Taking Away Intellectual Property
Protection For Those With Market Power

Taking Away Intellectual Property
Protection For Those With Market Power
01/06/2004 06:49 AM
Over at Silicon.com, someone has come up with an interesting s uggestion for adjusting intellectual property laws for software - saying that if you own more than 50% of the market, you should be forced to give away your product - and its source code - for free. The writer then makes some very good points about why forcing companies to give away their software isn't unfair - and how they should still be able to make plenty of money with such market power, even if the offering was free. I agree that companies can still make money offering software for free, but I don't think the overall suggestion is that good. If a company wants to charge for software, that's their business. Furthermore, any such "forced freeness" would lead to unintended consequences as companies and users tried to game the system. The big question, of course, is how would the markets be defined? Software companies will suddenly start redefining their markets to make them as broad as possible, to give them smaller market share numbers for the purposes of such a rule. Already, we see the opposite happening for PR purposes. Just how many software companies are the "leader" in their market - after redefining that market to make sure they're basically the only player?

MacArthur grants: study intellectual

MacArthur grants: study intellectual
property, public domain
03/13/2003 10:16 AM

The MacArthur Foundation issued two large grants for scholarly research into current intellectual property (IP) issues .

One, for $600,000, is to the American Association for the Advancement of Science ( AAAS ), in support of research into "examining intellectual property policies and their potential impact on scientific research and innovation".

"We have been looking for an appropriate balance between the interests of the public and its need for access to information, and the interests of those who produce and publish that scientific information... These grants will allow us to expand our approach so that we can address the impacts of both copyright and patenting on access to and use of scientific information."
A second grant, for $250,000, goes to the National Research Council , at the science-focused National Academies ( NAS ), to support "its efforts to promote open access to and the preservation of a public domain in scientific and technical data internationally." (The NAS has published a recent report on technology and education.)

The MacArthur Foundation has a history of, and program for supporting IP research. In July of 2002 it released four grants totalling $2.5 million, for research on the internet and intellectual property . In September of this year, the Foundation awarded one of its Fellows Grants , or "genius grants" to Cornell 's Paul Ginsparg, for his work on arXiv , an open-source scholarly archive for scientific research .

The Rockefeller Foundation launched a related initiative in November, aimed at developing new fair use policies to mitigate the digital divide .

w3compiler is a one-of-a-kind tool with performance and security offerings for Web developers working on any server platform andwith almost any Web file type. Developers use w3compiler to crunch code before it is served, reducing bandwidth costs by speeding up page loads for Web browsers. In particular, JavaScript developers find w3compiler's parser goes deeper than most tools to deliver impressive file size savings and code obfuscation. [PRWEB Aug 12, 2004]

My cattle grazing grounds are not my idea and vice versa. But thanks to laws I can "own" the idea as if the idea was a cow ; link goes to a interesting university-level paper [PDF]. The author makes some interesting analysis and points attention to the fact that current intellectual property laws can go against well established economic theories at the expense of free market competition theory, technical innovations and society-as-a-whole best interest.

Recommended to people with economic theory experience , but also to everyday public-goods-privatization opposers as the paper isn't (intentionally) way too technical.
