Independent Apple retailers could be assigned a trial date next month in their lawsuit filed against Apple Computer alleging unfair trade practices. Thomas Santos, president of MacAdams Computing, a San Francisco-based Apple retailer, said the trial date could be named as early as January 25, 2005, according to a report by CRN today. The lawsuit involves six independent retailers who claim Apple intentionally withheld adequate inventory from them in order to stock up Apple's own retail outlets and online store. The lawsuit also charges Apple with underpricing its retail partners, denying warranty claims made by certain retailers and poaching customers from retailers, said Santos.

Rumor site AppleInsider got hit with a lawsuit Wednesday, in the wake of two articles leaking information on what is to be release d in the Macworld Expo next week.

The suit, filed Tuesday in the Superior Court of Santa Clara County, Calif., aims to identify who is leaking the information and to get an injunction preventing further release of trade secrets. However, in filing the suit, Apple identifies specific articles that contain trade secrets, indicating that at least parts of those reports are on the mark.

Two ways to look at this, I guess; one, that the rumors reported on AI are dead on, and Apple is wanting to keep its secrets secret. Or two, (thanks to a Gadgetopia reader/poster) is that the rumors are not true, but Apple is trying to keep the rumors from raising the public's expectations for upcoming releases, which ends up hurting Apple's stock prices.

Me? I think that Apple has some hot stuff planned for the Expo, and the headless iMac is part of it. Why else would they announce a newer/faster/no-more-expensive Xserve the week before?

I sure wouldn't want to be the guy at Apple leaking this stuff. And maybe I'll think a little harder about posting the next Apple rumor I hear about.

Austin, Texas-based Forgent Networks announced late Thursday that its Compression Labs Inc. subsidiary has filed suit against 31 companies for patent infringement -- among them, Apple. Compression Labs alleges that these companies have infringed its U.S. Patent No. 4,698,672. The patent describes a "coding system for reducing redundancy" that Forgent says is integral in JPEG image compression.

The French news agency Agence France-Presse (AFP) has filed a lawsuit in the District Court of the US District of Columbia against the search engine operator Google. The object of the agency's lawsuit is to stop Google from borrowing without permission headlines, texts and pictures from the agency for its news pages Google News. AFP is suing for what amount to 13.2 million euros in damages. The agency is claiming to have asked Google repeatedly to remove the content in question, with the company having failed to react to the requests, however.

Online journalists who published trade secrets about Apple back in December filed an appeal Tuesday arguing that the ruling violated the First Amendment and that Apple should first subpoena its employees or use computer forensics to determine the sources of the leak. Apple filed a civil complaint against unnamed individuals who allegedly stole trade secrets and posted detailed information about an unannounced Apple product last December, and on March 11, a California judge ruled that Apple has the right to subpoena the records of the three Macintosh sites that published details on an unreleased Apple product. "The California courts have a long history of supporting and protecting the freedom of the press," attorney Kurt Opsahl said representing the journalists. "The Court of Appeal will now get the opportunity to correct a ruling that endangers all journalists."

Apple Computer investors cannot sue the company over the fact that the Power Mac G4 Cube and other products didn't live up to Apple’s sales expectations, according to a federal appeals court ruling this week. CNET News is reporting that the appeals court also said allegations that Apple knew some of its sales projections were false at the time they made them was not supported by the facts presented in the case. The attempted class action suit was filed on behalf of those who purchased Apple shares between July 19 and Sept. 28 of 2000. A California judge on Friday ruled that Apple has the right to subpoena the records of the three Macintosh sites that recently published details on an unreleased Apple product. Apple filed a civil complaint against unnamed individuals who allegedly stole trade secrets and posted detailed information about an unannounced Apple product last December. "Apple's DNA is innovation and the protection of our trade secrets is crucial to our success," the company said in a statement in December. Santa Clara County Superior Court Judge James P. Kleinberg ruled that Apple's interests in protecting trade secrets outweighed any interest the public may have in the information, according to CNET. "The public has had, and continues to have, a profound interest in gossip about Apple," Kleinberg said. "Therefore, it is not surprising that hundreds of thousands of 'hits' on a Web site about Apple have and will happen. But an interested public is not the same as the public interest."

Apple Computer Inc. is suing anonymous people who leaked details about new products by posting information on the Internet, Reuters is reporting today. According to Reuters, Apple said in the seven-page civil complaint which it filed on December 13 that it did not know the "true names or capacities, whether individual, associate, corporate or otherwise," of the defendants. Once they have been discovered, the Cupertino, California-based company said it would amend the complaint. The complaint alleges that “an unidentified individual, acting alone or in concert with others, has recently misappropriated and disseminated through Web sites confidential information about an unreleased Apple product. To succeed, Apple must develop innovative products and bring those products to market in advance of its competitors. If Apple competitors were aware of Apple's future production information, those competitors could benefit economically from that knowledge by directing their product development or marketing to frustrate Apple's plans.” "Apple has filed a civil complaint against unnamed individuals who we believe stole our trade secrets and posted detailed information about an unannounced Apple product on the Internet," the company said in a statement provided to Reuters.
