bearhug in 1997 when Microsoft needed the continued existence of at least one other operating system after OS/2's demise.

Microsoft may try to strike a deal with Japan's Sony in an effort to compete with Apple in the digital music arena, the Wall Street Journal repors. Microsoft Chairman Bill Gates told the newspaper in an interview published on Thursday that the two companies could benefit from a broad partnership in digital entertainment, both having "a lot of incentive to work together" in digital-music "infrastructure," including online-music services and protection against improper music copying.
