their version of the DMCA to see if people have the right to
modify hardware they've bought or to make backup copies of digital
media they purchased. In the old, pre-digital world, when you bought
a product, it was yours to do whatever you wanted with it. However,
thanks to recent law changes, any product that involves a digital
component seems much closer to a rental agreement, where the company
that "sold" you the product retains some sort of rights. For obvious
reasons, many people think this is unfair. In this particular case,
Sony went after a mod-chip trader, claiming that the mod-chips he
offered for the Playstation violated copyright law by letting users
play copied games, thereby violating anti-circumvention rules in
Australian law. It really becomes a question of whether or not
certain companies have the right to have their business models
protected by regulations, rather than forcing them to keep up with the
changing marketplace.

( CTEA ). The CTEA extended the lifetime of copyrights to
95 years past the moment of publication. According to the
majority opinion in the 7-2 ruling, Congress acted within
Constitutional bounds five years ago, when it added to
preexisting terms for copyright
ownership. Dissents from Justices
Breyer and
Stevens argued that the law's practical effects were deleterious
to public culture.
The decision represents the end of one battle in the copyright
struggles. It stands as a victory for several intellectual property
(IP) holders' groups, such as the
RIAA and MPAA , perhaps
signalling an era of
effectively perpetual copyright . It's a defeat for litigants and
supporters like Web publisher of public domain works Tim Eldred , and Stanford cyberlaw professor Lawrence Lessig .
For students and educators, the fallout is complex, although the
decision changes no law. As consumers of intellectual property, we

The United States Supreme Court agreed to
consider a high profile case involving the internet and copyright
infringement. The question, which has been subject to numerous lower
court rulings, concerns whether or not the creators of peer-to-peer
software can be held liable for users' copyright infrigement. The
companies cite the 1984 " Betamax case ," which immunized VCR makers from copyright
charges. The intellectual property holder side of the case charges
the software companies with knowing full well the uses to which their
applications have been put.
Metro-Goldwyn-Mayer Studios v. Grokster Ltd
involves a large group of players:
The large group of plaintiffs includes the Motion Picture Association
of America, the Recording Industry Association of America, Warner
Brothers Entertainment Inc. and a class of 27,000 music publishers and
songwriters. The Supreme Court will hear the case in March and is
expected to decide it by late June.

Supreme Court of the United States is scheduled to hear arguments
this week in a high profile digital copyright case. In MGM Studios v. Grokster
a group of movie studios sued Grokster , a popular peer-to-peer
file-trading program, arguing that the software enabled enormous
infringements of the studios' intellectual property . Last year a federal circuit court ruled in favor
of Grokster; the case has proceeded on appeal.
Supporters of Grokster, such as
Electronic Frontier Foundation , argue that such
file-sharing tools should be considered in the light of the 1984 "Betamax case" ,
where the Supreme Court ruled that users, not devices, should be held
liable for copyright offenses. Other defenders, such as The Economist , believe that a
ruling against Grokster could stifle innovation . Allies of MGM argue that
file-sharing applications, unlike VCRs, are primarily about copyright
