night, while trying to recall how that little run in Dylan's version
of
Delia went, and dang, if it
didn't have the
back story of that ballad. I love this kind
of stuff. The source of that account, John Garst, is the folklorist
king of such research--he puts
John Henry at a railroad
tunnel near Leeds, Alabama, just east of Birmingham on September 20,
1887, for example. Murder and heroic death ballad back stories are of
extreme interest to me, so I decided to post a few more here:

Last month, we wrote about how video games were getting
so
expensive, that almost all of the focus was on sequels and movie
tie-ins. Now, the NY Times is running an almost identical article
noting that
8 out of the 10 top video games are sequels. Of course,
what they forget to note is that many of these are sports titles,
where "sequel" isn't entirely accurate, as each game releases an
updated version with updated stats and a few additional features each
year. Still, the end result is the same as was described in the
original article: independent developers working on new types of games
can't get any attention from publishers. Lots of blame is thrown
around, from the expense of producing the games, to the hiring of
"consumer products" people at the publishers, to the end-of-life-cycle
for current gaming consoles. Of course, it seems like there are a few
simple ways to deal with this issue: first, the console makers need to
make it easier for independent developers to create games for their
consoles, and, since there seems to be a gap in the market, a smart
(or new) publisher should try to make a name for itself publishing
independent games. While the article complains that a "Blair Witch"
style video game success is almost impossible in the video gaming
world, they forget that it's also
almost impossible in the
movie world as well. Very few indie films become successful, but
there are still movie distributors focused on indie films. Perhaps
the gaming industry needs the equivalent.

probably available somewhere online. What many people probably don't
know, however, is how those products get there. Wired Magazine is
running a fascinating article looking at the
real
distribution process for unauthorized content. It is
not
about someone buying a CD and ripping songs to their Kazaa-enabled PC.
Instead, there's a complex, but amazingly efficient distribution
system that operates on a variety levels above the popular file
sharing networks, and the content all filters down. If you're
familiar with typical warez groups, it appears these are like
supersized versions of those -- where everyone involved is doing it to
get access to more stuff, but also just for the fun of it. While
what's happening in these networks is obviously very much illegal,
what's most fascinating is just how incredibly efficient a
distribution system it really is. If the entertainment industry was
being smart about things, they would stop reacting so badly, and start
looking for ways to actually
leverage this distribution system.
Of course, that would require them to adjust their business models,
and, as has become pretty damn clear, the industry doesn't believe in
ever changing business models.

continuing to send junk faxes in violation of US law numerous times.
The company has responded in a fairly questionable way. The FCC has
fined them
multipl
e times, which they've simply refused to pay. The company then
had a few of its employees create "new" companies to
continue
the Fax.com business under other names. Everyone involved was so
secretive about this little scam that in court, the CEO of one of the
firms denied he had any relationship with the firm
until his lawyer
reminded him that he was CEO. Now, the company is getting even
more ridiculous. Steve Kirsch had pushed forward the campaign against
the company by
suing
them for $2.2 trillion, which is what he figures they owe
based on current junk fax laws they've broken. He also set up a
website against the company. Fax.com, not shying away from its usual
bold moves is
now
suing him and others who have sued the company claiming that his
website is the "unauthorized practice of law," while encouraging
others to file frivolous lawsuits. Apparently, the "authorized"
practice of law only involves hiding behind shell companies, not
paying FCC fines, lying about corporate associations and (oh yeah)
ignoring junk fax laws.
