Google Loses Second French Trademark
Lawsuit
02/05/2005 09:48 PMComing just weeks after a French court
seemed
to misunderstand the purpose of trademarks a second French court
has ruled that
Google cannot
sell ads based on trademarked keywords. This time, the case was
brought by Louis Vuitton Malletier. Here, the argument appears to
make a bit more sense on its face, as it wasn't competitors that LVM
was worried about, but counterfeiters selling products to people who
searched on the Louis Vuitton name. Except... that's wrong. Louis
Vuitton Malletier should be going after the counterfeiters, not
Google. The counterfeiters are the ones who are breaking trademark
law by advertising products that aren't actually Louis Vuitton. So,
why is Google involved at all? They're just offering the platform by
which these ads are placed and shouldn't be responsible at all for the
content of those ads. Furthermore, as long as the ads aren't
confusing buyers about the nature of the products, then there's no
reason for it to be trademark infringement. It's just in cases where
there is confusion -- and then it's the company doing the confusing
that should be taken to court.

European counter to Google
03/19/2005 02:55 AM
The head librarian of the Bibliothèque nationale de France has
called for a European digitization project to counter or balance
Google. Jean-Noël Jeanneney critized Google for cultural bias :
the criteria of choice will be
heavily influenced -- even if we contribute
ourselves, uncomplainingly, to the riches of
this project -- by a point of view which is
Anglo-Saxon, with its specific approach to the
diversities of human civilization.

Justin falls in love
09/06/2004 03:35 AMBack when I still thbought the web was a silly thing (mainly 'cause
HTML really sucks), one of the few moments of Ah Hah
came from Cyborganic and a young guy named Justin Hall - who
not only came out on the web, but squirted that effervescent stream of
life - now known as blogging - more eloquently than a herd of elephant
chanting Rasta Fari.
Or shall I say - as a moonbeam wraps her light across the face of
my love - after sex?
Or maybe it's - the drunken paramours on the Il de Cite - in front
of Baudelaire's Hashish Club - dancing naked, swirling dervishes
surrounded by Moorish heads of captured Turks?
Justin defined for me - what it was like to live your life - as a
book.
So now - he's gona back to school and.....
And she returns my calls!
I met a gal who makes me want to floss. Just getting out of the house
or trading casual touches by telephone. Some thing is happening, an
embrocating exercise regimen for a tired heart. Unwitting smiles.
Some moments life seems dimmed without. Other moments I gladly
doubletime to finish my duties before she calls and I rush off for a
few more hours in suspended smiling animation
time changes, the sky opens, the years beyond now shift into
rose-focus, my manhood considered, a new set of smells. senses, other
then words.
I'm still behind, in school, in work, my home, in laundry.
