As expected, President Bush signed the so-called "CAN SPAM" bill into law today, effectively legalizing spam. What the law does is make sure that anyone now has the right to spam you legitimately, so long as they provide contact information and a way to opt-out. This means, the floodgates will open as all those out-of-work telemarketers now have a new job: spamming you. Wasn't the law supposed to stop spam? Well, the one anti-spam idea in the bill is that it bans people from faking headers for the sake of spamming - which would make a difference if spammers actually cared about the law. They've shown already that they're not too concerned, and thanks to their ability to fake headers and route their spam through many different computers, it will be very difficult to track them down. So, now we'll be getting much more "legitimate" spam, and just as much, if not more, fraudulent spam. Why is this a good law again?

It appears that politicians are increasingly paying attention to internet "evils" along the lines of spyware, spam and popups. In all cases, these are instances where the openness of the network has been abused, creating certain problems. However, it's not clear that any of these legislative solutions are likely to do any good. We already pointed out how ineffec tive CAN SPAM has been, but a few interesting things happened over the weekend in the areas of popups and spyware. First, a Utah court ruled that pop up ads were not covered by an anti-spam law in that state. The law in question is no longer in effect, so it doesn't really matter -- but it does suggest that the idea of using "unsolicited" email legislation against other forms of "unsolicited" advertising is unlikely to get very far. The news that's getting the most attention, however, is California's decision to pass anti-spyware legislation that would give out fines for spyware purveyors. The text of the actual law is worth reading, as it's clear that a fair amount of thought went into it. However, it's not entirely clear it will do much to stop spyware. First, the sneakiest forms of spyware have been very careful to hide who is really responsible for the products -- meaning, they're likely to successfully remain hidden from any lawsuits. The just slightly more legitimate adware variant of spyware, on the other hand, has always been more about social engineering than any technical trickery. That is, they bury the permissions in a ton of language so that no one is really sure what they're agreeing to. Assuming this continues, these firms will be able to claim that they presented the end user with a choice, and those end users agreed to move ahead with the installation.

The latest study on spam trends appears to show that financial spam is outpacing pharmaceutical spam - though, honestly, so much of both is coming out that it's really hard to imagine that this matters at all. Meanwhile, it seems that porn spam is increasingly less interesting to spammers as the numbers have been on a noticeable decline for quite some time. No matter what, though, it appears that CAN-SPAM has done absolutely nothing to slow down the amount of spam sent.

Well gosh, best of luck with the viral marketing thing there, Dr Pepper/Seven Up (DPSU). I think if I were handed the problem of how to get word out about ‘extreme milk’ that’s the road I’d take. It just feels right.

Here in the land of cheese-eating surrender monkeys (last week the Chirac government issued mandatory t-shirts carrying the slogan ‘anti-American, PoMo, MultiCulti and mocking your fat ass’) they’ve been selling nuked milk for years – in fact it’s hard to find any fresh stuff past the aisles of hideous, plasticky milk in cardboard boxes at room temperature, with expiry dates generations away, owing to all that mad cow business.

Hey! Where's the problem?: A heart-warming story here out of the Dallas area.

...a 13-year-old boy at Richland Middle School in Richland Hills was suspended for three days in December because he sent that simple message ["Hey!"] to every computer in the school using an archaic form of instant messaging. The software was created years ago in the old disk operating system used in earlier versions of personal computers.

Carl Grimmer's father taught him how to send messages through network computers as part of a tutorial on how DOS worked.

Thank God they caught that little Mitnick wanna-be. You gotta stay on top of this stuff, lest you get sidetracked by vastly more important things.

I'll go along with the thought that most of today's nefarious hackers (and they have brought into ill repute what was once a term of respect) are lazy. But I think they're too lazy even to do a spot of reverse-engineering. All they need to do is to read the Microsoft Knowledgebase article detailing the extent and cause of the vulnerability to help them create an exploit by adapting someone else's real hacking work.
