Grokster File-Sharing Case Hits The
Supreme Court
03/31/2005 12:35 PM

The Supreme Court heard arguments Tuesday from representatives of major film studios and the recording industry who are seeking to shut down peer-to-peer services they say are costing them billions of dollars. One of the questions the court kept coming back to was this: What's more important — preventing potential copyright violations or allowing the market to come up with innovative new products?

The case began when MGM and several record labels filed suit against StreamCast Networks and file-sharing network Grokster, arguing that they were intentionally created to allow people to illegally trade copyrighted material. That case was thrown out by a circuit court in August, paving the way for it to be argued in front of the Supreme Court. "The scale of the whole thing is mind-boggling," argued recording industry lawyer Donald Verrilli. "They intentionally built a network of infringing users."

Why the Supreme Court will hear Grokster

Why the Supreme Court will hear Grokster 08/22/2004 07:30 AM
Cory Doctorow: Over on Lessig's blog, Tim Wu has enumerated 10 reasons that the Supreme Court is likely to hear the Grokster case:
1. These is a stated legal conflict on the Sony standard as between the 7th and 9th Circuits;
2. The 7th and 9th Circuits disagree (albeit in partially in dicta) on the relevance of willful blindness to secondary liability;
4. The Court has these matters in hand: it has granted cert. in many similar cases historically (Sony, 1980s, White-Smith (the Piano Roll case) 1909, Teleprompter and Fortnightly (Cable / Broadcast, 1960s & 1970s);
5. The Court has a vague sense that some far-out stuff is going on in the field of “Computer Law” that maybe it should check out;
6. Law clerks use KaZaA & BitTorrent to plan basketball games;
7. Stevens and Breyer deeply dig this stuff;
8. Scalia likes anything having to do with property;
9. Souter got his first computer last week.

And most importantly,

10. The Court loves to be the center of attention, and this would make it so.

US Supreme Court to consider major
copyright and technology case
12/17/2004 06:30 PM

The United States Supreme Court agreed to consider a high profile case involving the internet and copyright infringement. The question, which has been subject to numerous lower court rulings, concerns whether or not the creators of peer-to-peer software can be held liable for users' copyright infrigement. The companies cite the 1984 " Betamax case ," which immunized VCR makers from copyright charges. The intellectual property holder side of the case charges the software companies with knowing full well the uses to which their applications have been put.

Metro-Goldwyn-Mayer Studios v. Grokster Ltd involves a large group of players:

The large group of plaintiffs includes the Motion Picture Association of America, the Recording Industry Association of America, Warner Brothers Entertainment Inc. and a class of 27,000 music publishers and songwriters. The Supreme Court will hear the case in March and is expected to decide it by late June.

Appeals Court Rules For Grokster

Appeals Court Rules For Grokster 08/19/2004 02:20 PM
While Senator Hatch is trying to overturn the original decision that said file sharing programs weren't liable for copyright infringement that occurred on their networks, the Appeals Court has upheld the original ruling. The Reuters report only has two paragraphs now, but I'm assuming it will be expanded with details. Once again, it looks like the courts have been able to understand the difference between a person doing something illegal, and a company that provides a tool. This ruling isn't a huge surprise, of course. During the trial, the judges made it clear they weren't buying the entertainment industry's version of the story, when the judge told the RIAA lawyer: "Let me say what I think your problem is. You can use these harsh terms, but you are dealing with something new, and the question is, does the statutory monopoly that Congress has given you reach out to that something new. And that's a very debatable question. You don't solve it by calling it 'theft.' You have to show why this court should extend a statutory monopoly to cover the new thing. That's your problem. Address that if you would. And curtail the use of abusive language."

Cases Are Tough

We've had plenty of discussions about whether it causes problems that judges don't understand the technology they're making decisions about. Some people have suggested special "tech courts" with legal experts who also have a strong understanding of technology, but others think part of what's "good" about our court system is that the decisions are made by generalists who understand the law. Now, Supreme Court Justice Stephen Breyer is admitting that technology cases are particularly difficult to deal with, but doesn't necessarily think the Supreme Court should hire subject matter experts to help out on certain cases. He does think the issue requires more investigation however.

Cory Doctorow: Grokster goes to the Supreme Court next week, where the MPAA studios are suing the P2P company over producing a tool that can be used to infringe copyright, and nevermind that it has lots of non-infringing uses too. Ironically, Fox, a leading MPAA member, is actually advertising its movies on Grokster:
TWENTIETH CENTURY FOX FILM CORP., currently suing Grokster and Morpheus for alleged copyright violations enabled by their peer-to-peer technology, apparently advertises through software bundled with Grokster, according to adware researcher Eric Howes. Howes reported Thursday afternoon that he was served a full-screen trailer for the DVD of the 20th Century Fox movie "Fat Albert," after downloading all of the software bundled with Grokster--eight separate adware programs.

Morpheus Launching Phone Service -
Simple To Create VoIP VNOs?
02/17/2004 10:21 PM
Streamcast, the company behind the Morpheus file sharing system, is making news today by announcing that they're going to offer Morpheus users their own telephone service. The obvious connection most people make will be with Skype, the software-based voice-over-the-internet play, because it was written by the folks who created Kazaa - a competing file sharing system to Morpheus. However, the Morpheus offer is quite different, and opens up a much more interesting line of discussion. In this case, Morpheus is just becoming a virtual network operator (VNO). More commonly, people have talked about mobile VNOs (MVNOs) such as Virgin Mobile, where some other network operator handles all the dirty technical details, and a company like Virgin simply slaps their brand and marketing efforts on top. In this case, Morpheus is basically offering a Vonage-like service (powered by i2 Telecom), but with their own brand. It will be interesting to see if other brand companies start jumping into the VoIP VNO business as well. It's even easier to do than jumping into the MVNO business, and I could see a lot of companies deciding that there's a fit - though, it may be a tough sell to a lot of customers. Are people really going to gravitate to a Morpheus service over a Vonage offering at the same or similar price? Still, one of the nice things about such a VoIP system is just how easy it must be to create your very own VNO. How long until companies are offering the ability to automatically set up your own VoIP telephone company the same way you become an Amazon affiliate or put a Google search on your page? Anyone interested in signing up for a Techdirt phone service?
