You may remember Orrin Hatch from such backwards thinking proposals as destr oying computers of any copyright violator or telli ng the FBI they should work on civil copyright cases or (most recently) his plan to make the iPod illegal with his INDUCE Act (though, he eventually agreed to exceptions for the iPods, plenty of other technologies would become illegal overnight). He's also the guy who tried to defend the INDUCE Act by admitting it might not be a good idea, but he that's fine as long as he does something. Yes, he believes in legislating for the sake of legislating even when it might make things worse. Well, it now turns out that good old Senator Hatch has been put in charge of the Senate panel that writes copyright laws. In other words, we should have another couple years of silliness in copyright laws coming out of the Senate.

It seems that Orrin Hatch is involved in just about every bizarre anti-consumer, pro-Hollywood piece of legislation these days. Just days after introducing his absolute ly ridiculous and dangerous INDUCE act, Hatch's PIRATE Act has passed the Senate without debate and via a voice vote, so there's no record of which of your Senators just agreed to take your tax money to fight Hollywood's battles. If you don't remember, the PIRATE Act would let the FBI work on civil cases against copyright infringers. In other words, cases that should be between two private parties, will now be handled by the federal government, using your tax money. There's simply no justification for this, other than some Senators wanting to pay back their entertainment industry backers by doing their legal work for them -- using your money.

The good Senator Orrin Hatch from Utah is sponsoring a bill that could make possibly any piece of technology (at least the tech that people actually want) illegal. The bill states that if you make or provide a product that 'induces' somebody to infringe on another's copyright you could be held liable.

Since the merits of this bill are being discussed elsewhere, I won't go into all that. I would however find it amusing and slightly ironic if somebody were to seed a bittorrent file of Orrin Hatch's latest musical offering Orrin Hatch's Christmas Eve (iTMS link) so the world could hear what it is Mr. Hatch is trying to protect. Just a thought.

Cory Doctorow: Loony old Orrin Hatch has been named the head of the new Senate subcommittee on Intellectual Property -- I guess that Genghis Kahn wasn't available to fill the position.

Sen. Orrin Hatch (R-Utah), once nicknamed "Terminator" for his 2003 comment that the recording industry should be allowed to remotely destroy the computers of file-sharers, was named today to head a new Senate subcommittee on intellectual property. While Hatch backed down slightly from that comment the next day, saying, "I do not favor extreme remedies -- unless no moderate remedies can be found," he has remained a staunch ally of the entertainment industry.

With Orrin Hatch's nation-destroying INCITE Act headed for law, EFF has decided to create a real example of just what kind of "piracy" Hatch is targetting. Here's EFF's hypothetical complaint against Apple (for making the iPod) C|Net (for reviewing the iPod), and Toshiba (for supplying hard drives for iPods). All three of these activities fall within the scope of activity that Hatch's bill seeks to end:

As detailed further in Professor Expert’s report, the iPod would have been much less attractive to consumers had it been incompatible with the music files downloaded from P2P networks and had it not allowed consumer-to-consumer transfers. Professor Expert’s report also makes it clear that the iPod, in turn, enhanced the attractiveness of P2P networks by offering iPod owners expansive storage capability and lightning-fast data transfer, allowing them to listen to any number of infringing music files when away from the computer.

Surveys conducted by Professor Expert establish that a majority of iPod owners have used at least some significant portion of their iPods to store and play infringing music files, whether derived from P2P networks or promiscuous hand-to-hand copying. Upon information and belief, Apple was certainly aware of this fact from its own internal marketing research.

The Inducing of Copyright Infringement Act of 2004, or INDUCE , a recently proposed Senate bill, would enable lawsuits against manufacturers of software which support or invite copyright infringement. The law would combine intellectual property redress with an eye towards punishing solication of minors.

Orrin Hatch (R-Utah) explained his proposal:

it is illegal and immoral to induce or encourage children to commit crimes. Artists realize that adults who corrupt or exploit the innocence of children are the worst type of villains. In Oliver Twist, Fagin and Bill Sikes profited by inducing children to steal. In the film Chitty-Chitty Bang-Bang, the leering “Child-Catcher” lured children into danger with false promises of “free lollipops.” Tragically, some corporations now seem to think that they can legally profit by inducing children to steal – that they can legally lure children and others with false promises of “free music.”

Critics argue that the bill undoes the technology protections established by the US Supreme Court in 1984, when it ruled that the VCR, while allowing some infringement, was not entirely a machine of copyright violation and hence could not be sued. Moreover, other INDUCE opponents believe that the law could be applied to a great variety of technology and innovation , including portable music players . Defenders argue that digital networks are qualitatively different from the 1980s VCR, and that peer-to-peer trading, the bill's primary target , is overwhelming about copyright infringement.
