problems with the patent system and suggesting
it's
about time something was done to fix it. They suggest that there
need to be more patent examiners, there needs to be a better process
for contesting patents, and examiners need to reject more "obvious"
patents. Of course, as another article about the patent system makes
clear, the government
sees
the patent office more as a revenue generator rather than as a
force for innovation. As such, they're not that interested in either
spending more on it or making it harder to receive patents. As far as
they're concerned, the more patents granted means more people will
apply, and more funds will go into the patent office coffers - which
can then be raided to pay off other government bills.

copyr
ight law was harming, not helping, innovation. To go with that,
how about an article from the Washington Post about how
the patent system is harming, not helping, innovation.
While the first article looked at DMCA smack-down suits, this one
looks at all of the little patent shops that buy up ridiculous
patents, don't actually build anything, wait for someone else
(completely independently) to build something similar, and then sue
them. It also looks at big companies who patent thousands of ideas
every year, and then threaten any small company that might compete
with them to "license our patents or else." The article mentions that
many are hopeful that the
resigna
tion of the current USPTO directer will encourage real reform
(despite all the praise he's receiving for being a "reformer"). From
the quotes from the incoming director, though, I wouldn't hold my
breath. In response to an FTC report that loudly questions the
current patent system, the new USPTO director basically says that his
hands are tied by treaty agreements the US has. He is happy, however,
that the FTC suggests the patent office gets more money. Big surprise
there. The money will go to more patent examiners, which just means
that bad patents will get approved that much faster. What's needed is
a real rethinking of the process. If the point of patents is to
encourage innovation, we need to see if that's really happening or (if
as appears in many cases) it's really just legalized extortion.

I reported back in September 2003 that an Indian
newspaper reported a local company receiving an outsourcing contract
from the Republicans for fund-raising calls. The Republicans denied
this at the time. Dvorak has an
update.

The Texas outfit may have actually got away with its outsourcing
exercise if it had not been for the poor training given to Indian
telemarketers who handled the job. Sources here said the India-based
operation was exposed when one American who received a fund-raising
phone call on behalf of the Republican Victory Committee wanted to
know where the call was coming from.
“The Washington DC of Virginia,” the caller answered.
Washington, the US capital, is actually in DC, short for District of
Columbia, and Virginia is its neighbouring state

personally have nothing against outsourcing to India, but it probably
looks bad for the RNC.

people get
annoyed with others talking on mobile phones because they only hear
one half of the conversation. At the time, I wrote that this made
sense as periods of silence followed by talking are a lot more jarring
to the passive listener. However, this BBC report claims that the
reason for the annoyance
is that it
shows that we're more curious about what the other party is
saying. I'm not sure I buy that. It seems much more likely that it's
the variability in noise, from silent to noisy rather than any form of
curiosity. When the conversation is at a constant hum (even when
loud), it's much easier to tune it out. Still, the findings do go
against the opinion many people have expressed that things like
"push-to-talk" where the phone usually acts as a speaker phone would
be more annoying since we get to hear both sides of the conversation.
In fact, the researchers behind the study are even suggesting that
mobile phone makers may want to explore adding speaker phones to more
phones to make them
less annoying. Of course, the study only
set up two conditions: a conversation on a mobile phone and a
face-to-face conversation. They didn't test the speaker phone
situation to see how annoying that was. It's possible that the
annoyance factor comes from the inability to make use of body language
to express concepts as well, leading to a different tone of voice.

commercial section with ads from law firms. A couple of them were
intellectual-property specialists and I snarled internally; whatever
you think about patent law, as a longtime businessman I’m pretty
convinced that the IP law profession, while it contains many good and
intelligent people, is collectively a giant leech sucking money and
time out of the community of innovators. Having said that, two of the
lawyers’ blurbs jumped out at me; both about proposed US legislation
which would institute a new process, within the PTO as opposed to the
courts, for a quick challenge to the validity of a patent. This is
important, because today, defending yourself against
patent-infringement litigation is insanely expensive, $1M and up, way
up. This is why most companies, in particular small companies, roll
over and settle quickly when they get hit with this kind of lawsuit,
no matter how dopey the patent is. Here are the two reports: Defending Against
Patent Greenmail (which begins Patent “trolls” are
currently the subject of much discussion...; most IP specialists
don’t like to admit that patent trolls exist, but they do) and New USPTO
Post-Grant Patent Opposition Legislation on Horizon. I think the
high-tech business community ought to get behind this legislation,
big-time. Everyone except the patent trolls.

decided to propose abolishing the compulsory right granted by
section 115 of the Copyright Act. This is
the provision that gives recording artists the right to record
"covers," so long as they pay a specified fee.
Remember
this quote from a 1967 House Judiciary Report, considering a
modification to the law as it existed then:
[T]he record
producers argued vigorously that the compulsory license system must be
retained. They asserted that the record industry is a
half-billion-dollar business of great economic importance in the
United States and throughout the world; records today are the
principal means of disseminating music, and this creates special
problems, since performers need unhampered access to musical material
on nondiscriminatory terms. Historically, the record producers pointed
out, there were no recording rights before 1909 and the 1909 statute
adopted the compulsory license as a deliberate anti-monopoly condition
on the grant of these rights. They argue that the result has been an
outpouring of recorded music, with the public being given lower
prices, improved quality, and a greater choice.
Copyright Law Revision, Committee on the Judiciary, 90th Cong. 1st,
Sess., Rep. No. 83 66 (March 8, 1967).
Apparently the Registrer believes performers no longer "need
unhampered access to musical material on nondiscriminatory terms."

third grade. He likes school, and he's pretty good at it. He started
reading chapter books this year, and he likes that. He wishes he could
go to school today, but he can't. He lives with his mom in their 1985
Mazda GLC. They get in trouble if they stay in one place for more
than a few nights, so he can't take the school bus. This morning
Robert's mom can't take him to school. She's too busy. This happens to
Robert a lot. It makes him really sad. He remembers when he was in
first grade he and his mom lived in an apartment. It wasn't a nice
apartment, it kinda smelled funny, the carpet was a weird orange
color, and the people who lived downstairs scared him. He didn't like
it there, but now he just wishes they could go back. He doesn't
understand why he and his mom have to be poor. One time he asked his
mom, and she started crying. He doesn't ask her questions like that
anymore. This is not an uncommon story. In 2003 there were 35.9
million people living below the poverty line in the United States of
America, 1.3 million more than in 2002. In addition, there were
millions living within the penumbra that surrounds 'official poverty',
with incomes that fell above the poverty line but bellow the threshold
for a decent standard of living.
