01/16/2004 01:03 PMWhen I was an undergraduate, I spent a lot of time studying
negotiations and bargaining situations - often in situations where
there was little to no trust between the parties. The end results of
such negotiations
always turned out to be much better when they
opened up and weren't done in a "us vs. them" or top down manner.
However, it was
very difficult to get over the hurdle of the
"we're telling you how it is!" thought process to the "let's lay
everything out on the table" process. Such a lesson doesn't apply
only to direct bargaining situations, but almost any type of
transaction between multiple parties. The more open the process is,
the more likely everyone can come to a resolution that makes people
happy. This is starting to show up in many aspects of our lives, and
even the folks over at Fortune have noticed the
trend in our society to move to a "bottom up" world
where participation and openness are expected and encouraged - rather
than the top down method of someone making a final decision on how
things will work. Now, whether it's the media we consume, the
software we use, the products we buy, and (apparently) the candidates
we elect, people are recognizing the power of the bottom up approach.

reduci
ng the range for their IPO last night, Google finally got the nod
from the SEC, and
priced tonight at $85
-- the bottom of the reduced range, suggesting just that interest
in the IPO was quite weak. Perhaps that's because it was
so
complicated that many investors couldn't get in on the process.
If that's the case, then many investors who couldn't get in on the IPO
may try to buy in tomorrow, pushing the stock up. However, if a lot
of original investors are just there to flip, there will be downward
pressure as well. The shares will begin trading tomorrow, and expect
plenty of commentary on which direction the price actually heads.

This web page returns the ten most reputable eBay members and the ten
least reputable ones. When I checked the page, it listed
mario23g (with a feedback rating of -26) as the least
reputable person on all of eBay, but I checked his page and it looks
like he is no longer registered. The second worst,
grannyvon10 (score of -19) earned her negative
whuffie from a seller who says she didn't pay for 118 dolls she
purchased. The third worst eBay member on Earth, according to this
page, is
jammin-garage (score -17), who has earned a
bunch of complaints from people who say they've paid for stuff he
failed to send them.

"Consumers who subscribed to a music service such as RealNetworks'
Rhapsody purchased an average of 11 CDs last year. Those who used
legal music downloading sites such as Apple Computer's iTunes bought
approximately 10 CDs, according to the report. Those who used
peer-to-peer file-sharing sites averaged eight CDs, whereas those who
did none of these bought an average of six CDs.
"Our research shows that it's the people who are really into music
that are beginning to adopt paid digital services as an additional way
of acquiring and enjoying music, and so far, these services are living
side by side with traditional CDs," Russ Crupnick, president of NPD
MusicWatch, said in a statement. 'As the industry matures, and digital
music becomes even more mainstream, it remains to be seen just how
much paid digital music will affect the market for CDs.' " [CNET News.com]
It would be interesting to see if those numbers went up if library
patrons could listen to digital music online at home for free using
their library card for authentication. Would they then spend even more
money on CDs or purchasing tracks because they were able to hear them
legally in their entirety first?
Conversely, it would be interesting to do a study of library
patrons who borrow CDs from libraries to see if they end up purchasing
more music than those that don't. Perhaps the music industry should be
working more closely with libraries as listening outlets.
