12/22/2004 01:26 AMThree individuals are being sued by Apple for illegally distributing
test copies of the Tiger OS on a file-sharing website, Reuters is
reporting today.
Apple claims in its suit that two different versions of Mac OS X,
code-named Tiger, were made available on the Web on or about Oct. 30
and Dec. 8 of this year. The company has said it will ship Mac OS X
“Tiger” in the first half of 2005, after previewing it to the Mac
community at a trade show last June.
Apple said in its lawsuit that the two different versions of Tiger
were made publicly available by the men, who were members of the Apple
Developer Connection. “Members of Apple Developer Connection receive
advance copies of Apple software under strict confidentiality
agreements, which we take very seriously to protect our intellectual
property,” the company said in a statement.
According to the suit, the men released the software on a Web site
that employs BitTorrent file-sharing technology, which is used to
rapidly distribute large files of electronic data, and is also widely
used to distribute pirated copies of motion pictures via the Internet.
Yesterday, Apple filed a lawsuit against unnamed individuals who
leaked details about new products by posting information on the
Internet.

Dvorak reports
that the leak about Apple switching from IBM PPC chips to Intel was
leaked by someone at IBM to analysts who leaked it to CNet or someone
close to CNet and then somehow the Wall Street Journal got the story.
He wonders whether Apple was suing bloggers in anticipation of this
announcement to try to plug the leaks. Dan Gillmor wonders whether
Apple is going to sue CNet.

new products by posting information on the Internet, Reuters is
reporting today.
According to Reuters, Apple said in the seven-page civil complaint
which it filed on December 13 that it did not know the "true names or
capacities, whether individual, associate, corporate or otherwise," of
the defendants. Once they have been discovered, the Cupertino,
California-based company said it would amend the complaint.
The complaint alleges that “an unidentified individual, acting alone
or in concert with others, has recently misappropriated and
disseminated through Web sites confidential information about an
unreleased Apple product. To succeed, Apple must develop innovative
products and bring those products to market in advance of its
competitors. If Apple competitors were aware of Apple's future
production information, those competitors could benefit economically
from that knowledge by directing their product development or
marketing to frustrate Apple's plans.”
"Apple has filed a civil complaint against unnamed individuals who we
believe stole our trade secrets and posted detailed information about
an unannounced Apple product on the Internet," the company said in a
statement provided to Reuters. "Apple's DNA is innovation and the
protection of our trade secrets is crucial to our success."

iTunes customer is suing Apple, claiming that he is forced to buy an
iPod if he wants to listen to his music on the move. Thomas Slattery,
from California, filed the lawsuit for unspecified damages over the
inclusion of Apple's "
Fairplay" Digital Rights Management system in
tracks bought over iTunes. "Fairplay" encodes files in the
AAC format, and downloaded songs cannot be transferred to MP3 players
- except Apple's own iPod.
The suit alleges Apple has broken anti-trust laws by only allowing its
songs to be played on its own player. The majority of MP3 players
support rival Microsoft's WMA format which also has DRM. The WMA
standard is also used by most online music stores, including
Napster. Apple is
believed to hold as much as 87% of the digital music player market,
with more than six million iPods now sold.
It alleges that "Apple has turned an open and interactive
standard into an artifice that prevents consumers from using the
portable hard drive digital music player of their choice, even where
players exist that would otherwise be able to play these music files
absent Apple's actions". Mr Slattery described himself as an
iTunes customer who "was also forced to purchase an Apple
iPod" if he wanted to take the music he had bought with him.
