It's been brewing for years, but Wi-LAN of Canada finally sues a big player: Wi-LAN has alleged for years that it holds patents that cover a variety of issues to do with OFDM (Orthogonal Frequency Division Multiplexing), the modulation scheme used for 802.11a and g, among other standards. In fact, at the first 802.11 Planet conference, representatives of Intersil and Texas Instruments traded barbs over the inclusion of OFDM in 802.11g with TI suggesting patent issues could muddy the water. Its own abandoned PBCC (Packet Binary Convolution Code) has an entirely different approach. Wi-LAN is going after Cisco, and ostensibly hopes that if it can either win in court or get Cisco to settle that it has a basis for collecting royalties from the entire industry. Wi-LAN could collect vast amounts of money, but they are probably poised to offer reasonable terms. Most patent holders want to ensure strong royalties by not encouraging an ultimate migration from their covered rights. If they lose in court, it's unlikely to cause a ripple....

Cory Doctorow: Richard Stallman, creator of the Free Software movement, has written a tremendous essay for the Guardian on the risks of software patents. Richard undertakes a gedankenexperiment about "literary patents" and the impact they would have had on Victor Hugo as he sat down to pen Les Miserables.
Now consider this hypothetical literary patent: Claim 1: a communication process that represents, in the mind of a reader, the concept of a character who has been in jail for a long time and subsequently changes his name...

These patents would all cover the story of one character in a novel. They overlap, but they do not precisely duplicate each other, so they could all be valid simultaneously - all the patent holders could have sued Victor Hugo. Any one of them could have prohibited publication of Les Misérables.

You might think these ideas are so simple that no patent office would have issued them. We programmers are often amazed by the simplicity of the ideas that real software patents cover - for instance, the European Patent Office has issued a patent on the progress bar, and one on accepting payment via credit cards. These would be laughable if they were not so dangerous.

sendo02.jpg imageOur friends at AllAboutSymbian have their review of the late to the game Sendo X, calling it the most desirable Series 60 handset in the world -- this despite the fact that the Sendo X is a Series 60 1.2 phone, and not a 2.0 model. One of its strong suits, they say, is that it looks like a phone, and not an "escapee from the Concept Labs," although the 5-way joypad still leaves something to be desired (it's too easy to hit the wrong button). Another interesting bit is an integrated white LED "flash" that can be used to illuminate a scene without the sucking down the battery like a traditional flash would. All around it looks like an extremely well thought-out phone, and AllAboutSymbian gives it a well thought-out review.

Mobile device maker, Sendo, have agreed an out of court settlement with industry giant, Microsoft. The specifics of the agreement have not been disclosed, yet is purported to be around the hundreds of millions mark. Sendo are "extremely pleased with the terms".

The dispute arose over a partnership between the two companies. Sendo helped Microsoft into the mobile phone market, where it lacked expertise. After developing software with Sendo, supposedly Microsoft illegally gave information learned from Sendo to low cost OEM's in Asia. The two companies broke up 2 weeks before product launch, and Sendo sued Microsoft soon after.

Microsoft have long accepted lawsuits as part of its business model, and the payout might register as a blip on this years profit levels. Sendo intend to move onto to new products and technologies, and undoubtedly now have a good financial base to do this.

The pair had been working together to develop the Sendo Z100 smartphone running Microsoft's Windows operating system for smartphones. Richard C. Jaworski announces that the US Patent Office has granted his “Petition to Make Special” on his System of Testing the Upstream Cable Modem Channel (TUCMC) patent application. The petition to the US Patent Office alleged infringement of his technology by Acterna Corporation in their DSAM 2500 Cable Modem Test Instrument. Mr. Jaworski has written evidence that Acterna knew of the patent and the technology prior to releasing the feature in the DSAM 2500. I've complained in the past about the annoyanc e of Plaxo spam. Lately, the more I've been thinking about Plaxo, the more it annoys me. Though I've never had anything to do with the company, and have never responded to a single spam, they now have a database with my contact info that others gave it. Bambi Francisco over at CBS Marketwatch has noticed the same thing with Spoke Software, which she finds disconcerting. However, I'm wondering about the bigger legal issues: is the personal info you've given to individuals for business or personal reasons shareable? Some say that all Spoke is doing is collecting public information. However, if the info was given to an individual, is there a reasonable expectation that the information is not public at all, but for private use only? I'm not sure what the answer is, but I wonder how long until there's a lawsuit around this issue. Personally, like so many other things, I don't think it's something you can get "back in the box," but these systems do reveal to me who is freely giving away personal information about me, which could make me less willing to do business with them in the future.
