07/07/2004 12:44 PMThe latest poster boy for spammers is Scott Richter, who gives a
fairly extensive
interview with PC World where he claims, among other things
that he's not a spammer, that he's making "the Internet a better place
with e-mail marketing," and that he may start selling an anti-spam
filter. It's funny because he continues to insist that he's not a
spammer, but talks about how, without him, all those anti-spam
companies would be out of business -- so they need him the way doctors
need tobacco companies to keep people smoking.

Anti-Spam Laws Sound Nice, But Won't Do
Much
12/09/2003 02:31 PMThe press is going spam crazy now that Congress has finally agreed on
a single spam bill, which will soon be signed into law by the
President. However, the people who actually understand the spam
problem are
slamming this law, and a new UK anti-spam law, both of which
will do little, if anything, to stop spam. In some cases, both laws
can be seen to legalize certain forms of spam - which will be
exploited as a loophole by just about every spammer with at least a
few functioning brain cells. As the article points out, both laws are
great if you believe that spammers are law-abiding, honest people.
Otherwise, they're terrible. However, with all the talk (good and
bad) about these spam laws, how come no one is asking how we're going
to measure the success or failure of these laws? Everyone just
assumes that they'll work (or they won't). Shouldn't we have a built
in way to check up on the results six months from now
and (more
importantly) shouldn't there be a plan B in the likely event that
these laws do nothing to slow the spam problem down?

Spammer, Anti-Spammer Involved In
Lawsuit Will Hold Public Debate
05/20/2004 11:41 PMJulian Haight, the founder of anti-spam service SpamCop, and Scott
Richter, the founder of spamming service OptInRealBig, are currently
in the middle of a fairly nasty
legal
battle over whether or not SpamCop can block OptIn's spam. Still,
the two have
agreed to appear together in public and debate the topic.
Both of their lawyers say that the debate will avoid the issue of the
lawsuit, but as the article points out, that seems unlikely. The
thing is, in listening to what both sides have said over the years,
you already know what they're going to say in this debate - and
they're talking at cross purposes. The spammers focus on their right
to make money, while everyone else talks about their right to be left
alone. The problem with the spammers' position is that they
don't have the right to make money. They have the right to
try to make money, but if it involves pissing everyone off, and
everyone decides to create and use filters to make email bearable
again - then that's their right too.

05/20/2004 07:05 PMRonnie Scelson is one of the shortlist of spammers who just seems to
love publicity. While many spammers like to hide away, Scelson's
always willing to talk. He testified before the Senate Commerce
Committee today, claiming that he is now
compl
ying with CAN-SPAM, but threatened to ignore the law if not enough
of his spam messages were getting through filters. He actually has
the audacity to complain that now that CAN-SPAM is in effect, ISPs
should be
required to let his mail through. Maybe the filters
are a little to thick around his head and the message isn't getting
through to him: the
reason his spam is filtered is because
people don't want it.

Spamming Travel Firm Sues Anti-Spammer
Spamming Travel Firm Sues Anti-Spammer
03/17/2005 03:26 AMHere's yet another case of a company accused of spamming getting
pretty upset when they're called on it. Someone asked a travel
company, named cruise.com, to stop sending him spam. They continued
to send him spam. He threatened to sue them under Oklahoma spam laws,
and featured them on his website. They turned around and
sued him for $4 million for defamation and trademark
infringement. They might have trouble on both those claims. First,
the guy seems to have the spams pretty well documented, including his
repeated attempts to opt-out. It's tough to win a defamation claim
when the facts alleged are true. Second, the trademark infringement
concerns the use of their logo on his website about them -- but, as
has been explained numerous times, trademark law is only to protect
against confusion, not to give full rights to the trademark. It's
quite unlikely that anyone going to this guy's website about how the
company was spamming him would confuse the site as one officially
sanctioned by the spamming company.

Spammer
12/29/2003 06:52 PMAlan Ralsky is famous as one of the top spammers around, so the NY
Times went to see what he had to say
about the new CAN SPAM
law. While he says that he's upset at how "one-sided" it is, it
won't do anything to stop him from spamming. He claims that he'll go
legit with a real opt-out address in emails, but it's tough to believe
that, when he claims in the same article that he's become an expert at
hiding his identity in how he sends out spam. He also says that he
can't stop spamming because there's "too much money" to be made - even
if (he claims) it's been getting more expensive lately to keep ahead
of all those filters. It's also amusing to see him blame "the
internet" for "forcing" him to hide his identity online. Perhaps, if
he wasn't annoying people by bombarding them with crap they didn't
want, he wouldn't have had to hide himself.
