Dead Marine's kin plead for e-mail: The family of a soldier killed in Iraq wants access to his email account. Yahoo! has said no.

"I want to be able to remember him in his words. I know he thought he was doing what he needed to do. I want to have that for the future," said John Ellsworth, Justin's father. "It's the last thing I have of my son."

But without the account's password, the request has been repeatedly denied. In addition, Yahoo! policy calls for erasing all accounts that are inactive for 90 days. Yahoo! also maintains that all users agree at sign-up that rights to a member's ID or contents within an account terminate upon death.

I'm sure they don't want to set a precedent. If they allowed they'd open themselves up to a ton of problems. Still, couldn't some at Yahoo! just accidentally send the password to the family? You know, an honest mistake and all.

Yahoo! continued Wednesday to refuse e-mail access to a Michigan father of a Marine killed in Iraq early last month. The family of Justin Ellsworth, 20, is trying to gain access to the e-mail before the Yahoo! account is erased at the end of next month due to the comapny's policy of deactivating unused accounts after 90 days.

Benjamin Cohen, former owner of the iTunes.co.uk domain name, will be taking Apple to the High Court to try and overturn a ruling from a domain registry that stated the domain name should be transferred to Apple. Apple issued proceedings against Cohen in December through the UK internet registry Nominet, claiming ownership of the domain should be transferred to Apple because it holds the iTunes trademark. The company won a legal battle against Cohen earlier in March as Nominet claimed that he had made an "abusive registration" and ruled that the domain name should be transferred to Apple. Cohen will be applying to the High Court on Tuesday or Wednesday for a judicial review. "We feel that the procedure that Nominet utilise to settle disputes is unfair and biased towards big business at the expense of legitimate small British companies," Cohen told The Guardian. "It's a matter of principle now. I paid for it and if Apple had contacted me nicely without lawyers we would have sold it to them."
