searching are two different modes of web surfing, and people will

reat ads differently in each situation. Some pointed this out
quit
e a while ago, but thanks to Google and Overture promoting
contextually matched ads as somehow being just like search ads, many
advertisers expected similar results -- which they're not getting at
all. So, now, some advertisers seem to be fighting back and are
telling Google and Overture that it's about time they separated out
the two forms of advertising and let the advertisers work each
campaign separately. It appears that Overture has started to move in
this direction, but Google continues to insist that there's no reason
to treat the ads differently.

12/02/2003 11:28 PMSeeing just how bad email spam has become, a group of marketers have
come together to
agree to a "code
of conduct" to prevent mobile spam. With the recent laws against
telemarketing and email spam, they're realizing that if they let
things get out of control, they'll be next. The code includes
(amazingly!) that marketers will only send mobile messages to those
who opt-in (unlike the current email law), and promise to provide easy
opt-out instructions. Finally (and why they had to put this in shows
just how out of touch many marketers are with their job function) they
promise that any mobile marketing message will "deliver something of
value" to the customer - and not just be blatant pitches all the time.
It's a good start, but I'm still cynical enough to wonder whether or
not those who agreed to it will really abide by it, and whether or not
it will really matter as traditional spammers increasingly send
messages to phones themselves. It's easy for marketers to say they'll
live by this sort of rule, but as soon as someone breaks the code of
conduct, and there's no real punishment, someone else will feel that
they need to break it too ("just to stay competitive"). Meanwhile,
traditional spammers couldn't care any less about what some marketing
group agrees to, and will continue to send annoying spam messages any
way they possibly can.

In a BoingBoing post last week, one reader wondered if political
motivations may have caused T-Mobile's reported "blocking" of messages
from activist messaging service TxTMOB.
BoingBoing reader Gabe replies:
"I'm a network data analyst for T-Mobile. I've actually
tested the network to see why those messages were blocked, and from
the response our email-to-sms gateway is giving, apparently our
immensely retarded spam filter thinks that txtmob's SMTP server is
spamming us. Basically, if the network sees more than about a hundred
messages coming from the same SMTP server within an hour, it just
blacklists it. Stupid but true."

When I attended some of the RNC protests on Tuesday (

invaluable for staying safe and developing effective protest
strategies and tactics.
Right around 5:30 or 6, just as things started to heat up around me, I
stopped getting SMS, just like that. I thought it was rather
suspicious, but was willing to concede that it could be some
technology malfunction. There were more SMSes going out than usual,
for the region, and I thought maybe it was an overload. It blew any
opportunities I had to effectively co-ordinate with the legal, and
civil, RNC protests. So now, as it turns out -- say the txtmob people
-- it wasn't technology, it was T-Mobile (my now ex-carrier).
Highlighted text below, from the txtmob dispatch: "T-Mobile blocked
TXTmob messages during a portion of the RNC. "
My only question is, WTF? Since when does T-Mobile decide which
messages are ok, and which aren't? What, in my contract with them,
specifies that they can decide which messages I am allowed to get? Who
told who to block which messages? I'm no lawyer, but those seem like
the kinds of questions that lawyers are interested in.
Following text snipped from a TxTMOB update to subscribers with
Subject: TxTMob UPDATE: Post RNC, issued September 3:
Finally, a note for T-Mobile customers: As many of you are aware,
T-Mobile blocked TXTmob messages during a portion of the RNC. While we
won't speculate on the reasons for this action, it would be extremely
helpful if the hundreds of customers who were unable to receive TXTMob
messages called T-Mobile to complain. Be sure to explain that TXTMob
is an opt-in service that you have chosen to join, and to encourage
their representatives to contact admin@txtmob.com if they have any
questions.
