threate
ning completely innocent people, but now they're getting even
worse. According to
Broadband
Reports among the people sued in the latest batch of lawsuits from
the RIAA
was an 83-year-old
woman who is now deceased. Even when she was alive she never
owned a computer, let alone had the username "smittenedkitten," or
shared over 700 songs online. The RIAA responds, oh so politely, by
saying they'll now dismiss the case. However, that's not the real
issue. All of these examples show that the RIAA doesn't really know
who's doing what -- and yet they're filing tons of indiscriminate
lawsuits. Every time a screwup like this happens, they apologize and
remove the lawsuit, but shouldn't they be punished for filing
frivolous lawsuits? It's clear that they really don't have the right
tools to be able to tell who actually committed a crime. A smart
lawyer should use these cases to show that the industry has no real
evidence that any of these lawsuits are valid.

their
case against the RIAA is somehow different from the Verizon case
which
the
RIAA won, they're now going to have to
convince the same
court that their case really is different. Originally, the case
was scheduled to be heard in California, which meant they weren't
bound to the original Verizon ruling in Washington DC. However, the
RIAA requested that the case be moved to DC, and the California court
complied. This makes it much more difficult for SBC, who has to prove
that the reasons they believe the RIAA has violated their customers'
privacy is somehow different than the similar claims Verizon made last
year.

EFF's helped win another victory this week! We filed a brief in RIAA
vs Charter, a case where the music industry was asserting the legal
right to require your ISP to turn over your information if you'd been
accused of copyright infringement -- rather than waiting until they'd
proven their case. The court ruled in Charter's favor yesterday,
saying that just because you've been accused of infringement, it
doesn't mean that you shouldn't have the due process right to privacy
until you've been proven guilty.
The Electronic Frontier Foundation (EFF), along with 21 other groups,
including the American Civil Liberties Union (ACLU), the Consumer
Federation of America (CFA), and the Computer & Communications
Industry Association (CCIA), filed a "friend of the court" brief in
the Charter case, urging the Eighth Circuit to determine that the same
strong protections applied to anonymous speech in other contexts also
apply when copyright infringement is claimed but has not yet been
proven. In a victory for privacy and anonymity, the Eighth Circuit
determined that DMCA subpoenas could not be used to get this
information.
