05/20/2004 11:41 PMJulian Haight, the founder of anti-spam service SpamCop, and Scott
Richter, the founder of spamming service OptInRealBig, are currently
in the middle of a fairly nasty
legal
battle over whether or not SpamCop can block OptIn's spam. Still,
the two have
agreed to appear together in public and debate the topic.
Both of their lawyers say that the debate will avoid the issue of the
lawsuit, but as the article points out, that seems unlikely. The
thing is, in listening to what both sides have said over the years,
you already know what they're going to say in this debate - and
they're talking at cross purposes. The spammers focus on their right
to make money, while everyone else talks about their right to be left
alone. The problem with the spammers' position is that they
don't have the right to make money. They have the right to
try to make money, but if it involves pissing everyone off, and
everyone decides to create and use filters to make email bearable
again - then that's their right too.

07/19/2004 08:09 PMConsidered one of the top spammers worldwide, Scott Richter and his
OptInRealBig spamming operation have been officially
slapped on the wrist by New York State AG Eliot Spitzer. NY
(and Microsoft) made a
big
deal of suing Richter last year, but the end result is a measly
$40,000 fine (plus $100,000 in "investigative costs") as part of a
settlement. This is just a bit lower than the $20 million fine
Spitzer threatened Richter with when the case was announced. As with
all of these types of settlements the company "admits no wrongdoing."
The only other "concession" that Spitzer got out of Richter was a
promise to send a copy of every spam message he sends to Spitzer's
office. Yes, for a small fine, it looks like Richter gets to add
Eliot Spitzer's email address to his spam lists. Richter's lawyer
(who also happens to be his father) suggests that the settlement was
so low because the state had no case. They were particularly annoyed
by the fact that OptIn was referred to as a "deceptive spammer" when
the truth of the matter is that it's a very very obvious spammer.

his company "OptInRealBig." Richter has received plenty of coverage
over the years for such stunts as
suing
SpamCop for "damaging his reputation". He was also one of the
major characters in Brian McWilliam's fascinating

i>Spam Kings book -- which gives you the impression that
Richter really likes the idea of becoming a legitimate, non-spamming
email marketer, but can't seem to stick to it. Richter also got off
extre
mely lightly last year in the case which NY State filed against
him with
great
fanfare. While he got away with just a slap on the wrist in that
case, both Richter and OptInRealBig are now
declaring bankruptcy. Of course, don't get too excited just
yet. The company claims that it's doing just fine and is actually
growing. The point of declaring bankruptcy is just to consolidate all
the other lawsuits that have been filed against the company (including
a $40 million suit from Microsoft) -- and to reorganize the business
to keep on churning out those emails.

Employees working at the agency reported that they received unwanted
pornographic and racist emails from a manager. They've hired some

fairly extensive
interview with PC World where he claims, among other things
that he's not a spammer, that he's making "the Internet a better place
with e-mail marketing," and that he may start selling an anti-spam
filter. It's funny because he continues to insist that he's not a
spammer, but talks about how, without him, all those anti-spam
companies would be out of business -- so they need him the way doctors
need tobacco companies to keep people smoking.

the linchpin of a spam gang.
The software maker's legal complaint was lodged against an unnamed
company in the North Rhine-Westphalia region of Germany and its
managing director, according to a statement (
in German)
on the Microsoft Germany Web site. Microsoft alleges that the company
sent out millions of spam e-mail messages advertising Web site design
services, online casinos and pornography.
