The nasty fight over John Kerry's Vietnam War record (we're waiting for similar obsessive scrutiny in the media of George W. Bush's Guard record) continued to rage over the weekend, with new eyewitnesses coming forward to back Kerry and his campaign trying to put the onus on President Bush to denounce the dirty work being done on his behalf. So far, no denunciations from the Bush-Cheney camp, just an attempt to equate the lies of the Swift Boat Veterans for "Truth" with all 527 group activity, including MoveOn.org. The Kerry campaign, late to the fight on this one, seemingly caught off-guard that the SBVT campaign to destroy his candidacy would have such legs, issued a TV ad on Sunday calling on Bush to "denounce the smear" and get back to the issues.

In a can-of-worms style legal ruling, a judge has dismissed a case against Northwest Airlines concerning how they treated customer info. It's already well known that many web surfers ignore privacy policies or simply assume that, if there's any privacy policy, their info must be safe. However, in this case, the judge ruled that Northwest did not violate its privacy policy in giving out customer info, because there was no evidence anyone actually read the privacy policy! In other words, even if a company has a privacy policy, it doesn't matter, because no one will read it at all. While this (rightfully so) worries many consumer advocates who are now pushing for federal privacy laws, it also opens up other possibilities. Almost no one reads software end user license agreements. In fact, that's one of the reasons why adware is so common - because companies hide the fact that they're installing all sorts of junk on your computer in the EULA. However, if you took this particular ruling and applied it to the EULA, you could conceivably claim that no EULA is valid, because there's no evidence anyone read it either. In the meantime, though, this ruling really just confirms what most people already knew in the first place: most privacy policies are completely meaningless. The only difference is they used to just be meaningless to the company and now they're meaningless under law as well.

iRATE Radio, an open-source application that sends users free-legal MP3s through its radio client, is now able to read the ID3 tags of MP3 files to identify Creative Commons license information. Enabling this kind of feature is exactly why Creative Commons put forth its MP3 embedding strategy many months ago, which defines a standard way to embed Creative Commons metadata in the ID3 tag of an MP3. Our hope was that file-sharing networks, and applications like iRATE, would read the ID3 tags, and tell users if there was a Creative Commons license attached. This way, users could feel assured to trade these MP3s online, or even make remixes of them. Check out some screenshots of the CC enabled iRATE Radio application.

iRATE has yet to enable the second part of our MP3 strategy, where MP3s are validated through an automatic web page verification process. (Validation can be done manually, though). This step is important because it prevents people from making fraudulent license claims about the MP3s.

Beyond being able to read ID3 tags, iRATE Radio has a catalogue of over 46,000 MP3s it can send you. It's also really smart in that it enables users to rate songs and then sends you more songs based on your ratings and preferences. We hope that more applications follow the lead of iRATE!

It was brought to my attention today that Yahoo is copyrighting the RSS feeds for those that are setting up Yahoo 360 accounts. Some are already refusing to use the service because in a sense Yahoo now owns your content.

This may be a oversight on Yahoo's part and I hope it is, I will probaly use their service anyway but probably not the blog portion and give them some time to answer these issues. [Yahoo 360 Copyrights Personal RSS Feeds]

Folllowing up on this post about Yahoo webmail users receiving upgraded storage capacity in an apparent attempt by Yahoo to compete with Gmail, Boing Boing reader Brian says, "As a member of SBC Yahoo dial-up service, I received a notice yesterday that my email account now has a 2 Gig storage capacity. Obviously, this is separate from the free web-based email service from Yahoo, but 2 Gigs is bar far the most storage available to date, worldwide."
