The higher-capacity batteries are rated at 59 watt hours and 71 watt hours, 12 percent and 29 percent more respectively than Apple's stock battery. Apple is offering consumers who had battery problems with older versions of the popular iPod digital music player $50 vouchers and extended service warranties under a tentative settlement in a class-action lawsuit. According to AP, lawyers representing consumers in the state court case said that the settlement could affect as many as 2 million people nationwide who purchased first-, second- and third-generation iPods through May 2004. Apple confirmed the settlement but has not officially commented. The settlement comes after eight consumers filed a suit in 2003, alleging that the iPod failed to live up to claims that the rechargeable battery would last the product's lifetime and play music continuously for up to 10 hours. According to the terms of the settlement, people who fill out a claim form are entitled to receive $50 redeemable toward the purchase of any Apple products or services except iTunes downloads or iTunes gift certificates. Consumers will be notified of the tentative settlement in three ways: by e-mail, by letters, and through advertisements in USA Today and Parade Magazine in the next month, said Elizabeth C. Pritzker, an attorney at Burlingame-based law firm Cotchett, Pitre, Simon & McCarthy LLP, which represented two plaintiffs. Apple has agreed to pay up to $2.8 million to the two law firms that represented consumers.

A few weeks ago, Xeni posted about Talking Panda, an iPod application containing hundreds of common words and phrases in your choice of three languages. It seemed like a great deal for $10, so I bought the French version. (I'm going to be spending several months in Paris in the fall.) The bummer though is that for some reason, Talking Panda requires iPods with firmware v2.0 or later. It won't run on the first or second-generation iPods (like mine). Basically, if you bought your iPod before May 2003, you're out of luck. I emailed info@talkingpanda.com and developer Bob Ippolito responded right away:
"The iPod 1.x firmware is simply not capable of using Talking Panda. You can either purchase a new iPod, give the software to a friend as a gift, or I can offer you a refund of $8. Unfortunately it costs us $1 for each transaction (once for sale, once for refund), so I can not offer you a full refund."
The $2 loss won't kill me and, besides, it's my own fault for not reading the system requirements on the Talking Panda site. But I am annoyed disappointed that I can't use the software! It sounds like a useful application and I wish there was a way to get it to run on my iPod. Or that Bob would develop a version that does. Link

"You should ask Apple, not me. The revision 1 and 2 iPod hardware is technically capable of doing the things that the newer iPods do, at least in this case, but they simply have chosen not to add the functionality to the older firmware. If you want to do cool new things with the Notes functionality, you simply need to buy a new iPod. Seriously, there is no possible way for me to do anything for older iPods, short of developing a new firmware image myself and having the users void their warranty and lose iTunes integration! The iPod firmware is an extremely closed environment and I was lucky that I was able to get the kind of integration that I did."

c_flash_dime_bit.jpgPretec Electronics Corporation, apparently unaware that more than eight competing formats already exist in this market, has developed a new flash memory card called the C-Flash. Smaller than a dime, Pretec seems to be gambling on the "hope your customers lose your product and don't learn from their mistakes" business model. Cards with capacities up to 1GB will be available by June, and they're sampling them in mobile phones, which is just about the only place I'd want to see one. Honestly, though, there comes a point (perhaps when you require magnification equipment) when it's just too small. A note to these companies with the perpetual smaller-is-better mentalities: Just because I might one day be able to carry all of my media collection as well as the Library of Congress on a card the size of an eyelash doesn't mean I'll want to, dig?
