legal excuses to get people off from charges of computer related
crimes, but now people are combining that with psychologists' tendency
to
call
everything an addiction. A guy in Germany who was fired from his
job for (a) running up a huge internet bill charged to his office
while (b) surfing porn at work has the guts to
claim he's an online porn addict, and as
such deserves "understanding", and not a pink slip. Now, certainly,
there are people with problems who need to understanding and therapy,
but this seems to be going too far. Why is it that no one can ever
take responsibility for their own actions any more?

companies as the case which could effectively spell out the future for
many peer-to-peer programs got under way. The Supreme Court questioned
attorneys for both the firms and Hollywood studios - and also
criticised the entertainment industry's proposal that those behind the
software "predominantly" supported by piracy should be held
liable for copyright infringement.
Record labels and film studios are facing off against Grokster and
StreamCast in the courtroom, after two federal courts ruled in favour
of P2P. They said the software should be looked at in the same way as
a VCR or a photocopier as it has legal uses - however, the labelsand
studios say the software has been built on, and is mainly used for,
illegal downloads.
Ronald Katz, a copyright attorney with Manatt, Phelps & Philips,
told
CNet: "I
think the court is going to affirm (the lower-court rulings). This
doesn't fit in with the way copyright law is written. But it's not
surprising that the law doesn't fit with something that didn't exist
at the time the law was made."
The case has already been going on for some five years, and as Neowin
previously reported, the file-sharing side has won support from
internet billionaire Mark Cuban. However, Justice Anthony Kennedy told
the firms: "What you are suggesting is unlawful expropriation of
property as a kind of start-up capital. From an economic standpoint
and legal standpoint, that sounds wrong." Many protesters turned
up to support the software firms - but some were on the other side of
the divide, with a group of musicians saying they were there to give a
human face to the cost of illegal downloading. "When we don't get
paid, we can't pay our rent," said Erin Enderlin, one of the
songwriters.

is too cool for words. Duke will be providing all incoming freshman
with their very own iPod this coming semester.
The iPods will be preloaded with content related to Duke
campus life, including freshman orientation information and the
academic calendar. What's more, a special Duke Web site modeled on
Apple's own iTunes site will offer course content for download,
including language lessons, music, recorded lectures and audio books.
Duke students will also be able to purchase music through the
site.
Getting one won't be as easy as it sounds. Have you seen the
admissions requirements for Duke? Tuition alone is $29,000. I suppose
the least they could do is throw in a $300 iPod. When I entered
college about 20 years ago they never would have given every student a
Walkman. Just goes to show how our attitudes about content
distribution are changing.

Classics a few weeks ago I felt like kicking myself. It's hard for
most people to understand what "public domain" really means, and what
value it can give us as a culture, and directly as capitalists and
entrepreneurs.
Project Gutenberg has recently
uploaded their 10,000th public domain book, and Brewster and the gang are working
on the "million book project". To demonstrate the potential of the
public domain, and show people what movies, music, and stories used to
be like when there was an active public domain (that at one time was
only 14 to 28 years old -- imagine making new movies and music from
60s stuff totally free of copyright), I've been kicking around ideas
of how to exploit these free works (again, for demonstration purposes
more than anything else).
One idea I called "judge a book by its cover." Take these public
domain classics, create exciting, artistic cover designs (perhaps by
famous designers), and sell them via the new crop of print-on-demand services. A few months ago there was
news of Oprah's book club coming back to life and only selecting
classics from the public domain, and how publishers would have to rush
to meet the demands, but how anyone could print them up.
I've been coming up with other ideas but nothing is as good as customized
classics. They just do a search-and-replace on names of your
choosing, and spit out a custom book to you for 25 bucks or so.
Brilliant and simple.
