Real and France's Virgin claim that they deserve to be able to sell their music on Apple's iPod. To prove they're serious, Virgin Mega has filed a complaint against Apple to do so. Perhaps I'm missing something here, but last I checked it wasn't anybody's responsibility to open up their product or service to purposely allow the competition in. That is, of course, unless the government steps in. Are Real and Virgin Mega just being whiny little brats, angered that they're not invited to the party? What are legitimate reasons for the legal system to get involved and to rule in favor of such plaintiffs? While the obvious Microsoft may come to mind, are there other examples you can think of? As for me, I'd like to hand out copies of "Atlas Shrugged" and "The Fountainhead" to both Real and Virgin Mega...

Well, this should be interesting. An "unhappy" iTunes user is now suing Apple for antitrust violations, claiming that they broke antitrust laws by only allowing their music to play on iPods -- blocking out other music players from the market. It's unlikely that he'll win the lawsuit, and honestly, it sounds more like a setup by an Apple competitor than just some individual who feels wronged. The guy in question says he was "forced" to buy an iPod in order to make use of the music he bought on iTunes, but the courts will likely point out that he could have gone to a competing online music store. Of course, what this really highlights is how some of these copy protection issues are building fragmented worlds. How would people react if the CDs they bought at Tower Records could only play on Tower-branded radios? Thanks to the way the industry views intellectual property online, the end result is a lot of competing separate worlds, which actively discourages use.

Apple is offering consumers who had battery problems with older versions of the popular iPod digital music player $50 vouchers and extended service warranties under a tentative settlement in a class-action lawsuit. According to AP, lawyers representing consumers in the state court case said that the settlement could affect as many as 2 million people nationwide who purchased first-, second- and third-generation iPods through May 2004. Apple confirmed the settlement but has not officially commented. The settlement comes after eight consumers filed a suit in 2003, alleging that the iPod failed to live up to claims that the rechargeable battery would last the product's lifetime and play music continuously for up to 10 hours. According to the terms of the settlement, people who fill out a claim form are entitled to receive $50 redeemable toward the purchase of any Apple products or services except iTunes downloads or iTunes gift certificates. Consumers will be notified of the tentative settlement in three ways: by e-mail, by letters, and through advertisements in USA Today and Parade Magazine in the next month, said Elizabeth C. Pritzker, an attorney at Burlingame-based law firm Cotchett, Pitre, Simon & McCarthy LLP, which represented two plaintiffs. Apple has agreed to pay up to $2.8 million to the two law firms that represented consumers.
