Although Apple's name was brought up repeatedly during a congressional subcommittee hearing on digital music Wednesday, the company was nowhere to be found, much to the ire of the subcommittee's chairman, Republican congressman Lamar Smith of Texas, who also pointed the spotlight at Apple's current dominance of the commercial online music download marketplace. The hearing on "Digital Music Interoperability and Availability" took place in Washington, D.C., in front of the House of Representatives Committee on the Judiciary's Subcommittee on Courts, the Internet and Intellectual Property.

According to a story in today's Financial Times, music companies are upset because, get this, customers are flocking to buy legal digital downloads.

For several years, the record companies have complained about unauthorized peer-to-peer file sharing. Now, they are finally generating significant revenues from users paying to receive their songs over the Net. And the labels' response is to complain that prices must be set too low. There were other, higher-priced digital download services around before Apple made 99 cents the standard price on iTunes, and they failed to catch on. That seems to suggest the current prices are in the sweet spot of the market, stimulating demand and luring users away from P2P downloads. The record companies seem to think otherwise.

In most businesses, news that customers are buying your products in droves would be met with jubilation. But in an industry used to controlling distribution chains and prices through rigid oligopolistic practices, that scenario is met with fear. Of course, if prices for legal digital downloads go up, illegal digital downloads start to look more attractive again. The labels may be about to cut off their noses to spite their faces.

Digital music may be great for distributing songs, but some are upset about losing out on album cover art. Of course, plenty of cover art is available online, and some of the new download stores include the ability to offer cover art and information. However, not everyone does this or feels comfortable with it. There's one interesting suggestion in the article: a band's website is the new cover art. The problem with that, however, is that there's no historic record of what their website looks like with each release. With a band, many people form some association between the cover art of an album and the music on that album. That's much more difficult with a website that no longer exists. It is true that (at least for me) album cover art is closely associated with the music. I've found that to be especially true when I've ended up with used or pre-release CDs that don't contain the cover art. When I later see the actual cover art it often is a bit jarring, because it doesn't necessarily fit with how I've been experiencing the music. I recently ordered a CD online from a musician (directly from his website) who I've been a fan of for over a decade. There were some problems with the order, and eventually the musician just burnt me a copy of the CD and included a second CD with new stuff he was working on (along with a hand written note listing the songs and apologizing for the order taking "bloody forever"). In both cases, since the CDs have no artwork I've been having a little bit of trouble "picturing" the album in my head. I'd never realized that this happens, but it seems that I very closely associate the cover art with the music itself.

Because there aren't already enough different (and often incompatible) music download stores online, various British newspapers are now looking to get into the game. It seems odd that so many brands that have absolutely nothing to do with music retailing somehow think they can now make selling downloadable music a worthwhile business, especially when there's so much competition and so few ways to differentiate.

As Microsoft gets ready to lau nch their own music download store, Apple has a carefully timed announcement adding an affiliate program to iTunes, so that individuals and organizations can get a tiny piece of the pie for every paid download they push on people. The end result, of course, will be to make iTunes' already miniscule margins even smaller. This, obviously, is of little concern to Apple, since they still view the iTunes store (properly) as a promotion for selling iPods. Meanwhile, Napster, fresh from sheddin g their core Roxio software business appears to be in complete denial about the marketplace. In an interview, Napster's CEO brushes off all of the competitive questions by pretending the real competition isn't competition, and then pointing out how badly they trash the non-competition. Obviously, Apple's iTunes is their main competition. However, he brushes this aside, pointing out that Apple only does pay-per-download, whereas Napster does pay-per-download and subscriptions. Since iTunes has no subscription offer, apparently, they're nothing. No customer anywhere would ever think of replacing one with the other, apparently. Of course, he seems to be forgetting two things: customers define what the competition is by deciding what products are substitutes, and it's pretty clear they consider iTunes and Napster substitutes. He also seems to completely ignore file sharing systems, which while much of the sharing may be in violation of copyrights, is still competition. So, with those in his blind spot, the competition he does bring up is Wal-Mart and Sony, two companies who everyone knew did a dreadful job creating music download stores. Any time you have your CEO defining away your biggest competition on a technicality and then bragging about how you beat the competition who had already beat themselves, you should be worried.
