deer_vision.jpgNTT DoCoMo is showing off a set of binoculars equipped with object-recognition capability. The binocs identify certain objects and uses image acquisition to display pertinent details about whatever you're staring at. The examples they offer include looking at a passing plane and seeing the flight number and destination displayed in the eyepiece, or looking at a flower and having its name shown to you. This sort of technology could make its way into camera phones and the like, perhaps affording us an automatic photo-tagging system somewhere down the road.

Of course, we're happy to aimlessly pontificate about this technology since we have no idea how they actually work.

We've covered this topic many times before, but almost every article on the subject seems to ignore the real legal issues involved... until now. The question is about whether or not Google should be able to sell ads based on trademarked keywords. As we've pointed out before, trademark law isn't about giving the owner complete protection over the trademark, but rather about avoiding customer confusion. Thus, using trademarked terms in ads is only trademark violation if the ad somehow implies that the company advertising is a different company, or that it endorses the company in question. It's certainly possible that ads could constitute trademark infringement, but it depends on what the ads say. LocalTechWire is running a good overview of the real legal issues surrounding advertising on trademarked terms, noting that companies are likely to claim "initial interest confusion" -- saying, basically, that when a searcher first spots the ads, they may be confused. This may be a pretty difficult argument to make, as it's pretty easy to distinguish an ad from a search result on Google. Even more importantly, if they can somehow suggest people can't distinguish between the ad and the natural search results, they'll have to show that the ad is somehow confusing in a way that would harm their brand. This may be provable on a case-by-case basis, but it will be tough to make that claim across the board on all Google ads.

Of course, I'd hope most $900 pairs of binoculars would be.

binoculars_instrep.jpg imageSomeday someone is going to get one of these digital camera/binocular hybrids right and have a hit product on their hands, but manufacturers' continual insistance to make the camera lens seperate from the binoculars really futzes up what could otherwise be a fantastic product. Take these Bushnell Instant Replay binocs, for instance, as reviewed by KC's David Twiddy. It's not a cheapo device - Bushnell is a major binocular brand - but it still doesn't take images of what you're actually seeing through the binoculars (and has a crappy shutter speed, too, it sounds like), so no matter how many flip-up LCD screens and Compact Flash slots it has, it's still fundamentally flawed. Although it has lots of nice features, like the ability to be remotely controlled to pan and tilt, one of the most interesting is that the HNC700PT is IP-addressable, meaning you could place the camera anywhere on your network and it will operate without a computer. As if the content companies haven't already been making fools of themselves with some recent strategic decisions, things are only going to get worse. Sony is now saying that it wants to create an "iTunes for movies," saying it will "set business models, pricing models, distribution models like (Apple chief Steve) Jobs did for music, but for the film industry." First of all, that's simply not going to happen. Sony is in the content business itself -- so its competitors in the movie business probably aren't going to be thrilled about contributing to its movie store. However, even if they can set up business models, pricing models and distribution models just like iTunes, they've totally missed the point. That, alone, is not what made iTunes successful. It's the customer experience. Apple made the customer experience work. They made it easy. While some of their decisions have been less than user friendly concerning copy protection and the forced-iPod connection -- overall it's the user experience that makes iTunes work. That means, for the most part, not treating your customers like criminals. However, Sony's entertainment execs have made it clear that they already view their customers as criminals and will do everything they can to lock all their content down. Hell, just take a look at Sony's widely disparaged alread y existing iTunes clone for music to see how copying the business model isn't nearly enough.

Xeni Jardin: At a conference in Santa Monica today, Sony Pictures Digital Entertainment SVP Michael Arrieta said:
"We want to set business models, pricing models, distribution models like (Apple Computer CEO Steve) Jobs did for music, but for the film industry," [said Arrieta], "I'm trying to create the new 'anti-Napster."

To that end, Arrieta said, his group plans to digitize Sony Pictures' top 500 films and make them available for the first time in various digital environments within the next year. He said the distribution for films like "Spider-Man 2" will go beyond just Movielink, the video-on-demand joint venture of Sony Pictures and several other major studios, which to date has hosted a limited library of Sony's movies.

For example, Sony plans to sell and make films available in flash memory for mobile phones in the next year, Arrieta said. It also will further develop its digital stores for downloading and owning films on the PC, he said in an interview. Sony's plans--and similar moves by other studios--are likely to avoid empowering any one technology company--such as Apple in the music equation--and allow studios to pocket more of the profits. The philosophy in Hollywood is "Define your own agenda or someone else will for you."
