If you thought all those worries about Google storing your email messages was a problem, you're certainly not going to be happy with a new court ruling that basically says it's okay for an ISP to read your emails. The case concerned a book seller who offered his customers free email accounts. Then, he read through any of their emails that came from Amazon.com in order to offer better deals on the books Amazon was offering. He was charged with violating wiretap laws, but the Appeal Court has ruled that because the messages were already stored in RAM on his server, he didn't actually "intercept" communications -- which is the basis for wiretap law. The court admits that this is a problematic finding, suggesting that perhaps its time politicians updated wiretap law to take into account the internet. Of course, knowing how all of our politicians have been acting lately, the idea of them trying to "adjust" wiretap laws for the internet age should be particularly scary, because it's likely that what comes out will be even worse than what we have now. Either way, with this ruling, people can make the very real case that anyone offering email services can read every email that goes through their servers without fear of breaking wiretap laws.

Linksys releases legal antenna add-ons for several of its Wi-Fi gateways: We've said it in this space before, and we'll say it again: in the U.S., you cannot legally mix and match antennas with Wi-Fi gateways. The FCC's Part 15 rules require that you only use antennas that were certified with the gateway that they were designed for. In response to a recent query made by a colleague of mine, the FCC wrote back a very clear response: When using Part 15 (2.4GHz) devices, mixing and matching components is a violation of the rules. Oddly, it is perfectly legal to sell antennas separately from gateways without violating any laws. It's only deploying them that is technically illegal. We haven't heard of any letters or prosecutions, however. Linksys isn't getting around this, but has rather taken several antennas and several gateways and paid the fees to get each of the combinations certified in a matrix. This cost them at least a few hundred thousand dollars in fees and associated expenses entirely separate from the development costs of the antennas themselves. Linksys has two kinds of antennas and matching stands for each. One add-on, the TNC Connector Antenna, is designed for two-antenna systems: WRT54GS, WRT54G, WAP54G, BEFW11S4, and WAP11. The one-antenna device, the SMA Connector Antenna, works with more specialized equipment: WRV54G, WMP54GS, WMP54G, and WET54G. Both antenna types cost $60 each (suggested retail), while the respective antenna stands are another $30. The stands allow mounting the antennas to a wall or ceiling....

Cops engage in ID thefy - legally! [sorry - reg. required was all I could find] Cops in Ohio were putting together a sting in a strip club. They paid a 24-year-old informant a $100 a night to work as a stripper in the club (What? After tips?) But in order to carry out the sting, they gave the informant a false identity. Instead of creating a new one, they simply plucked the details off of some poor girl’s drivers license and social security card, such that this girl now has being paid as a stripper on her record. And according to the law, this is PERFECTLY LEGAL — in fact the Ohio police’s right to do this was included as a provision in a new Ohio law that was aimed at stopping ID theft. Which also makes me wonder — was this a commonplace practice in Ohio or anywhere else? Is that why they sought to protect it in the law? Is some guy using my ID to infiltrate NAMBLA right now?

CDBaby, a wonderful indie music publisher, has put up a howto for legally selling downloads of cover songs.
If you record a cover version of a song, (meaning your performance of a song that has been released in the U.S. with consent of the copyright owner), you are entitled by law to release your recording commercially, and the owner of the copyright to the song cannot prevent you from doing so.

The Copyright Act provides for what is called a "Compulsory License", which means that if you follow the steps set forth by statute, you can distribute your recording of that song on a CD or over the internet.

The following details the procedure for individuals to obtain a compulsory license to digitally distribute cover songs over the Internet to end users in the United States.

I really need to get things together and finish the time-limited black hole route system I keep thinking about. Digging through the logs recently I've been finding that there are patterns in there to be teased out--systems that constantly hammer me with viruses or bang on the webserver with attempts to post comments to non-functional cgi programs. (Yeah, I left mt-comments.cgi around and just marked it non-executable) While it's not a lot of traffic, it's annoying traffic, and in the case of the virus bombs it's repeated over and over. I could just install a blackhole route for these things,...
