Fans of live music received a helping hand from Judge Harold Baer Jr today as he struck down a lawsuit brought against a New York record dealer. Under previous Bootleg law, the RIAA had brought a lawsuit against the dealer for selling recordings of live shows; the dealer was convicted in 2003 yet appealed the ruling.

He was convicted of "unauthorised recordings of live performances by certain music artists through his business". However, with today's ruling the decision was over turned. Judge Baer Jr commented that the previous law had provided "seemingly perpetual protection" and was thus invalid. He also described it as “unfair”.

The Recording Industry Association of America (RIAA), an industry lobby group, announced that they were disappointed with the ruling, and would be reviewing the decision. Spokesman Jonathan Lamy said "It stands in marked contrast to existing law and prior decisions that have determined that Congress was well within its constitutional authority to adopt legislation that prevented trafficking in copies of unauthorised performances of live music."

U.S. District Judge Kollar-Kotelly, the same judge who threw out the Microsoft break-up ruling, and backed the feds in the Gitmo case, issued a 157-page ruling today which rejects 15 of the 19 federal rules implementing the two year old US campaign finance law. While the ruling does not affect the law's key prohibition against large donations to political parties (known as "soft money") it does seem to create some uncertainty for political fund-raising, with only six weeks to go until the elections.

We've been doing bootlegs / mash-ups for a few years now. For the last several months, we've been working with MTV on exclusive bootlegs for a new show called ""MTV MASH" which is broadcast all around Europe 3 times a week. We already made12 tracks for the show so far. If you want to listen to our bootlegs, check out our website, it's still under construction, but there's already a lot of tracks to listen to.

Microsoft's anti-Sasser-worm patch can't be applied to copies of Windows with serial numbers associated with bootleg or fake copies. It's an interesting dilemma for MSFT: the more unpatched copies of Windows (whether legit or not) the worm infects, the worse it becomes for all unpatched users, including those who paid their license fees. It's like denying smallpox vaccinations to known crooks, then having to pay the social cost of the smallpox outbreak that infects everyone who hasn't had a shot (including honest cits). Xeni Jardin: This morning I went to the LA garment district knockoff haven known as Santee Alley, with pals Jeff Koga and Sean Bonner. We found lots of neat-o bootleg crap, including these awesome framed pirat e gangsta artworks (bad unauthorized photocopy of a still from Scarface on one side, and little diorama of toy machine gun, fake money, and blinged out bullets on the other side). Other finds included scrol ling digital LED belt buckles, clothing stores promising plus size fashions for "Phat Women", toy laptops running pirated warez, and much more. The best we can't blog yet... stay tuned for a report on the best booty of pirate-town, slated to run in Wired News on Tuesday (with photos shot by Sean and Jeff).
