Coming just weeks after a French court seemed to misunderstand the purpose of trademarks a second French court has ruled that Google cannot sell ads based on trademarked keywords. This time, the case was brought by Louis Vuitton Malletier. Here, the argument appears to make a bit more sense on its face, as it wasn't competitors that LVM was worried about, but counterfeiters selling products to people who searched on the Louis Vuitton name. Except... that's wrong. Louis Vuitton Malletier should be going after the counterfeiters, not Google. The counterfeiters are the ones who are breaking trademark law by advertising products that aren't actually Louis Vuitton. So, why is Google involved at all? They're just offering the platform by which these ads are placed and shouldn't be responsible at all for the content of those ads. Furthermore, as long as the ads aren't confusing buyers about the nature of the products, then there's no reason for it to be trademark infringement. It's just in cases where there is confusion -- and then it's the company doing the confusing that should be taken to court.

Google keeps running into lawsuits concerning companies who buy advertisements based on the names or trademarks of their competitors. We've already explained why should be perfectly legal under trademark law (which doesn't prevent all use of a trademarked term - just any use that is seen to be confusing people into believing one company is another company). However, this NewMediaZero piece points out that, even if it is a trademark violation, it makes no sense to go after Google, who is simply the publisher. If they must go after someone, the complaining companies should go after those who they are accusing of misusing their trademarks: the competitors buying the ads. Of course, what this article leaves out is that the complaining companies are upset that Google appears to be profiting off of their trademark by selling the ads. I wonder what would happen if Google set up a "compromise" position where a portion of the money that an advertiser paid for advertising on a trademarked keyword went to the trademark owner?

Taiwan Authorities Suspend Workshop Dealing with Fake AMD Chips. Local authorities on Friday suspended a workshop that made fake, or remarked, AMD microprocessors in Taipei, Taiwan, and seized unprecedented number of chips of nearly one million units.

A report over Sin Chew Daily web-site claims the local police had discovered a workshop that remarked microprocessors made by Advanced Micro Devices to sell them at higher price-points. It is unclear, which chips have been attempted to counterfeit and whether the chips were also somehow modified. Source for the processors the swindlers used is also unknown. At least one man is reported to have been arrested and accused of illegal handicraft.

There were a bunch of stories recently about exploding mobile phones, and after investigating the issue, one of two reasons always turned up: either it wasn't really an "explosion" but a "graphite discharge" or counterfeit batteries that weren't up to snuff safety-wise were what caused the explosion. Nokia has taken the stance of using these cases to warn people not to use counterfeit batteries, but NEC has gone a step further and created a system that will block fake batteries from mobile phones. While the safety argument makes sense, this is somewhat similar to efforts by printer makers to create encryption systems that block knockoff ink cartridges, and it makes you wonder if some of the incentive to do this is to keep competitors from being able to enter the market.

It looks like it's going to be quite a while before companies realize that suing the service provider for something someone did on their service is a dead end. The latest is that jeweler Tiffany is suing eBay because users sold fake Tiffany items. Tiffany should be going after those who sold fake items, since they're the ones who have actually done something wrong, but apparently that's too difficult, and those people are unlikely to have very much money. So, instead, they just sue eBay -- even though the company has done nothing wrong themselves.
