Politicians have been threatening to put a "Cell Phone Bill of Rights" in place for years. The idea would be to force wireless carriers to open up their coverage maps and allow early termination for those whose homes or offices have coverage gaps. Now, it appears that threats from various state AGs has done the trick. Verizon, Cingular and Sprint have now agreed to reveal the coverage maps and let people cancel within two weeks of signing up for service... but only in 32 states, which sucks if you're in the other 18 (or if you use a different carrier). Also, it's unclear exactly which coverage maps will be revealed. The carriers have been adamant that the detailed coverage maps they have are trade secrets, so it still seems unlikely that they'll reveal them. The one thing this might do, however, is really force them to be much better about coverage gaps -- something that's been lacking (despit commercial advertisements to the contrary). Of course, none of this helps if you happen to move into a new home that is in a gap, but I guess there's only so much consumer friendliness you can force on carriers at a time.

Admittedly, wireless carriers are notorious for their poor service. However, with the advent of number portability, one would hope that a little competition should help to solve many of those problems. However, why wait for the market when you can sue? It looks like some groups are trying to come up with just about any excuse to file a class action lawsuit against mobile phone service providers. Now, I'm no fan of most of the wireless carriers - who I think have done a terrible job providing service to their customers and who are often misleading and downright sneaky in what they do. However, I also don't think bogus class action lawsuits help the situation much either.

For years, we've been saying that a true "Napster for mobile phones" was on the way, but the recording industry and (most) wireless carriers continued to put their head in the sand and think that mobile phones were somehow different than computers. This wasn't a particularly hard lesson to learn from just a few years ago, but both industries have an incredibly large set of blinders that they seem to wear. So, in the last few weeks as news spread about both SK Telecom and Nokia developing file sharing apps -- neither of which uses copy protection -- the industries were again taken by surprise. In response to these developments, they are fighting back by... complaining. Rather than actually dealing with the issue they're out talking about how such developments could be disastrous to their money making plans and how they shouldn't be allowed to continue. In other words, they're acting like buggy makers freaked out that someone is building cars and saying it shouldn't be allowed. While it was a bit surprising that the first developments came from large industry players, if the entertainment industry and the carriers somehow convince the large companies to back down on their plans, have no fear that smaller players will fill the void. The shortsightedness of so many companies in both industries continues to amaze.

Nearly a year ago we had a post where we discussed the fact that many shoppers on the market for a mobile phone service focused on what phone they wanted more than what service provider they wanted. So, if they wanted a certain Nokia phone, their choices of service providers was limited to those who sold that particular phone. A few months later we looked at how the carriers should respond to this and one of the predictions was that carriers would start to focus increasingly on white-label phones where smaller, lesser known device manufacturers would build phone handsets to spec and brand them with the carriers name. It appears that's exactly what's happening. The carriers have been doing their best to take the customer ownership back from the handset makers, and it appears to be working. More and more people identify their phone by the brand of the service provider, rather than the handset maker. Of course, the article uses Nokia and Motorola as the example cases of the big name handset makers likely to lose out - and back it up with Nokia's poor earnings. However, the story was written before Motorola posted very impressive earnings due to their handset sales taking off again. Maybe this is one battle that isn't over yet.
